AN EMERGENCY ORDINANCE A111"'NDING SF.CTIOId 1 01, ORDINANCE' NO. 95311, ADOPTED DECE PIED 9, 1982), THE CAPITAL IMPROVEIIE'NT APPROPRIATION ORDINANCE FOR FISCAL YEAR ENDING SEPTEvIBEIII 30, 1983; AS AMENDED; BY ESTABLISHING UNANTICIPATED INTEREST EARNED AS A PESOURCE IN TIII, CAPITAL IMPROVEMENT :FUND IN THE MOUNT OF $633 , 900 AND APPROPRIATING, T111S AMKNT TO GOVERNMENT Cl NTER PARKING GARAGE FUI:'iIIER TRANSFI.�]RRING SAID RESOURCE AND PROJECT FROM THE CAPITAL I,,IPI:OVEI TENT FUND TO THE GOVERNMENT CENTER PARKING GAP.AGE' ENTERPRISE FUND TO INCR.EASI" APPROPI:IATIONS FRO"[ $10,400,000 TO $11,033,900, ITEM CONTAINING A REPEALER PROVISION AND A SEVEI-ABILITY CLAUSE, t,%iHEREAS, the City Commission adopted Ordinance No. 9534 on December 9, 1982, establishing resources and appropriations for the implementation of Capital Improvements in the City of ;Miami, Florida, for the fiscal year ending September 30, 1983; and WHEREAS, the City Commission adopted Resolution 82-556 on June 17, 1982, ratifying and confirming the action of the administra- tion in authorizing the additional work of tailbur Smith and Associates, Inc., on the Downtown Government Center Parking Garage; and WHEREAS, sufficient funds for payment to 1Jilbur Smith and Associates, Inc., for their work was not appropriated at that time; and WHEREAS, the City Commission adopted Resolution 83-152 on February 10, 1983, authorizing the City Manager to execute the negotiated agreement with the City of .liami Department of Off Street Parking for the operation and management of this garage; and WHEREAS, the Department of Off Street Parking requires Housekeeper sealant on a1L parking decks in order to protect the concrete surface and enhance the cleanliness of the garage; and WHEREAS, the Department of Off Street Parking requires a computerized revenue control system to be installed; and WHEREAS, the Department of Off Street Parking requires a television security system, conduits for which are being installed in the garage, and for which 44 cameras are needed; and WHEREAS , funds For the preceding i7e1)artment of OFF Street Parking; requirements hiave not. been ;zppropriated; and WHE�ZEAS, funds for the precedint, IiIust he appropriated by eIII er,ency procedures so as not to delr.iv thc� proposed July 1stKV opening of the facility; and r WHEREAS, the amount of $633,900 is zavailable from Unanticipated Interest Earned by the Capital Improvement Fund, and can be appropriated in the Capital Improvement Fund to the Government Center Parking, Garage Capital Project; and 1J11EREAS, the resource Unanticipated Interest Earned by the Capital Improvement Fund in the amount of $633,900 for the Government Center Parking Garage is hereby transferred to the Government Center Parking Garage Enterprise Fund to increase appropriations for said project from $10,400,000 to $11,033,900; NOW, THEREFORE, BE IT ORDAINED BY THE COHNIISSION OF THE CITY OF MIAMI, FLORIDA: Section 1 of Ordinance No. 9534, adopted December 9, 1982, as amended, is hereby further amended in the following particulars:l/ "Section 1. We are requesting that the Capital Improvement Appropriations Ordinance No, 9534 be amended to include $633,900 as revenue whose source is unanticipated interest earned by the Capital Improvement Fund, We are requesting that this proposed ordinance be passed on an emergency basis, dispensing with the requirement of reading the ordinance on two separate days. The reason for this request is the urgency to have the garage ready for its opening on July 1, 1983. We propose to appropriate that same amount, $633,900 to the Govern- ment Center Parking Garage Project in the Government Center Parking Garage Enterprise Fund.
