DESCRIPTION IN ARTICLE, 3, SECTION 300,
THEREOF; BY REPEALING ALL G)PDINANCES, CODE
SECTIONS, OR PARTS THEREOF IN CONHI,ICT AND
CONTAINING A SEVERABILITY CLAUSE.
WHEREAS, the Miami Planning Advisory Board at its meetinq of
April 20, 1983, Item No. 4, f_ollowiny an advertised hearing,
adopted Resolution No. PAB 41-83 by a 4 to 0 vote, RECOMMENDING
APPROVAL of applying the [IC-1: GENERAL USE HERITAGE CONSERVATION
OVERLAY DISTRICT to subject property, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this application as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Ordinance No. 8500, adopted September 23,
1982, as amended, the 7,oning Ordinance of the City of Miami,
Florida, is hereby amended by applying the HC-1: GENERAL USE
HERITAGE CONSERVATION OVERLAY DISTRICT to the "DR. WILLIAM
CHAPMAN HOUSE," being approximately 526 Northwest 13th Street,
more particularly described as Lots 16 and 17 and Lots 18 and 19,
less than north 5 feet, and less that part of Lots 17 and 19
lying in the right-of-way, of Block 1 in the Plat of BRAGG
INVESTMENT CO. SUBDIVISION, as recorders in Plat nook 4 at Page
86, of the Public Records of Dade County, Florida; further,
finding that the subject property is associated in a significant
way with the life of a person important in the past and warrants
the herein action; further, the zoning atlas incorporated in
said Ordinance, by reference and descri!,ti_on in Article 3,
Section 300 thereof, is lie rehy ainencled to r.eFI.c,ct the herein

Section 2. All ordinances, cndF-- scections or- parts
thereof in conf_l i.ct herewith are her-_bv rcoealed insof ar as they
are in conflict.
Section 3. Should any part or. provision of this ordi-

invalid,
the same
shall
not affect the validity of the Ordinance

The Planning Advisory Board, at its meeting of April 20, 1983, Item 4, following
an advertised hearing, adopted Resolution PAB 41-83 recommending approval of the
above petition with a 4 to 0 vote, on above site, as described in the designation
report.

An ORDINANCE to provide for the application of this Overlay District has been
prepared by the City Attorney's Office and submitted for consideration of the
City Commission.

PETITION: 4. Consideration of recommendations concerning amendments to
the Zoning Map of Ordinance 9500, when effective, Zoning
Ordinance of the City of Miami, Florida, to apply Section
1610. HC-1: GENERAL USE HERITAGE CONSERVATION OVERLAY
DISTRICT to the Dr. William Chapman House, 526 NW 13th
Street, as described in the designation report.
REQUEST: To apply the proposed HC-1 overlay to this historic site,
as described in the attached designation report.
BACKGROUND: The Dr. William Chapman House was recommended for historic
site designation by the Black Archives, History and Research
Foundation, Inc. It is located in the Overtown neighborhood,
but is isolated by the adjacent massive expressway ramps
of I-95 and SR-836. Much of the surrounding area is vacant
or deteriorated. The property is part of several blocks under
consideration for acquisition by the Dade County School Board
for expansion of the Booker T. Washington School. If the
site is required by the School Board, every effort should be
made to find a school or community related use for the
structure.
ANALYSIS: On March 22, 1983, the newly established Heritage Conservation
Board held a public hearing, and determined that the subject
property meets the following criteria for historic site
designation.
1. Is associated in a significant way with the life of a
person important in the past.
The Dr. William Chapman House is the most important
structure associated with the life of a prominent
physician in the black community.
2. Embodies those distinguishing characteristics of an
architectural style, or period, or method of construction.
The Dr. William Chapman House is a fine example of the
type of masonry vernacular architecture prevalent in Dade
County in the 1920's. The building's size and classical -
detailing make it perhaps the most elaborate residence
remaining in Overtown.
The PAB need not reconsider the issue of historic designation
criteria; however, it should consider the appropriateness of
the proposed HC-1 zoning overlay as compared to any other
"HC" regulations that could be created for the subject
property. The HC-1 overlay would not change or modify any
of the existing zoning regulations.
