AMENDED, THE COMPREHENSIVE ZONING ORDINANCE
FOR THE,' CITY OF MIAMI, BY AMENDING ARTICLE II
(DEFINITIONS) SECTION 2, BY RENUMBERING
EXISTING SUBSECTION (13-A) TO (13-B), AND
EXISTING SUBSECTION (13-B) TO (13-C) , AND
ADDING A NEW SUBSECTION (13-A) ENTITLED
"CARPORTS, TEMPORARY" TO SAID ARTICLE; BY
ADDING A NEW SUBSECTION (8) , PERTAINING TO
"TEMPORARY CARPORTS" AS AN ACCESSORY USE, TO
SECTION 19, ARTIICLE IV - GENERAL PROVISIONS;
FURTHER BY AMENDING SECTION 1 OF ARTICLE, V
(ONE FAMILY DWELLINGS, R-1, R-lA, R-IB
DISTRICTS) AND SECTION 1 OF ARTICLE VI (TWO
FAMILY DWELLING - R-2 DISTRICT) TO PROVIDE
FOR CARPORTS; AND 13Y REPEALING AI,L
ORDINANCES, CODE SECTIONS OR PARTS THEREOF IN
CONFLIC`C AND CONTAINING A SEVERABIL.I`I'Y
CLAUSE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of December. 8, 1982, Item No. 1, following advertised hearing
adopted Resolution No. PAB-95-82, by a 7 to 0 vote, RECOMMENDING
APPROVAL of amending Comprehensive Zoning Ordinance No. 6871, as
hereinafter set forth; and
WHEREAS, the City Comn-tission after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
these amendments, as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, as amended, the Compre-
hensive Zoning Ordinance for the City of Miami, is amended by
renumbering subsection (13-A) entitled CATERING SERVICE, SOCIAL
OR HOME, of Section 2, Article II - DEFINITIONS, to (13-B) and,
adding a new subsection (13-A) to said Article and Section to
read as follows: 1
"ARTICLE II - DEFINITIONS
Section 2. - TERMS DEFINED

Section 2. C)rdinance No. 6871 is further amended by
adding a new sub -sect ion (8) to Sect ion 19, ARTICLE IV - "GENERAL
PRC)VISIONS, to read as follows:

(3) Te.mporary carports as an accessory use to a
principal use may be erected in R-1, R-lA,
and R-2 zoning districts subject to the following
l iffAtat ions :
(a) Temporary carports may be located in a
required front or side street yard but shall
not be located closer than 5 feet from any
side or rear lot line. Roof structures of
the carport way cantilever 2 feet beyond the
aforementioned side or rear requirements.
(b) Only one (1) single (1 car capacity), or one
(1) double (two car capacity), or two (2)
single carports will he permitted for a
two-family dwelling provided the lot averages
fifty (50) feet in width. Only one (1)
single or one (1) double (two car capacity)
carport will be permitter) for a single fauflily
dwelling where the lot averages fifty (50)
feet in width. Only one (1) single (one car
capacity) carport will be permitted for
single or two-family ,dwellings where the lot
averages less than fifty (50) feet in width.
The length dimension of the carport shall be
perpendicular to the street where the average
lot width is sixty ive (65) feet or less.
The size shall not exceed 9 feet in width and
19 feet in length for single carports, 19
feet in width a-n-d----17 feet to length for

:)n 3. ARTICLE V of said Ordinance is amended by
ew Subsection (5-B) to read as follows:
"ARTICLE V - ONE FAMILY DWELLING - R-1, R-lA, R-lB
DISTRICTS
Section 1. - USE REGULATIONS

(5-B) 'Temporary carports for parking of private
passenger vehicles as an accessory use to
a _principal use. The temporary carport
shall he constructed, located, maintained
and used in accordance with requirements
set forth in Article II, Section 2 (13-A)
and Article IV, Section 19 (8)."
Section 4. Article VI of said Ordinance is amended by
adding a new Subsection (3-B) to read as follows:
"ARTICLE VI - TWO FAMILY - R-2 DISTRICTS
Section 1. - USE REGULATIONS
(3-B) Temporary carports for parking of private
passenger vehicles as an accessory use to
a principal use. The temporary carport
shall be constructed, located, maintained
and used in accordance with requirements
set forth in Article II, Section 2 (13-A)
and Article IV, Section 19 (8)."
Section 5. That all Ordinances, Code Sections, or parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.

•Sectii�n 6. Should any part or provision of this Ordi-
nance be declared by a court oC competent jurisdiction to be
invalid, the same shall not affect the validity of the Ordinance
as a whole.

"It is recommended that Articles II,
IV, V and VI of the Comprehensive
Zoning Ordinance 6871 be amended
to allow carports in R-1, R-lA,
R-IB and R-2 zoning districts."
The Planning Advisory Board, at its meeting of December 8, 1982, Item 1, following
an advertised hearing, adopted Resolution PAB 95-82 recommending approval of
the above petition as amended by a vote of 7-0 by renumbering sub -section (13-A)
titled Catering Service, Social or Home, or Section 2, ARTICLE II - Definitions,
to (13-3), adding a new sub -section (13-A), Section 2, ARTICLE II - Definitions,
_ titled "Carports, Temporary", and by adding a new sub -section to Section 19,
ARTICLE IV - General Provisions, pertaining to "Temporary Carports" as an
accessory use and by amending ARTICLE V - One Family Dwelling R-1, R-IA, R-lB
Districts, Section 1 and ARTICLE VI - Two Family Dwelling R-2 Districts, Section 1,
to allow certain carports as permitted uses under accessory structures.
Backup information is included for your review.
An ORDINANCE to provide for this Ordinance Amendment has been prepared by the
Cicy Accorney's Office and submitted for consideration of the CiLy Commission.

In response to the request of Commissioner J. L. _Plummer, the
following wording, if inserted into the proposed carport ordinance,
would provide for the elimination of street yard area (setback) for
temporary carports.
This wording is to replace paragraph (a), sub -section (8), Section
19 of the proposed amendment to Ordinance #6871:
"Temporary carports may be located in a required front
or side street yard but shall not be located closer than
5 feet from any side or rear lot line. Roof structures
of the carport may cantilever 2 feet beyond the afore-
mentioned side or rear lot line."
The wording for the proposed amendment to Ordinance #9500, paragraph
(b) of -subsection 2003.4 will be as follows:
"Car shelters may b.e located in a required front or side
street yard however the roof structure shall not cantilever
more than 2 feet into the required side or rear yard."

PETITION: 1. Consideration of amendments to the Comprehensive
Zoning Ordinance #6871 as amended, by:
Amending ARTICLE IV, Section 19 - ACCESSORY
USES AND STRUCTURES, to provide for the regu-
lation of carports; and by amending ARTICLE II -
DEFINITIONS; to provide for appropriate defini-
tions relating to carports.
(This is a companion item to Item 2.)
REQUEST: To allow single and double temporary carports in
yard areas in R-1, R-lA, R-1B and R-2 districts which
were not previously permitted.
ANALYSIS: The City of Miami Planning Department has experi-
enced several requests for carports and there is
no provision in the current zoning ordinance
which addresses the needs for carports specifi-
cally. The City Commission directed the Planning
Department to develop a recommendation which
would incorporate carports as a unique temporary
component in the Zoning Ordinance.
