I would very much appreciate your review and comments on the legislation. The current situation is in need of improvement in that the collection ratio for Metropolitan Dade County is approximately 50 percent of tickets issued and the value of unpaid tickets exceeds $6.0 million. Clerk of the Circuit Court Richard Brinker and Chief Judge Gerald Wetherington have been extremely cooperative in our efforts to solve this problem. However, without State enabling legislation, the local Dade County ordinance which allows immobilization of "scofflaw" vehicles is virtually unenforceable. The proposed legislation may be summarized as follows: o An immobilization program using the "Denver Boot" is authorized for all vehicles which have accumulated five (5) or more unpaid tickets. o Each three months the appropriate jurisdiction shall publish in the newspaper of largest daily circulation a list of all vehicles and their registered owners who have accumulated in excess of five (5) parking violations. The notice shall clearly state that the listed vehicles are subject to immobilization and eventual sale at public auction. No vehicle may be immobilized until the advertisement has been published. o If the vehicle is immobilized and the tickets are not satisfied within 72 hours, the appropriate jurisdiction must notify the registered owner by mail within seven (7) days that the vehicle is subject to sale at public auction. o The registered owner may obtain release of the vehicle after posting a bond in the amount of the unpaid tickets or by paying the parking fines, towing and storage fees. Third Street !Miami, Florida 33132 305.579.6789 4 A o If the registered owner fails to respond to the mail notice of possible sale within ten days after the notice is mailed, a certified mail return receipt requested notice shall be nailed informing the registered owner that the vehicle will be sold to the highest bidder after twenty days. she sale shall be advertised in thenewspaperof largest daily circulation and the advertisement shall specifically list all vehicles and the registered owners. o Following the public sale, the proceeds for the sale of each vehicle shall be applied to the cumulative value of the unpaid tickets and the oldest tickets shall be satisfied first. If the proceeds of the sale are insufficient to satisfy the amount owed, the balance shall become a lien against any other vehicles currently owned or subsequent vehicles owned by the person or corporation which owned the vehicle sold at public auction. Your assistance in solving the parking ticket problem is most appreciated. Copies of this letter and the proposed legislation have been forwarded to the appropriate Committee Chairpersons and staff directors.
