A RESOLUTION ACCEPTING THE PLAT ENTITLED
EXECUTIVE PLAZA. SUBDIVISION, A SUBDIVISION IN
THE CITY OF MIAMI; AND ACCEPTING THE DEDICA-
TIONS SHOWN ON SAID PLAT; AND AUTHORIZING AND
DIRECTING THE CITY MANAGER AND CITY CLERK TO
EXECUTE THE. PLAT AND PROVIDING FOR THE
RECORDATION OF SAID PLAT IN' THF, PII951-,IC
RECORDS OF DADE COUNTY, FLOPTDA.
WHEREAS, the City Zoning Board and the Department of Public
works have recommended the acceptance of the plat;
NOW, THEREFORE;, BE IT RESOLVED 13Y THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The plat entitled EXECUTIVE PLAZA SUBDIVISION
is a resubdivision of all of Block 2 and portion of Block 3, of
BROADMOOR SUBDIVISION, Plat Gook 2 at Paqe 37, and Tract P, RANNI
SUBDIVISION, Plat Book S5 at Page 45, and Northeast 31st Street
lying within the exterior boundaries of platted lands, all in
Public Records of Dade County, Florida; Section 30, Township 53
South, Range 42 East, City of Miami, Dade County, Florida, which
subject plat by reference is made a part hereof as if filly
incorporated herein, and which plat, together with the dedica-
tions shown thereon, and the dedications to the perpetual use of
the public of all existing and future planting?, trees and
shrubbery on said property, is hereby accepted and. confirmed by
the City of Miami, Florida.
Section 2. The City Manager and City Clerk are hereby
authorized and directed to execute the plat and cause the same to
be recorded in the Public Records of Dade County, Florida.

The Department of Public Works recommends
the approval of the plat by the City
Commission of Miami, Florida, and -certifies
its correctness as to form.
The proposed record plat entitled "EXECUTIVE PLAZA" is a resubdivision
of all of Block 2 and portion of Block 3, of BROADMOOR SUBDIVISION,
Plat Book 2 at Page 37 and Tract B, RANNI SUBDIVISION, Plat Book 85,
at Page 45 and N.E. 31st Street lying within exterior boundaries of
platted lands, all in Public Records of Dade County, Florida; Section
30, Township 53 South, Range 42 East, City of Miami, Dade County,
Florida. It will consist of three tracts containing 4.1f acres. It
is zoned C-1 and C-4.
This plat is being forwarded to your office for City Commission
action.
Also attached are the following itemized papers necessary to present
the plat to the City Commission of Miami:
(1) Resolution accepting the plat
(2) Print of proposed record plat
(3) Agreement form pertaining to subdivision improvements
(4) Opinion of Title
(5) Memorandum from the Miami -Dade Water and Sewer
Authority pertaining to water mains and appurtenances.
(6) Portion of City Zoning Sheet No. 21 showing property
platted colored in red.

The accompanying plat entitled "EXECUTIVE PLAZA" was prepared by
Biscayne Engineering Company. It is in correct form for submission
to the City Commission and is forwarded with a recommendation that
it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
(1) The property platted is a resubdivision of all of
Block 2 and portion of Block 3 of BROADMOOR SUB-
DIVISION, Plat Book 2 at Page 37 and Tract B,
RANNI SUBDIVISION, Plat Book 85 at Page 45 and
N.E. 31st Street lying within exterior boundaries
of platted lands, all in Public Records of Dade
County, Florida; Section 30, Toc,mship 53 South,
Range 42 East, City of Miami, Dade County, Florida.
It will consist of three tracts containing 4.1f
acres. It is zoned C-1 and C-4.
(2) The location of the streets and widths conform
with the standards of the Department of Public
Works of the City of Miami, Florida.
(3) As certified to by Alfred Mohr, Registered Land
Surveyor, this plat complies with the plat filing
laws of the State of Florida.
(4) The City Zoning Board of Miami, Florida, after
Public Hearing, has recommended the closing of
N.E. 31 Street between the west right-of-way line
of Biscayne Boulevard and the east right-of-way
line of N.E. 2 Avenue for a distance of 475.9t feet.
This action was confirmed by City Commission
Resolution No. 81-915.
(5) By authority of Resolution No. 21-83, adopted
February 7, 1983, the plat was recommended for
acceptance by the City Zoning Board of Miami, Florida.
(6) The attached Certificate of Title Examination dated
March 22, 1983, signed by Arnold A. Brown, Attorney,
indicates that the fee simple title to the property
platted is correctly vested in Ronald R. Fieldstone,
individually and as Trustee and Linda B. Fieldstone,
his wife and not individually and Ronald R. Fieldstone
as Personal Representative of the Estate of Samuel
Irving Fieldstone and David M. Fieldstone, a single
man, individually and as Trustee.
(7) The area platted is encumbered by mortgages and the
mortgage holders have executed the plat and joined
in its dedications.

(8) In accordance with the requirements of Chapter 54,
Section 54-30, of the Code of the City of Miami,
Florida, an irrevocable Letter of Credit No. UNB277
in lieu of a Performance Bond or Cashier's Check
in the amount of $22,500 has been signed by Robert A.
Cronin, President, Commercial Loan Division of and for
United National Bank of Miami in Favor of Ronald R.
Fieldstone, individually and as Trustee and Linda B.
Fieldstone, his wife and not individually and Ronald R.
Fieldstone as Personal Representative of the Estate of
Samuel Irving Fieldstone and David M. Fieldstone, a
single man, individually and as Trustee. This Letter
of Credit will accompany the Agreement between the
City of Miami, Florida and the principal to guarantee
the construction of landscaping, asphaltic concrete
pavement, removal of existing sidewalk, removal of
existing curb and gutter, sidewalk, curb and gutter
and curb.
(9) The location of the property is shown colored in red
on the accompanying copy of a portion of City of Miami,
Florida, Zoning Sheet No. 21.
(10) The attached Resolution has been prepared for the
acceptance of the plat by the City Commission of Miami,
Florida.

Trustee, joined by his wife, LINDA B. FIELDSTONE (not
individually, but as the wife of Ronald R. Fieldstone);
RONALD R. FIELDSTONE, as Personal Representative of the
ESTATE OF SAMUEL IRVING FIELDSTONE; DAVID H. FIELDSTONE, a

"Principal") up to an aggregate amount of TWENTY-TWO

Street, Miami, Florida 33128, that we elect not to so
renew this letter of credit. Upon receipt by you of such
notice, you may draw hereunder by your drafts drawn at
sight on us and accompanied by a statement signed by the
Director, Department of Public Works to the effect that
the aforesaid bond is in full force and effect on that
date.

Ile hereby agree with you that all drafts drawn under and
in compliance with the terms of this credit shall be duly
honored upon presentation to the drawee.
Drafts must be drawn and negotiated not later than
April 28, 1984. Each draft must state that it is "Drawn
Under Irrevocable Letter of Credit No. UNB277 of the
United National Bank of Miami, dated T4arch 18, 1983," and
the amount thereof endorsed on this letter of credit and
also on our correspondent's advice of this credit. We
hereby agree with the drawers, endorsers and bona fide
holders of all drafts under and in compliance with the
terms of this letter of credit that such drafts will be
duly honored upon presentation to the drawee.

Gentlemen:
This letter shall confirm that we have updated title
with respect to the Property from the day of the above
described Opinion of Title, January 24, 1983 at 8:00 a.m.
through March 22, 1983 at 1:00 p.m. Our update of title
reflects no changes in the state of title as set forth
in the above described Opinion of Title between the periods
of time covered by our update of title.
This letter shall also serve to correct certain inaccuracies
in the Opinion of Title referred to above as follows:
1. In numbered exception 22, the correct Clerk's file
number for the Mortgage referred to therein is
G7R-101245 instead of 67R-101243.
2. In item 27, the correct recording information for the
Easement Agreement described therein is Official
Records Book 11579, Page 196 ratifier than Page 194.

To: Dade County, a political subdivision of the State of
Florida.
With the understanding that this Opinion of Title is
furnished to Dade County, Florida in compliance with its
Ordinance No. 57-30, and as inducement for acceptance of a
proposed final subdivision plat covering the real property
hereinafter described. It is hereby certified that we have
examined the complete Abstract of Title completely covering the
period from the beginning to January 24, 1983 at 6:00 A.M.
inclusive of the following described real property:
All of Lot 1 lying west of Biscayne
Boulevard and Lots 2, 3, 4, 5, 6, 7, 8, 9
and 10, Block 2, Broadmoor Subdivision,
according to the Plat thereof recorded in
Plat Book 2, Page 37, of the Public Records
of Dade County, Florida;
and
Lots 3 and 4, less the west 10 feet of Lot
4 and less the north one-half of the alley
lying south of and adjacent to Lots 3 and

the fee simple title to the above described real property was

lying west of Biscayne Boulevard, Lots 2 and 3, Block 2,
Broadmoor Subdivision; and Lots 3 and 4 less the
west 10 feet of Lot 4 and less the north one-half of
the alley lying south of and adjacent to Lots 3 and 4,
Block 3, Broadmoor Subdivision.
2. Estate of Samuel Irving Fieldstone, also known as
Samuel I. Fieldstone and S.I. Fieldstone, as to Lots 4, 5, 6, 7
and 8, Block 2, Broadmoor Subdivision; and Tract B, Ranni
Subdivision.
3. David M. Fieldstone, as Trustee, as to Lots 9 and 10,
Block 2, Broadmoor Subdivision.
Subject to the following encumbrances, liens and other
exceptions:
AS TO ALL PARCELS:
1. General and special taxes and assessments for the year
1982 and subsequent years.
2. Rights of persons other than the above owners who are
in possession.
