HomeMy WebLinkAboutR-83-0508J-83-379 46 0 RESOLUTION NO. �� • A RESOLUTION AUTHORIZING THE CITY MANAGER TO AMEND THE LEGISLATIVE SERVICES AGREEMENT,IN SUBSTAN- TIALLY THE FORM ATTACHED, [KITH THE LAW FIRM OF CRAMER, HOFFMAN & HABER, P. C., COUNSELORS AT LAW, TO EXTEND THE AGREEMENT THROUGH APRIL 22, 1984, AND TO INCREASE THE BASE COMPENSATION FROM $30,000 TO $33,000 PER YEAR AND TO DECREASE THE ALLOWANCE FOR OUT-OF-POCKET EXPENSES FROM $12,000 TO $9,000 PER YEAR WITH FUNDS HEREBY ALLOCATED FROM SPECIAL PROGRAMS AND ACCOUNTS. WHEREAS, the City Commission adopted Resolution No. 81-528 on June 25, 1981, authorizing the City Manager to enter into an agree- ment with the law firm of Cramer and Cramer to provide legislative advisory services; and WHEREAS, an agreement with this firm was entered into on October 8, 1981, providing the firm up to $36,000 per year in consultant fees and out-of-pocket expenses; and WHEREAS, the City Commission adopted Resolution No. 82-427 on May 11, 1982, authorizing the City Manager to amend the aforementioned agreement by increasing consultant fees and out-of-pocket expenses to $42,000 per year and extending the agreement through April 22, 1983; and WHEREAS, the aforementioned amendment was entered into on July 7, 1982, with the firm of Cramer, Hoffman & Haber, P. C.; and WHEREAS, the law firm of Cramer, Hoffman & Haber, P. C. has pro- vided the City of Miami assistance in communicating with top govern- mental officials to discuss funding and technical assistance from the federal government to the City of Miami; and WHEREAS, the City of Miami is desirous of continuing to receive legislative advisory services from this law firm for an additional year; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Sec;L--ion 1. C., which will extend the agreement period through April 22, 1983, increase the base compensation by $3,000, and decrease the allow- ance for out-of-pocket expenses by $3,000. GARCIA-PEDROSA TY ATTORNEY r -50& CITY OF MIAMI LEGISLATIVE SERVICES AGREEMENT AMENDMENT # 2 An amendment to a legislative services agreement made this day of , 1983 between the CITY OF MIAMI, hereinafter called the "CITY", a municipal corporation of the State of Florida, and the law firm of CRAMER, HOFFMAN & HABER, P.C., Counselors at Law, previously known as Cramer & Cramer, Counselors at Law, hereinafter calleti the "CONSULTANT". WITNESSETH WHEREAS, the CITY entered into an agreement dated October 8, 1981 with the CONSULTANT to provide legislative advisory services and WHEREAS, this agreement covered the period from April 23, 1981 through April 22, 1982 and WHEREAS, this agreement was amended on April 23, 1981 extending the agreement period through April 22, 1983 and increasing the monthly compensation to $2,500.00 as authorized by Resolution No. 82-427, adopted by the City Commission on May 11, 1982 and WHEREAS, the CITY is desirous of extending this Agreement to April 22, 1984 increasing the monthly compensation of the CONSULTANT to $2,750.00, a $3,000.00 per year increase, and decreasing the allowance for out-of-pocket expenses by $3,000.00 per year and WHEREAS, the City Commission passed and adopted Resolution No. on authorizing the City Manager to execute an amendment with the CONSULTANT to extend the agreement through April 22, 1984, to increase the monthly compensation of the CONSULTANT to $2,750.00, and to decrease the allowance for out-of-pocket expenses to $9,000.00 a year, bringing the maximum amount payable under this Agreement not to exceed $42,000.00; NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS AND AGREEMEUTS HEREINAFTER SET FORTH, THE PARTIES HERETO COVENANT AyD AGREE to amend the October 8, 1981 Agreement as amended as follows: 83-5081 1. Section 2.A of the original agreement, shall be modified to read as follows: The City will contract with the CONSULTANT for an additional year covering the period beginning April 23, 1983 through April 22, 1984. 2. Section 2.B of the original agreement is hereby modified to read as follows: The basic agreement will be for 533,000.00 per year. Payments will be in advance in equal monthly installments of $2,750.00 with the first installment payable immediately upon execution of this agreement. 3. Section 2.E of the original agreement is hereby modified to read as follows: The CONSULTANT and the CITY hereby agree the maximum amount payable under this Agreement shall not exceed $42,000.00 for the period commencing April 23, 1983 through April 24, 1984. IT IS UNDERSTOOD BY BOTH PARTIES TO THIS AGREEMENT THAT ALL OTHER CONDITIONS OUTLINED UNDER THE ORIGINAL AGREEMENT OF OCTOBER 8, 1981, AS AMENDED, REMAIN IN FULL FORCE AND EFFECT P:ITHOUT MODIFICATION EXCEPT AS PROVIDED HEREIN. This amendment shall take effect the 23rd day of April, 1983. REFEREN�7ES ENCLOSURES "It is recommended that the City Manager be authorized to amend the Legislative Services Agreement with the law firm of Cramer, Hoffman & Haber to extend the Agreement through April 22, 1984, to increase the consultant's monthly compen- sation from $2►500 to $2,750 per month and decrease the allowance for out-of- pocket expenses by $3,000 per year." On June 25, 1981, the City Commission adopted Resolution No. 81-528 authorizing the execution of an agreement with Cramer and Cramer to provide legislative advisory services. The agreement was executed on October 8, 1981, covered the period April 23, 1981 through April 22, 1982, and provided for compensation at a rate of $2,000 per month plus a $12,000 allocation for out-of-pocket expenses. The $36,000 allocation was budgeted in Special Programs and Accounts. On May 11, 1982, the City Commission adopted Resolution No. 82-427 authorizing the City Manager to amend the legislative services agreement with Cramer and Cramer. The amendment was entered into on July 7, 1982, covered the period April 23, 1982 through April 22, 1983, and provided for compensation at a rate of $2,500 per month plus a $12,000 allocation for out-of-pocket expenses. The $42,000 allocation was budgeted in Special Programs and Accounts. The firm of Cramer, Hoffman & Haber has been helpful to the City by assisting staff to obtain access to top officials in Washington, D.C. in refugee and other related matters. Particular mention should be made of the efforts put forth by this firm during the negotiations which resulted in Congressional conferees from the United States Senate and House of Representatives including in the Conference Report of the 4.6 billion jobs stimulus bill the following language: S3-50151 TO: City Manager April 26, 1983 FROM: Jim Reid Re: Contract Amendment - Cramer, Hoffman & Haber "It is the intent and expectation of the conferees that funds apportioned to the State of Florida for Interstate resurfacing, restoration, rehabilitation and reconstruction be eligible for financing and construction of ramps in the vicinity of S.
