A RESOLUTION ACCEPTING THE COMPLETED WORK
PERFORMED BY PYRAMID PLUMBING AND HEATING
AT A TOTAL COST OF $34,681.42 FOR EDISON
PARK POOL - SOLAR HEATING (2ND BIDDING);
AND AUTHORIZING A FINAL PAYMENT OF $867.04.
WHEREAS, there exists a contract dated October 23,
1978 between the City of Miami and Pyramid Plumbing and
Heating; and
WHEREAS, the original contract was increased on
October 17, 1979 by Resolution No. 79-690 in the amount
of $4,600.00; and
WHEREAS, the work has been satisfactorily completed,
and Pyramid Plumbing and Heating has furnished the required
documents certifying that all bills for labor and materials
have been paid in full in connection with the aforesaid
contract; and
WHEREAS, the City Manager and the Department of
Public Works recommend that the completed work be accepted
and final payment made to the contractor;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. The completed work performed by
Pyramid Plumbing and Heating for EDISON PARK POOL - SOLAR
HEATING (2ND BIDDING) at a total cost of $34,681.42 is
hereby approved.
Section 2. The proper officials of the City of
Miami are herewith authorized to pay $867.04 to Pyramid
Plumbing and Heating as full and final payment for all
work performed and all materials furnished in connection
with EDISON PARK POOL - SOLAR HEATING (2ND BIDDING).

The Department of Public Works recommends the
adoption of the resolution accepting the com-
pleted work and authorizing a final payment
of $867.04 to Pyramid Plumbing and Heating
for EDISON PARK POOL - SOLAR HEATING (2ND
BIDDING).
Pyramid Plumbing and Heating has completed the project consist-
ing of constructing a solar heating system for the Edison Park
Swimming Pool. The original contract amount was $35,710.00,
and was increased by Resolution No. 79-690 in the amount of
$4,600.00 on October 17, 1979. The completed amount is
$34,681.42.
It is now in order for the Commission to accept the completed
work and authorize final payment, after all conditions are
met.

Explanation for Overrun of Contract Time
The contract was awarded on this project September 2, 1978, and the
contractor's construction time began January 15, 1979. Almost im-
mediately after starting construction, we became aware of a problem
involving patent infringement that delayed the contractor. We had
specified a certain type of patented fitting to be used with ordinary
pipe, and the manufacturer of the fittings objected and threatened to
sue us if we did not also use his pipe. The Law Department agreed
that the manufacturer could probably successfully sue us, and thus we
elected to request an increase in contract not to exceed $4600 to.
allow the contractor to purchase and use pipe to match the fittings.
The request was granted by the City Commission. It took us until
October of 1979 to get the problem resolved.
After the system was installed, we became aware of a problem with the
controllers for the system. We found that the problem was with the
manufacture and/or the specifications, and that we could not,hold the
contractor responsible for them. They were finally resolved'when the
whole control system was rebuilt by the contractor in accordance with
directions from our Design Division.
After the controller problems were corrected the system was tested,
and it was found that additional valves and braces to keep the system
from vibrating itself apart, were necessary. At this point the con-
tractor took the position that these faults in design were problems
that should be corrected by the City, and he refused to make any
further modifications to his work. Since that time we have awaited
for the City to buy and install the necessary valves and to provide
and install the needed braces on the pipe. To date the City,
(Property Maintenance Division of Buildings and Vehicle Maintenance
Department), has not been able to do,the work, and since the park is
closed during the winter months anyway, we have not pressed them to
do so. We have reached the decision that the contractor has done
all that he should be expected to do in relation to the contract, and
we recommend that we consider his work completed and acceptable, and
that final payment be made to him.
