RESOLUTION NO. 83-53:1
A RESOLUTION ACCEPTING THE PLAT ENTITLED
SANTA CLARA STATION, A SUBDIVISION IN THE
CITY OF MIAMI; AND ACCEPTING THE DEDICA-
TIONS SHOWN ON SAID PLAT; AND AUTHORIZING
AND DIRECTING THE CITY MANAGER AND CITY
CLERK TO EXECUTE THE PLAT AND PROVIDING
FOR THE RECORDATION OF SAID PLAT IN THE
PUBLIC RECORDS OF DADE COUNTY, FLORIDA.
WHEREAS, the City Zoning Board and the Department of Public
Works have recommended the acceptance of the plat:
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The plat entitled SANTA CLARA STATION is a resub-
division of all of Tract "B", T.R. SUBDIVISION FIRST ADDITION, accord-
ing to the plat thereof, as recorded in Plat Book 110, Page 59; all
of Tract "A", T.R. SUBDIVISION, ;iccording to the plat thereof as
recorded in Plat Book 107, Page 72; all of Lots 31 through 34,
inclusive, and a portion of Lots 10 and 11 in Block 12, BRADDOCK
SUBDIVISION NUMBER 3, according to the plat thereof, as recorded in
Plat Book 2, Page 71 and a portion of Block 12, REPLAT OF BLOCKS 8,
9. and 12, BRADDOCK SUBDIVISION NUMBER 3, according to the plat there-
of, as recorded in Plat Book 47, Page 8, all said plats being recorded
in the Public Records of Dade County, Florida and that 10 foot alley
bounded on the South by said Lots 31 through 34 and bounded on the
North and East by said Block 12 and that 10 foot alley bounded on the
East by said Lots 10 and 11 and bounded on the South by said Tract
"A" and bounded on the West by said Tract "B", all lying in Section
26, Township 53 South, Range 41 East, City of Miami, Dade County,
Florida, which subject plat by reference is made a part hereof as
if fully incorporated herein and which plat, together with the
dedications shown thereon, and the dedications to the perpetual use
of the public of all existing and future planting, trees and shrubbery
on said property, is hereby accepted and confirmed by the City of
Miami, Florida.

The Department of Public Works recommends
the approval of the plat by the City
Commission of Miami, Florida, and certifies
its correctness as to form.
The proposed record plat entitled SANTA CLARA STATION, being a
resubdivision of all of Tract "B", T.R. SUBDIVISION FIRST ADDITION,
according to the plat thereof, as recorded in Plat Book 110, Page
59; all of Tract "A", T.R. SUBDIVISION, according to the plat =
thereof as recorded in Plat Book 107, Page 72; all of Lots 31
through 34, inclusive, and a portion of Lots 10 and 11 in Block 12,
BRADDOCK SUBDIVISION NUMBER 3, according to the plat thereof, as
recorded in Plat Book 2, Page 71 and a portion of Blockl2, Replat
of Blocks 8, 9, and 12, BRADDOCK SUBDIVISION NUMBER 3, according to
the plat thereof, as recorded in Plat Book 47, Page 8, all said
plats being recorded in the Public Records of Dade County, Florida
and that 10 foot alley bounded on the South by said Lots 31 through
34 and bounded on the North and East by said Block 12 and that 10
foot alley bounded on the East by said Lots 10 and 11 and bounded
..on the South by said Tract 'A" and bounded on the West by said Tract
"B", and will consist of one tract totalling 3.66f acres. It is
zoned I-1.
This plat is being forwarded to your office for City Commission
action.
Also attached are the following itemized papers necessary to present
the plat to the City Commission of Miami:.
(1) Resolution accepting the plat;
(2) Print of proposed record plat;
(3) Agreement form pertaining to subdivision improvements;
(4) Opinion of Title;
(5) Memorandum from the Miami -Dade Water and Sewer
Authority pertaining to water mains and appurtenances;
(6) Portion of City Zoning Sheet No. 20 showing property
platted colored in red.

The accompanying plat entitled SANTA CLARA STATION was prepared by
The Kaiser Transit Group. It is in correct form for submission to
the City Commission and is forwarded with a recommendation that it
be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
(1) The property platted is a resubdivision of all of
Tract "B", T.R. SUBDIVISION FIRST ADDITION, according
to the plat thereof, as recorded in Plat Book 110,
Page 59; all of Tract "A", T.R. SUBDIVISION, according
to the plat thereof as recorded in Plat Book 107, Page
72; all of Lots 31 through 34, inclusive, and a portion
of Lots 10 and 11 in Block 12, BRADDOCK SUBDIVISION
NUMBER 3, according to the plat thereof, as recorded in
Plat Book 2, Page 71 and a portion of Block 12, REPLAT
OF BLOCKS 8, 9, and 12, BRADDOCK SUBDIVISION NUMBER 3, -
according to the -plat thereof, as recorded-1—h Plat Book -
47, Page 8, all said plats being recorded in the Public
Records of Dade County, Florida and that 10 foot alley
bounded on the South by said Lots 31 through 34 and
bounded on the North and East by said Block 12 and that
10 foot alley bounded on the East.by said Lots 10 and
11 and bounded on the South by said Tract "A" and
bounded on the West by said Tract "B", and will consist
of one tract totalling 3.66f acres. It is zoned I-1.
(2) The location of the streets and the widths conform with
the standards of the Department of Public Works of the
City of Miami, Florida.
(3) As certified to by Henry R. Kingsbury, Registered Land
Surveyor, this plat complies with the plat filing laws
of the State of Florida.
(4) The City Zoning Board of Miami, Florida, after Public
Hearing, has recommended the closing of the alleys
located in the block bounded by N.W. 20 Street and 21
Street and N.W. 12 Avenue and 13 Avenue for- a combined
distance of 155±-feet. This action was confirmed by
City Commission Resolution No. 82-586.
(5) By authority of Resolution No. 124-82, adopted July 12,
1982, the plat was recommended for acceptance by the
City Zoning Board of Miami, Florida.
(6) The attached Certificate of Title Examination dated
March 16,.1983, signed by Robert L. Krawcheck, Attorney,
indicates that the fee simple title to the property
platted is correctly vested in Metropolitan Dade County,
and the plat has been correctly executed.

(7) The area platted is not encumbered by mortgages.
(8) Prior to the recording of this plat a building
permit has been issued to Dade County.
(9) The location of the property is shown colored in
red on the accompanying copy of a portion of City
of Miami, Florida, Zoning Sheet No. 20. _
(10) The attached Resolution has been prepared for the
acceptance of the plat by the City Commission of
Miami, Florida.

AGREEMENT FOR CONSTRUCTION OF CERTAIN IMPROVEMENTS
WHEREAS, METROPOLITAN DADE COUNTY, a political subdivision
of the State of Florida, (hereinafter referred to as the "Owner"),
concurrently with the delivery of this Agreement, has applied to
THE CITY OF MIAMI, (hereinafter referred to as the "City"), for
the acceptance and confirmation by the Commission of said City,
of a certain proposed plat of a subdivision known as SANTA CLARA
STATION (Metrorail), located at N.W. 12 Avenue & 20 Street, a copy
of which proposed plat is attached hereto and made a part hereof
as Exhibit "A".
WHEREAS, this Agreement when executed will testify to the
Owner's intention to plat and install certain improvements as set
'forth herein; and
,WHEREAS, the completion of improvements as set forth herein -
will'not be required prior to the acceptance of the plat by the
City Commission.
NOW, THEREFORE, the Owner hereby covenants and agrees with
the City as follows:
1. Within a reasonable length of time, the Owner will construct,
or cause to have constructed, at no cost to the City, those improve-
ments in the streets adjacent to the station site as per approved
contract drawings for SANTA CLARA STATION Contract N246.
Although a reasonable length of time is being allowed for the
completion of the aforementioned improvements, it is not in the
- public interest that such construction work should be prolonged
to the extent that it would have a disorganizing effect upon the
..neighborhood. After the work is started, the Owner hereby agrees
to prosecute said work progressively so as to complete it in a
reasonable length of time.
2. The Owner, upon completion of the improvements, will sub-
mit to the City of Miami, Department of Public Works, a letter from a

This memorandum is in response to your request for an
opinion of title pertaining to the following described real
property, hereinafter "the property":
All of Tract "B," T. R. SUBDIVISION FIRST ADDITION,
according to the plat thereof, as recorded in
Plat Book 110, Page 59; all of Tract "A," T. R.
SUBDIVISION, according to the plat thereof as recorded
in Plat Book 107, Page 72; all of Lots 31 through
34, inclusive, and a portion of Lots 10 and 11 in
Block 12, BRADDOCK SUBDIVISION NUMBER 3, according
to the plat thereof, as recorded in Plat Book 2,
Page 71, and a portion of Block 12, REPLAT OF BLOCKS

to a point of tangency, said point being the POINT OF
BEGINNING.
The opinion which you request is pursuant to Section
28-8 (d)(3) of the Code of Metropolitan Dade County,. which
requires that an application for final plat approval be
accompanied by a "current opinion of title from any attorney
authorized to practice law in this state." Pursuant to this
provision, I hereby certify that I am an attorney authorized
to practice law in the State of Florida.
This opinion is based upon and assumes as true, complete
and correct, the following:
a. The title information and results of a title search
as set forth in the title commitments from the Title Insurance
Company of Minnesota issued by State Title and Guaranty Co.
as to all the property described above.

b. That the County's title to all property abutting
the alleys contained within the property includes all reversionary
interests in said alleys.
Dade County acquired fee simple title to the property
above, exclusive of the two 10-foot alleys contained within,
by virtue of Order of Taking dated August 13, 1981, and
Certificate of Payment pursuant to said Order of Taking,
recorded in Official Records Book 11191, Pages 16.14-1642,
Public Records of Dade County, Florida, both filed for
record in the eminent domain case Dade County v. Tavilla
Realty Associates, Ltd., et al., Circuit Court Case No.
81-8716 (CA 28) .
With regard to the two 10-foot alleys contained within
the property, the City of Miami by its Board of County
Commissioners' Resolution No. 82-586, dated June 24, 1982,
closed, vacated and discontinued the same to be used in
conjunction with the tentative plat of Santa Clara Station.
Based upon all the assumptions and statements hereinabove
set forth, together with the exceptions listed on said
commitments, and upon the premises that no liens or judgments
have been filed against the property subsequent to Dade County's
obtaining title, I am of the opinion that, subject to any
conditions, restrictions, covenants, easements, reservations,
limitations and liens of record, Dade County has good and
marketable fee simple title to the property described herein.
