WhEREAS, the Mia.ni Planning Advisory Boars) at its mePtinq of
,January 19, 1983, Item No. 7, followinq an advertised hearing,
adopted Resolution No. PATS 9-8 3 by a 5 to 0 vote, RE'COMMENDINC,
APPROVAL of applying the HC-1: GF,NER.AL, USE HERITAGE; CONSERVATION
OVERLAY DIS`I'R..ICT to subject property, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of 'Miami and its inhabitants to grant
this application as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINET. ";Y THE COMMISSION OF THE CITY
OF MIAMI, FL,ORIDA:
Section 1. Ordinance No. 9500, adopted September 23,
1982, as amended, the Zoning Ordinance of the City of Miami,
Florida, is hereby amended by applyinq the HC-1: GENERAL USE
HERITAGE CONSERVATION OVERLAY DIS'PRICT to "EL JARDIN," 3747 Main
Highway, more particularly described as all of Lots D and E lying
southeast of County Road of the plat of EWANTON HEIGHTS, as
recorded in Plat Book B at Paqe 52, of the Public Records of Dade
County, Florida; further, the City Commission finds that the
subject property embodies appropriately distinguishing
characteristics of an architectural style, period, or method of
construction to warrant the herein action; further, the Zoninq

The Planning Advisory Board, at its meeting of January 19, 1983, Item 7, following
an advertised hearing, adopted Resolution PAB 9-83 recommending approval of the
above petition with a 5 to 0 vote on the above site as described in the designation
report.
One objection received in -the mail; five responses in favor received in the mail.

An ORDINANCE to provide for the application of this Overlay District has been
prepared by the Cicy Attorney's Office and submitted for consideration of the

7. Consideration of recommendations concerning amendments to the
Zoning Map of the New Zoning Ordinance 9500, effective April 6,
1983, of the City of Miami, Florida, to apply the proposed
HC-l: GENERAL USE HERITAGE CONSERVATION OVERLAY DISTRICT to
El Jardin, currently Carrollton School, 3747 Main Highway, as
described in the designation report.
(This is a companion item to Item = 6.)
To apply the proposed HC-1 overlay to this historic site, as
described in the attached designation report.
BACKGROUND: The subject property was included among 15 historic sites pre-
viously designated under the City of Miami's Interim Heritage
Conservation Zoning District ordinance. These sites were selected
as the first to be recognized by the City because they are already
listed on the National Register of Historic Places.
ANALYSIS: On December 14, 1982, the newly established Heritage Conservation
Board held a public hearing, and determined that the subject
property meets the following criteria for historic site designation:
1. Is associated in a significant way with the life of a person
important in the past.
E1 Jardin was built by John Bindley, president of Pittsburgh
Steel, as his winter home.
5. Embodies those distinguishinc characteristics of an archi-
tectural style, or period, or method of construction.
E1 Jardin is an outstanding example of Mediterranean Revival
style architecture and is the earliest known example of that
style in Miami.
6. Is an outstanding ior4; of a prominent designer or builder.
El Jardin was designed by Richard Kiehnel of the firm of
Kiehnel & Elliott. Kiehnel introduced the Mediterranean
Revival style to Miami and went on to produce many of the
City's outstanding structures.
The PAB need not reconsider the issue of historic designation
criteria; however, it should consider the appropriateness of the
proposed HC-1 zoning overlay as compared to any other "HC" regu-
lations that could be created for the subject property. The HC-1
overlay would not change or modify any of the existing zoning
regulations.
