CITY OF M.IAMI, FLORIDA, AS AMENDED, (UPON BECOMING EFFECTIVE) , TO PROVIDI., "(-'.AR SHELTERS" BY ADDING A NEW SUBSECTION 2008.4, DELPTING SUBSECTION 2008.7, AND RFNUMBI;RING EXISTING SUBSH,C'TIONS 2008.4, 2008. `i, AND 2008.6, TO 2008.5, 2008.6 AND 2008.7, RESPFCTIVELY, OF SECTION 2000 - APPLICATIONI OF ARTICLE XX —GENERAL AND SUPPLEMENTARY REGULATIONS; 13Y AMENDING ARTICLE XXXVI — DEFINITION; (DEFINING CAR SHELTERS); AND BY AMENDING THE SCHEDULE OF DISTRICT REGULATIONS, "ACCESSORY USES AND STRUCTURES" COLUMN, (PERMITTING CAR SHELTERS IN THE RS/1 AND RS/2 ONE —FAMILY DETACHED RESIDENTIAL, RS/l, ONE —FAMILY DETACHED RN,SIDENT I.AL, AND RG/1 GENERAL RESIDENTIAL [ONE AND TWO FAMILY], BUT NOT IN R(3/2 [GENERAL, RESIDENTIAL] AND OTHER DISTRICTS) OF THE OFFICIAL SCHEDULE OF DISTRICT REGULATIONS MADE A PART OF SAID ORDINANCE NO. 9500, BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 300, THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT AND CONTAINING A SEVER.ABIL'ITY CLAUSE. WHEREAS, the Miami Plannina Advisory Board, at its meeting of December 8, 1982, Item No. 2, following an advertised hearing adopted Resolution No. PAB-96-82, by a 7 to 0 vote, RECOMMENDING APPROVAL of amending Comprehensive Zoning Ordinance No. 9500, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this ;natter, deems it advisable and in the best interest of the general welfare of the City of Mia,ni and its inhabitants to grant these amendments, as hereinafter set forth; NOW, THEREFORE, ICE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 9500, adopted September 23, 1982, as amended, the Comprehensive Zoning Ordinance of the City of Miami, Florida, is hereby further amended to provide for "Car Shelters" by adding a new subsec- tion 2008.4, deleting subsection 2008.7, and r_enum- i h. erinq existiny subsections 008.4, 7.008.5 anti 2008.6 to 2008.5, 2008.6 and 2008.7, r.espectiveI of :;RCTTON 2000 - APPLICATION of ARTI(;),F 20 -GENERAL, AND SUPPLEMENTARY RI-,c;ULATIONS to read as f_o11.ows: L 1 2000. APPLICATION 2008.3.4 Canopies over Vehicular Areas. k 2008.4, Car Shelters; Definition; Limitations and Requirements. -- A car shelter is an accessory structure made of canvas, aluminum, or similar materials, or any combination thereof, on movable framing for the shade and she]_ter of one or two _private,passenger vehicles. The structure shall meet the requirements of the South Florida Building Code but shall he designed and constructed in a manner which pemits disassembly and reassembly. ^ Car shelters are subject to the following limitations and requirement: (a) Only one (1) single (1 car capacity, or one (1) double (two car capacity), or two (2) single carports will be permitted for a two-family dwelling provided the lot averages fifty (50) feet in width. Only one (1) single or one (1) double (two car capacity) carport will be permitted for a single family dwelling where the lot averages fifty (50) feet n width. Only one (1) single (one car capacity) carport will be permitted for single or two-family dwellings where the lot averages less than fifty (50) feet in width. The length dimension of the carport shall be perpendicular to the street where the average lot width is sixty-five (6 ) feet or less. The horizontal dimensions including the supporting framing shall not exceed 9 feet in width and 19 feet in length for single car shelters, 19 feet in width and 19 feet in length for double car shelters, and shall not exceed 8 feet in height. In no instance shall the permitted lot coverage for all accessory structures be exceeded. (b) Car shelter may be located in a required front or side street yard however the roof structure shall not cantilever more than 2 feet into the required side or rear yard. (c) Such shelters shall remain unenclosed on at least 3 sides, except for permitted land- scaping, and shall not be used for the storage of any goods or for any use other than for the shelter of private passenger vehicles. The Planning Advisory Board, at its meeting of December 3, 1982, Item 2, following an advertised hearing, adopted Resolution PAB 96-82 recommending approval of the above petition as amended by a vote of 7 to 0 by adding a new section 2003.4, deleting section 2008.7, and renumbering sections 2003.4, 2003.5 and 2003.6 to 2008.5, 2003.6 and 2003.7, respectively, by amending Article 36 to reference the definition of car shelters and by amending the schedule of district regulations, accessory uses and structures to permit car shelters in the RS-1 and RS-2 (One Family Detached Residential), RS-l.l (One Family Detached Residential), RG-1 [General Residential (One and two family)] but not in RG-2 [General Residential (and other)] districts. Consideration of amendments to the New Zoning Ordinance 9500 of the City of Miami, effective April 6, 1983, by amending ARTICLE 20 - GENERAL AND SUPPLEMENTARY REGULATIONS, by adding a new Section 2008.4 to provide for the regulation of car shelters; by amending ARTICLE 36 - DEFINITIOdS to further define the existing definition for car shelters, and by amending the Schedule of District Regulations, Accessory Uses and Structures, to permit car shelters in RS-1 and RS-2 One Family Detached Residential, RS-1.1 One Family Detached Residential, RG-1 General Residential (One and Two Family) but not in RG-2 General Residential (and other) Districts. ANALYSIS: The City of Miami Planning Department has experi- enced several requests for car shelters and there is no provision in the new zoning ordinance which addresses the needs of car shelters specifi- cally. The City Commission directed the Planning Department to develop a recommendation which would incorporate car shelters as a unique temporary component in the zoning ordinance. RECOMMENDATION: PLANNING DEPARTMENT: Approval (see attached). PLANNING ADVISORY On November 17, 1982, passed a Motion to continue BOARD: to December 8, 1982.
