WHEREAS, the Miami P.lanninq Advisory 5oara at its meeting of
January 19, 1983, Item No. 6, following an advertised hearing,
adopted Resolution No. PAB 8-83, by a 5 to 0 vote, RIB COM.MFNI)ING
APPROVAL of applying the HC-1: GENERAL [)SF HE';RITAGE CONSERVATION
OVERLAY DISTRICT to subject property, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this application as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE; COMKISSION OF THE CITY
OF MIAMI, FLORIDP:
Section 1. ordinance No. 6871, as amended, the Compre-
hensive Zoning Ordinance of the City of Miami, is hereby amended
by applying the HC-1: General Use Heritage Conservation Overlay
District to "EL JARDIN," 3747 Main Highway, more particularly
described as all of lots D and E lying southeast of County Road
of the plat of EWANTON HEIGHTS, as recorded in Plat Book B at.
Page 52, of the Public Records of Dade County, Florida; further,
finding that the subject property: embodies those distinguishing
characteristics of an architectural style, or period, or method
of construction; an(] by making all the necessary changes in the
zoning district map made a part of said Ordinance No. 6871, by
reference and description in Article III, Section 2, thereof,
Section 2. That all ordinances, code sections or parts
thereof in con f.l.1ct herew.l.th r-ir.e hereby repeal.e'l ins-olar_ as they
are in conflict.
Section 3. Should any part or provision of this or.di-
narice he declared by a Court of competent j,_Jrisdi.ction to he
invalid, the same shall nest affect the validity of tine ordinance
as a whole,

The Planning Advisory Board, at its meeting of January 19, 1983, Item 6,
following an advertised hearing, adopted Resolution PAB 8-83 recommending
approval of the above petition with a 5 to 0 vote on the above site as
described in the designation report.
One objection received in the mail; five responses in favor received in the
mail.
Backup information is included for your review.
An ORDINANCE to provide for the application of this Overlay District has been
prepared by the City Attorney's Office and submitted for consideration of the
City Commission.

PETITION: 6. Consideration of recommendations concerning application of the
proposed HC-1: GENERAL USE HERITAGE CONSERVATI&N OVERLAY DISTRICT,
pursuant to Comprehensive Zoning Ordinance #6871, as amended, to
E1 Jardin, currently Carrollton School, 3747 Main Highway, as
described in the designation report.
(This is a companion item to Item At7.)
REQUEST: To apply the proposed HC-1 overlay to this historic site, as
described in the attached designation report.
■ BACKGROUND: The subject property was included among 15 historic sites pre-
viously designated under the City of Miami's Interim Heritage
Conservation Zoning District ordinance. These sites were selected
as the first to be recognized by the City because they are already
listed on the National Register of Historic Places.
ANALYSIS: On December 14, 1982, the newly established Heritage Conservation
— Board held a public hearing, and determined that the subject
property meets the following criteria for historic site designation:
1. Is associated in a significant way with the life of a person
important in the past.
E1 Jardin was built by John Bindley, president of Pittsburgh
Steel, as his winter home.
5. Embodies those distinquishinq characteristics of an architectural
stele, or period, or method of construction.
El Jardin is an outstanding example of Mediterranean Revival
Style architecture and is the earliest known example of that
style in Miami.
6. Is an outstanding work of a prominent desiqner or builder.
E1 Jardin was designed by Richard Kiehnel of the firm of
Kiehnel & Elliott. Kiehnel introduced the Mediterranean
Revival style to Miami and went on to produce many of the
City's outstanding structures.
The PAB need not reconsider the issue of historic designation
criteria; however, it should consider the appopropriateness of
the proposed HC-1 zoning overlay as compared to any other "HC"
regulations that could be created for the subject property. The
HC-1 overlay would not change or modify any of the existing zoning
regulations.
