WHEREAS, the Miami Planninc, Advisory Board at its meeting of March 2, 1983, Item. No. 3, f.oIIowing an advertised hearing, adopted Resolution No. PAR 25-83 by a 5 to 0 vote, RFCOMMENDING APPROVAL of applying the HC-3: RESIDENTIAL OFFICI HERITAGE CONSERVATION OVERLAY DIS'T'RICT to subject property, as hereinafter set forth; and WHER 'AS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this application as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 9500, adopted September 23, 1982, as amended, the Zoning ,ordinance of the City of Miami, Florida, is hereby amended by applying the HC-3: RESIDENTIAL OFFICE HERITAGE CONSERVATION OVERLAY DISTRICT to the "J.W. WARNER HOUSE," located at 11 Southwest 5th Avenue, more particularly described as Lots 8 and 9, less the north 5 feet, of Block 18 in the plat of MIAMI (A.L. Knowlton) SOUTH, as recorded in Plat Rook B at Page 41, of the Puhlic Records of Dade County, Florida; further, the City Commission finds that the subject property is associated in a significant way with the life of a person important in the past and embodies appropriately distinguishing characteristics of an architectural style, period, or method of (-,')nstruct-on to warrant the herein action; further_', the Zoning Atlas incorporated in said Ordinance, by reference and des- cription in Artir.ln 3, Section 300, thereof, is hereby amended to reflect the herein DISTRICT. Section 2. All ordinances, code sections or parts thereof in conflict herewith are hereby r_r.pealed insofar as they are in conflict. Section 3. Shrould any part or provision of this ordi- nance be declared by a Court of competent jUr_isdiction to he invalid, the same shall not affect the validity of the Ordinance as a whole. W. Warner House, 111 SW 5 Avenue be approved." The Planning Advisory Board, at its meeting of March 2, 1983, Item 3, following an advertised hearing, adopted Resolution PAB 25-83 recommending approval of the above petition with a 5 to 0 vote on the above site as described in the designation report. Consideration of reco:rmendations concerning amend-ments to the Zoning Map of the New Zoning Ordinance 9500, effective April 6, 1983, of the City of Miami, Florida, to apply the proposed HC-1 RESIDENTIAL OFFICE HERITAGE CMISERUATION OVERLAY DISTRICT to the J_!-1. !darner House, Ill S14 5th Avenue, as described in the designation report. (This is a companion item to Item REQUEST: To apply the proposed HC-3 overlay to this historic site, as described in the attached designation report. BACKGROUND: This site was previously recognized as an historic site by the PAB and City Commission under the provision of an SPD-5 overlay zoning district. SPD-5 was not carried over into the new Zoning Ordinance 9500 (effective April 6, 1983) thus, the J.ld. Warner House must be redesignated under the provisions of HC zoning. The restoration of the building and its conversion to office use has been approved under SPD-5, and work will com- mence shortly. ANALYSIS: On December 14, 1982, the Heritage Conservation Board held a public hearing, and determined that the subject property meets the following criteria for historic site designation: 1. Is associated in a significant way with the life of a person important in the past. The J.W. Warner House was the home of J.l,). Warner and his family from the time of its construction in 1912 until the late 1970's. Warner was the founder of South Florida's first floral company, a business which he conducted from the do';rn- stairs of the house. 5. Embodies those distinquishing characteristics of an archi- tectural style, or period, or method of construction. The J.W. Warner House is an outstanding example of Neo- Classical style architecture and is particularly note;•rorthy for its temple front with massive columns. 7. Contains elements of design, detail, materials, or craftsman- ship of outtandine� giiality or �rhich re_lr_e ent a si2ific_:nt_ innovation or adaption to the SOuth Florida environment.
