HomeMy WebLinkAboutR-83-0545f J-83-483 RESOLUTION NO. 8 3`54 5, A RESOLUTION ESTABLISHING SEPTEMBER 8, 1983, AS THE DATE FOR A PUBLIC HEARING CONCERNING ISSUANCE OF A DEVELOPMENT ORDER FOR THE LINCOLN/NASHER PROJECT, A DEVELOPMENT OF REGIONAL IMPACT TO BE LOCATED AT 623-799 BRICKELL AVENUE; AND DIRECTING THE CITY CLERK. TO NOTIFY APPROPRIATE AGENCIES. WHEREAS, Section 380.06, Florida Statutes, of "The Florida Environmental Land and Water Management Act of 1972," requires local government to establish a elate certain, and give public notice, for a local }public hearing on an Application for Develop- ment Approval for a Development of Regional Impact prior to issuing a Development Order; and WHEREAS, by letter, the South Florida Regional Planning Council has notified the City of Miami that the Lincoln/Nasher Project Application for Development Approval contains sufficient information for their review and that a local public hearing could be scheduled for said project, a Development of Regional Impact, to be located at 623-799 Brickell Avenue; and WHEREAS, Section 380.06 Florida Statutes requires local government to set a public hearing date at its next scheduled meeting after the receipt of such a letter and to give at least sixty (60) days notice of the hearing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. A public hearing shall be held at 2:30 P.M., September 8, 1983, or at a reconvened meeting, in City Commission Chambers, 3500 Pan American Drive, Miami, Florida, 33133, concerning issuance of a Development Order for the Lincoln/Nasher project, a Development of Regional Impact, to be located at 623-799 Brickell Avenue. Section 2. Per Chapter 380.06 F.S., local government is required to set a date certain and to give public notice 60 days in advance of a required public hearing on an Application for Development Approval for a Development of Regional Impact, prior to issuing a Develop- ment Order. By letter (attached) the South Florida Regional Planning Council stated that the Lincoln/Nasher Project Application for Development Approval contained sufficient information for their review and would be tentatively scheduled on the Council agenda of July 11, 1983. Further, the letter stated that the Development of Regional Impact public hearing must be set at the next scheduled meeting of the Commission and advertised at least 60 days in advance of the hearing, per Chapter 380.06 F.S. It is requested that the Commission consider the setting of the hearing date at their meeting of June 15, IM , and establish September 8, 1983, as the Development of Regional Impact public hearing date for the Lincoln/Nasher project, which would allow for the required 60 day public notice. Box 330708 Miami, Florida 33133 Dear Mayor Ferre: This letter is to given written notice that the Lincoln/Nasher Property Application for Development Approval is sufficient for regional impact review. A Development of Regional Impact public hearing as required by Chapter 380.06(10), Florida Statutes, must be set at your next scheduled meeting and advertised at least sixty (60) days in advance of the hearing. The hearing notice must specify that the information and reports on the Development of Regional Impact Application may be reviewed at the Council and/or City of Miami offices. The law also requires that the notice of public hearing be transmitted to the Department of Community Affairs, Division of Local Resource Management, and the South Florida Regional Planning Council. .Receipt of that notice will officially commence our fifty day review period. At this time, the South Florida Regional Planning Council staff report and recommendations are tentatively scheduled to be presented for official action at the regular Council meeting on July i1, 1983.
