RESOLUTION NO. $353
A RESOLUTION ACCEPTING THE PLAT ENTITLED
VIZCAYA STATION, A SUBDIVISION IN THE
CITY OF MIAMI; AND ACCEPTING THE DEDICA-
TIONS SHOWN ON SAID PLAT; AND AUTHORIZING
AND DIRECTING THE CITY MANAGER AND CITY CLERK
TO EXECUTE THE PLAT AND PROVIDING FOR THE
RECORDATION OF SAID PLAT IN THE PUBLIC RECORDS
OF DADE COUNTY, FLORIDA.
WHEREAS, the City Zoning Board and the Department of Public
Works have recommended the acceptance of the plat:
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA.
Section 1. The plat entitled VIZCAYA STATION is a resubdivision
of all of lots 1 through 13, inclusive, Block 47; all of lots 16
through 27, inclusive, Block 48; and that portion of S.W. 32nd Road
between said Blocks 47 and 48, all according to EAST SHENANDOAH as
recorded in Plat Book 14, Page 55 of the Public Records of Dade
County, Florida, all lying in Section 40, Township 54' South, Range
41 East, City of Miami, Dade County, Florida, which subject plat by
reference is made a part hereof as if fully incorporated herein and
which plat, together with the dedications shown thereon, and the
dedications to the perpetual use of the public of all existing and
future planting, trees and shrubbery on said property, is hereby
accepted and confirmed by the City of Miami, Florida.
Section 2. The City Manager and City Clerk are hereby authorized
and directed to execute the plat and cause the same to be recorded
in the Public Records of Dade County, Florida.

The Department of Public Works recommends
the approval of the plat by the City
Commission of Miami, Florida, and certifies
its correctness as to form.
The proposed record plat entitled "VIZCAYA STATION" being a resub-
division of all of lots 1 through 13, inclusive, Block 47; all of
lots 16 through 27, inclusive, Block 48; and that portion of
S.W. 32nd Road between said Blocks 47 and 48, all,according to
EAST SHENANDOAH as recorded in Plat Book 14, Page 55 of the Public
Records of Dade County, Florida, and will consist of one tract
totalling 2.62t acres. It is zoned R-2 & R-4.
This plat is being forwarded to your office for City Commission
action.
Also attached are the following itemized papers necessary to
present the plat to the City Commission of Miami:
(1) 'Resolution accepting the plat;
(2) Print of proposed record plat;
(3) Agreement form pertaining to subdivision improvements;
(4) Opinion of Title;
(5) Memorandum from the Miami -Dade Water and Sewer
Authority pertaining to water mains and appurtenances;
(6) Portion of City Zoning Sheet No. 44 showing property
platted colored in red.

VIZCAYA STATION
LOCATED AT S.W. 32 ROAD & S.W. 1 AVENUE
A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA

The accompanying plat entitled VIZCAYA STATION was prepared by the
Kaiser Transit Group. It is in correct form for submission to the
City Commission and is forwarded with a recommendation that it be
approved.
PERTINENT INFORMATION REGARDING THE PLAT:
(1) The property platted is a resubdivision of all of
Lots 1 through 13, inclusive, Block 47; all of
Lots 16 through 27, inclusive, Block 48; and that
pG:-tlon of S.W. 32 Road between said Blocks 47 and
48, all according to EAST SHENANDOAH as recorded in
Plat Book 14, Page 55 of the Public Records of Dade
County, Florida, and will consist of one tract
totalling 2.62f acres. It is zoned R-2 & R-4.
(2) The location of the streets and the widths conform
with the standards of the Department of Public
Works of the City of Miami, Florida.-
(3) As certified to by Henry R. Kingsbury, Registered
Land Surveyor, this plat complies with the plat
filing laws of the State of Florida.
(4) The City Zoning Board of Miami, Florida, after
Public Hearing, has recommended the closing of
S.W. 32 Road for a distance of 155.5f feet between
the southerly right-of-way line of S.W. 1 Avenue
and the northerly right-of-way boundary of the
Metrorail Rapid Transit System. This action was
confirmed by City Commission Resolution No. 82-587.
(5) By authority of Resolution No. 125-82, adopted
July 12, 1982, the Plat was recommended for
acceptance by the City Zoning Board of Miami, Florida.
(6) The attached Certificate of Title Examination dated
March 16, 1983, signed by Robert L. Krawcheck,
Attorney, indicates that the fee simple title to
the property platted is correctly vested in Metro- .
politan Dade County, and the plat has been correctly
executed.
(7) The area platted is not encumbered by mortgages.
(8) Prior to the recording of this plat, a building permit
has been issued to Dade County.
(9) The location of the property is shown colored in red
on the accompanying copy of a portion of City of Miami,
Florida, Zoning Sheet No. 44.
(10) The attached resolution has been prepared for the
acceptance of the plat by the City Commission of Miami,
Florida.

AGREEMENT FOR CO"ISTRUCTION OF CERTAIN IMPROVEMENTS
WHEREAS, METROPOLITAN DADE COUNTY, a political subdivision
of the State of Florida, (hereinafter referred to as the "Owner"),
concurrently with the. delivery of this Agreement, has applied to
THE CITY OF MIA1.11, (hereinafter referred to as the -"City"), for
the acceptance and confirmation by the Commission of said City,
of a certain proposed plat of a subdivision known as VIZCAYA STATION
(Metrorail), located at S,W. 32 Road & S.W. 1 Avenue, a copy of
which proposed plat is attached hereto and made a part hereof as
Exhibit "A".
WHEREAS, this Agreement when executed will testify to the
Owner's intention to plat and install certain improvements as set
forth herein; and
WHEREAS, the completion of improvements as set forth herein
will not be required prior to the acceptance of the plat by the
City Commission. _
NOW, THEREFORE, the Owner hereby covenants and agrees with
the City as follows:
1. Within a reasonable length of time, the Owner will construct,
or cause to have constructed, at no cost to the City, those improve-
ments in the streets adjacent to the station site as per approved
Florida Department of Transportation Street Improvement plans.
..-,Although a reasonable length of time is being allowed for the
completion of the aforementioned improvements, it is not in the
public interest that such construction work should be prolonged
to the extent that it would have a disorganizing effect upon the
neighborhood. After the -work is started, the Owner hereby agrees
to prosecute said work progressively so as to complete it in a
reasonable length of time.
2. The Owner, upon completion of the improvements, will sub-
mit to the City of Miami, Department of Public Works, a. letter from a

Registered Land Surveyor certifying that the Permanent Reference
Monuments indicated on the plat have been installed and properly
placed.
IN WITNESS WHEREOF, the Owner has authorized this Agreement

SUBJECT Opinion of Title
Viscaya Station - Metrorail
This memorandum is in response to your request for an
opinion of title pertaining to the following described real
property, hereinafter "the property":
All of Lots 1 through 13, inclusive,
Block 47, all of Lots 16 through 27,
inclusive, Block 48, and that portion
of S. W. 32nd Road between said Blocks
47 and 48, all according to EAST
SHENANDOAH as recorded in Plat Book 14,
Page 55 of the Public Records of Dade
County, Florida.
The opinion which you request is pursuant to Section
28-8 (d)(3) of the Code of Metropolitan Dade County
which requires that an application for final plat approval be
accompanied by a "current opinion of title from any attorney
authorized to practice law in this state." Pursuant to this
provision, I hereby certify that I am an attorney authorized
to practice law in the State of Florida.
This opinion is based upon and assumes as true, complete,
and correct, all of the following:
_ a. The title information and results of a title search
as set forth in the title commitments from Commonwealth Land
Title Insurance Company issued by Friendship Title Company as
to Lots 1, 2, 8, 9, 10, 11, 12 and 13, Block 47, and Lots 16,
17, 18, 19, 20, 21, 22, 23, 24, 25, 26 and 27, Block 48, '
East Shenandoah, PB 14/55.
b. The.title information and results of a title search
as set forth in the title commitment from the Title Insurance
Company of Minnesota issued by State Title and Guaranty Co.
as to Lots 3, 4, 5, 6 and 7,.Block 47, East'Shenandoah, PB 14/55.
co That the County's title to all lots abutting S. W.
32nd Road between Blocks 47 and 48 of East Shenandoah, PB 14/55,
includes all reversionary interests in said portion of S. W.
32nd Road between said Blocks 47 and 48.

Dade County acquired fee simple title to the following
properties as listed below:
1. Lots 16 and 17, Block 48, East Shenandoah, according
to the plat thereof as recorded in Plat Book 14, Page 55, of the
Public Records of Dade County, Florida, by virtue of a Warranty -
Deed to Metropolitan Dade County excuted by Maria D. Hernandez,
a.single woman, recorded in Official Records Book-10872, Page 59.3,
Public Records of Dade County, Florida. -
2. Lots 21, 22, 23, 24 and 25, Block 48, East Shenandoah,
according to the plat thereof as recorded in Plat Book 14,
Page 55, of the Public Records of Dade County, Florida, by
virtue of a Warranty Deed to Metropolitan Dade County executed
by the President of Serma Corporation, a Florida corporation,
recorded in Official Records Book 11073, Page 1796, Public Records
of Dade County, Florida.
3. Lots 3, 4, 5, 6 and 7, Block 47, East Shenandoah,
according to the plat thereof as recorded in Plat Book 14, Page 55,
Public Records of Dade County, Florida, by virtue of a Warranty
Deed to Metropolitan Dade County, executed by Margery D. Fry and
Walli D. Simpson, single women, and recorded in Official Records
Book 10633, Page 1243, Public Records of Dade County, Florida.
4. Lots 1, 2, 8, 9, 10, 11, 12 and 13, Block 47, and
Lots 18, 19, 20, 26 and 27, Block 48, East Shenandoah, according
to the plat thereof recorded in Plat Book 14, Page 55, Public
Records of Dade County, Florida, by virtue of Order of Taking
dated June 29, 1981,- and --Certificate of Payment pursuant to
said Order of Taking, recorded in Official Records Book 11148,
Pages 467-470, both filed for record in the eminent domain
case Dade County v. George Bishop Collins, et al., Circuit
Court Case No. 81-7316.
5. With regard to that portion of S. W. 32nd Road between
Said Blocks 47 and 48, East Shenandoah, PB 14/55, the City of
Miami by its Board of County Commissioners' Resolution No. 82-587,
dated June 24,1982, closed and vacated said portion of S. W.
32nd Road to be used in conjunction with the tentative plat
of "viscaya Station."
Based upon all'the assumptions and statements hereinabove
set forth, together with the exceptions listed on said commitments
and title insurance policies issued therefor, and upon the premises

that no liens or judgments have been filed against the property
subsequent to Dade County's obtaining title and the issuance of
said insurance policies on said properties, I am of the opinion
that, subject to any conditions, restrictions, covenants, easements,
reservations, limitations and liens of record, Dade County has good
and marketable fee simple title to the properties described herein.
