A RESOLUTION GRANTING A DELAY IN
THE CO11STRUCTION SCHEDULE PREVIOUSLY
SUBMITTED TO THE CITY OF MIAMI AS RE-
QUIRED BY SECTION 601 OF THE CITY OF
MIAMI'S CABLE TELEVISION LICENSE ORDI-
NANCE TO T17.E EXTENT THAT THE CABLE
LICENSEE, IN ACCORDANCE WITH THE RE-
VISED SCHEDULE AND ATTENDANT CONDITIONS
SUBMITTED TO THE CITY MANAGER, THAT WILL
RESULT IN THE COMPLETION OF THE CABLE
SYSTEM BY NOVEMBER 19, 1984, AS REQUIRED
BY THE CABLE TELEVISION LICENSE ORDINANCE.
WHEREAS, the City's cable television licensee has encountered
delays in the process of obtaining permits for the attachment of its
equipment to utility poles; and
WHEREAS, as a result of the occurrence of conditions beyond
the control of the licensee the said licensee has fallen behind in
the construction schedule required under Section 601 of the Cable
Television License Ordinance; and
WHEREAS, on March 11, 1983, the City notified the cable licensee
of alleged violations resulting from their inability to meet the
aforesaid construction schedule; and
1•;HEREAS, under the terms of the cable television license
ordinance the licensee had 30 days to either bring the construction
into compliance with the construction schedule or refute the alle-
gations contained in the letter; and
IlHEREAS, on April 1, 1983 the licensee responded by letter but
did not refute the allegations nor had it complied with the construc-
tion schedule which compliance was required as of April 11, 1983; and
WHEREAS, under Section 1002(2) of the Cable Television License
Ordinance the City Commission may specifically approve a delay in
construction by motion or resolution due to the occurrence of con-
ditions beyond the licensee's control; and
WHEREAS, the licensee requests approval of the City Commission
for its delay in the construction of the system and has submitted a
revised construction schedule for review;

14014, THEREFORE, BE IT RESOLVED BY THE COPTISSION OF
THE CITY OF MIA14I , FLORIDA:
Section 1. The City of Miami's cable television
licenseeis hereby granted a delay in the construction schedule
previously submitted to the City of Miami as required by Sec-
tion 601 of the City of Miami's Cable Television License Ordi-
nance to the ext-ent that the cable licensee, in accordance
with the revised schedule and attendant conditions submitted
to the City Manager, that will result in the completion of
the cable system by November 19, 1984, as required by the
Cable Television License Ordinance. A variation of up to
207, from the number of miles of proofed and accepted system
proposed for completion in each month of the revised timetable
will not be considered cause for violation of Section 1002(2)
of the Cable Television License Ordinance. Powever, the
licensee must include in its monthly construction report to
the Citv Manager, the reasons for such delay in specific detail.
Further, a construction monitoring system shall be established
by the City Manager to ensure compliance with the revised con-
struction timetable. The licensee agrees to fully cooperate
with the City *tanager's monitoring system.

WITH 3,000 TO 4,000 SENIOR CITIZENS OF THE AREA; FURTHER
INSTRUCTING THE CITY MANAGER TO GRANT SAID AGENCY THE SUM OF
$2,500 IN CONNECTION WITH THE RENTAL OF SAID FACILITY.
A MOTION OF THE CITY COMMISSION GRANTING A REQUEST MADE BY
REPRESENTATIVES OF THE INTERNATIONAL FOLK FESTIVAL COMMITTEE
TO SELL BEER AT BAYFRONT PARK, MAY 12 - 15, IN CONNECTION
WITH THE HOLDING OF STAID FESTIVAL, SUBJECT TO ALL REQUIRE-
