Miami and its inhabitants to grant this application as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 9500, adopted September. 23, 1982, as amended, the Zoning Ordinance of the Citv of Miami, Florida, is hereby amended by applying the HC-1: GENERAL USE HERITAGE CONSERVATION OVERLAY DIS`.1'RICT to "THE PAGODA," 3575 Main Highway, more particularly described as Lot 13 lying southeast of Main Highway, less the triangular portion northwest of County Road, and submerged land lying southeast to the bulkhead line, of the plat of MUNROE's Plat, as recorded in Plat Book D at Page 253, of the Public Records of Dade County, Florida; further., the City Commission finds that the subject property embodies appropriately distinquishinq characteristics of an architectural style, period, or method of construction to warrant the herein action; further, the Zoning Atlas incorporated in sai(i C)r.dinance, by reference and description in Article 3, Section 300, thereof, is hereby amended to reflect the 11prein 01��TRICT. Section 2. All ordinances, (-l)tl(- sections or parts - thereof in conflict herewith are hereby repealed insofar_ as they are in conflict. Section 3. Should any part or r)rc-)visi.on of this ordi- nance be declared by a Court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole. Consideration of recommendations concerning amendments to the Zoning Map of the New Zoning Ordinance 9500, effective April 6, 1983, of the City of Miami, Florida, to apply the proposed HC-l: GENERAL USE HERITAGE CONSERVATION OVERLAY DISTRICT to The Pagoda, currently Ransom -Everglades School, 3575 Main High%•ray, as described in the designation report. (This is a companion item to Item -`8.) REQUEST: To apply the proposed HC-1 overlay to this historic site, as described in the attached designation report. BACKGROUND: The subject property was included among 15 historic sites pre- viously designated under the City of Miami's Interim Heritage Conservation Zoning District ordinance. These sites were selected as the first to be recognized by the City because they are already listed on the National Register of Historic Places. ANALYSIS: On December 14, 1932, the newly established Heritage Conservation Board held a public hearing, and determined that the subject property meets the following criteria for historic site designation: 3. Exemplifies the historical, cultural, political, economic, or social trends of the community. The Pagoda is a reflection of Coconut Grove's pioneer era and is significant for its role in the early educational history of the community.. 5. Embodies those distinguishinn characteristics of an architectural style, or period, or method of construction. The Pagoda is an excellent example of the type of vernacular style architecture constructed in Dade County at the turn - of - the- century. 7. Contains elements of design, detail, materials, or craftsmanship of outstanding quality or which represent a significant innova- tion or adaptation to the South Florida environment. The Pagoda is particularly noteworthy for the excellence of its design which is remarkably adapted to the South Florida environ- ment. The building's many windows, high ceilings, and location are tailored to meet the requirements of South Florida and afford maximum comfort to its inhabitants, The PAB need not reconsider the issue of historic designation cri- teria; however, it should consider the appropriateness of the pro- posed HC-1 zoning overlay as compared to any other 'W " regulations that could be created for the subject property. The HC-1 overlay would not change or modify any of the existing zoning regulations.
