(3.351 F.A.R. PERMITTED), A 32.7% (9,400 SQUARE FEET) PROPOSED LOT COVERAGE FOR THE PRINCIPAL STRUCTURE [21.18% (6,089.25 SQUARE FEET) LOT COVERAGE PERMITTED] AND 0.0' WEST SETBACK AT THE MINIMUM POINT OF THE UNDERGROUND PARKING STRUCTURE (5' REQUIRED); ZONED R-CB (RESIDENTIAL OFFICE). WHEREAS, Article XXXI, of the Comprehensive Zoning Ordinance No. 6871, permits an extension of a variance by the City Manager with approval of the City Commission, for a Six month period; and WHEREAS, the City Manager recommends the extension of the variance granted by Zoning Board Resolution No. ZB-182-82; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a six month extension of a variance granted from Ordinance No. 6871, Article XI-2, Section 5, 6(1) and 9(3), to permit construction of an office building (CRYSTAL TOWER), on tentative Plat #1176 "BRICKELL SHORE TOWER," located at approximately 1198 South Bayshore Drive, as per plans on file revised "as per 8-23-82" with a 3.613 floor area ratio (FAR) (3.351 FAR permitted, a 32.7% (9,400 square feet) proposed lot coverage for the principal structure [21.18% (6,089 square feet) lot coverage permitted] and 0.0' west setback at the minimum point of the underground parking structure (5' required); zoned R-CB (Residential office) is granted. The Zoning Board, at its meeting of October 18, 1982, Item 4, following an advertised hearing, adopted Resolution ZB 182-82 by a 7 to 0 vote, granting the request for a Variance to permit construction of an office building (Crystal Tower) at approximately 1198 South Bayshore Drive, Tentative Plat #1176, BRICKELL SHORE TOWER", as per revised plans on file (8-23-82) with a 3.613 FAR (3.351 FAR permitted), a 32.7% (9,400 sq. ft.) proposed lot coverage for the principal structure (21.18% (6,089.25 sq. ft.) lot coverage permitted] and 0.0' west setback at the minimum point of the underground parking structure (5' required); zoned R-CB (Residential Office). The Planning Department has no objection to the granting of the extension for this Variance. A RESOLUTION to provide for this extension has been prepared by the City Attorney's Office and submitted for the consideration of the City Commission. RECOMMENDATIONS PLANNING DEPT. DENIAL. The Miami City Commission passed an ordinance on March 16th, 1982 amending the R-CB regulation to include not only a more liberal F.A.R., (which comprises an array of bonuses) but also a greater lot coverage per height of building. In view of these changes, the Planning Department believes that new applicants should abide by the already liberalized requirements. PUBLIC WORKS Dedication is required by plat. Extension of Time - 1198 South Bayshore Drive REFERENCES Item #27, 5/31/83 AGENDA ENCLOSURES On December of 1982, the Planning Department appealed the Zoning Board's approval of the variances granted for the subject property before the City Commission. The City Commission upheld the Zoning Board's approval over the objection of department. Notwithstanding, the department has no objection to the extension of time for the subject property. On December 16, 1982 the City Commission, upon the appeal of the Planning Depart- ment, refused to overturn the decision of the Zoning Board which, in essence, made the variances effective as of that date. On behalf of our client, Sophal, Inc., we hereby request an extension of these variances and the right to build under the RC-B zoning classi-fication as it existed on December 16, 1982, until June 16, 1934. Our client has submitted the project to major institutional lenders for the necessary financing based upon the RC-B zoning and variances thereunder. However, Sophal, Inc. has yet to reach agreement for the financing of the project.
