P. IACONIS, CERTIFIED PUBLIC ACCOU'VTANr, FOR SPECIAL COST REVIEW AND AUnITS AS NECESSARY AND AS DETERMINED BY THE CITY MANAGER FOR THE CITY OF MIAMI/UNIVERSITY OF MIAMI, JAMES L. KNIGHT INTERNATIONAL CENTER PROJECT; FURTHER AUTHORIZING THE EXPENDITURE OF ADDITIONAL FUNDS NOT TO EXCEED $45,000 FOR THE AFORESAID SERVICES FROM THE CONSTRUCTION ACCOUNT ESTABLISHED FROM THE SALE OF CONVENTION CENTER AND PARKING GARAGE REVENUE ►3ONDS, UNLESS FURTHER EXPRESSLY AUTHORIZED 3Y THE CITY COMMISSION. WHEREAS, the City of Miami/University of Miami James L. Knight International Center_ project involves the expenditure of almost $100 million dollars in public fun,3s; anti WHEREAS, the source of these Funds has been from the Federal Government, Revenue Bonds and other City capital funds; and WHEREAS, proper control of the expenditure of these funds is essential; and WHEREAS, by Resolution No. 81-852, the City Commission authorized the City Manager to enter into a Professional Services Agreement with E.P. Iaconis, Certified Public Accountant, for cost review and audits as necessary and as determined by the Assistant to the City Manager in charge of the said Project; and WHEREAS, on October 30, 1961, a Professional Services Agreement was executed for a term of one year commenciri(j October 7, 1981 and terminating October 7, 1982; and WHEREAS, by Resolution No. 82-933 the City Commission authorized the City Manager to extend for six (6) months the term of the existing Professional Services Agreement; and CITY I-OMMISSIOU L U 4 J u N 9 1983 3-4 FFMd RK" 6 WHEREAS, the finds previously authorized for these services have been fully expender; and WHEREAS, the construction of the Convention Center_ is substantially complete; and WHEREAS, there is a need to audit the general construction contract in order to make final payment to the Contractor; NOW, T►iEREPORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to ,= extend the existing Professional Services Agreement, subject to the City Attorney's approval as to form and correctness, with E. P. Iaconis, Certified Public Accountant, for special cost review and audits as necessary and as determined by the City Manager for the City of Miami/University of Miami James L. Knight International Center Project. Section 2. The expenditure of additional funds for the aforesaid services is hereby approved in an amount not to exceed $45,000 from the Construction Account established from the sale of Convention Center and Parking Garage Revenue Bonds, unless further expressly authorized by the City Commission. Poms REFERENCES Project Director Conference Center ENCLOSURES Since Commission action to extend E.P. Iaconis' (CPA) contract to audit the Convention Center Construction Contract has been delayed, he has agreed to proceed with the audit work under the City Manager's authority. On this basis and as agreed at the meeting with Frank J. Rooney, Inc. on 4/12/83, E.P. Iaconis is proceeding with the audit. It is recommended that the proposed Resolution to extend the Auditor's contract be put on the next City Commission Meeting Agenda. If possible, it should be considered to include it on the Agenda for the Planning & Zoning Meeting scheduled for May 31, 1983. cc: Vince Grimm John Copelan Miriam Maer I.P. Gary � "=5 City Manager It is recommended that the proposed resolution be adopted by the City Commission in its meeting of April 28, 1983, whereby the City Manager is authorized to extend the existing Professional Services Agreement with E.P. Iaconis, Certified Public Accountant, for special cost review and audits as necessary and as determined by the City Manager for the City of Miami/University of Miami James L. Knight International Center Project; further authorizing the expenditure of additional funds not to exceed $45,000 for the aforesaid services from the Construction Account established from the sale of Convention Center and Parking Garage Revenue Bonds unless further expressly authorized by the City Commission. The construction of the Convention Center Project is substantially complete and there is a need to audit the City's contract with Frank J. Rooney Inc. on the general construction in order to make final payment. The contract is a "Cost of the Work plus a fee with Guaranteed Maximum Cost" and the contract must be audited in order to establish a final cost as provided by the contract and to ensure that all expenditures were appropriate. As a result of a preliminary audit, we found several matters of concern requiring a comprehensive audit to verify the expenditures by the Contractor. In addition, there is a need for cost review concerning operation and maintenance expenditures to be allocated to the City and its lessees on an equitable basis. It is essential that these auditing services proceed immediately. The rate of compensation to E.P. Iaconis, Certified Public Accountant, will remain the same as contained in the current agreement dated September 3, 1982. 83-4831
