Dear Mayor Ferre:
Last year the City of Miami was in the process of
considering roofing the courtyard at the Coconut
Grove Exhibition Center, with a hopeful completion
date in time to accommodate the ASTA Convention.
As a result they requested that Miami's Summer
Boat Show not use the courtyard. Six weeks prior
to the 1982 Miami's Summer Boat Show, for reasons
both you and the Commission are aware, the City
opted not to proceed with that project at that
time, and notified us we could use the courtyard.
This was costly to the boat show -and embarrassing
as it was difficult to properly fill that area in
only six weeks.
I am sorry to report that, again this year, the
boat show is going to be suffering both financial
and physical (appearance) damages due to the
inability of the contractor to finish prior to the
1983 Miami's Summer Boat Show, scheduled July 15-18th.
Previous to this, I have been in touch with Pete
Long (Public Works Department) approximately every
10 days to make sure the project would be completed
enough so that occupancy would be granted by June 30th.
Since we are only 60 days away from the show and
there is little evidence of physical improvement in
the courtyard, last week I contacted the contractor
(LGH Construction) who indicated the plans had taken
so long to go through all the channels that the steel
is just now being ordered (May 18th), and there is
no human way possible the facility can be roofed
and ready for occupancy by this year's boat show.

In previous conversations with Pete Long, he indicated the
facility would be ready for occupancy by June 30th. As a
result of this information we have sold every inch of that
space to 75 different exhibitors, who now have to be relocated
or cancelled as there is not roofed, air-conditioned space
available to move them to.
Florida Tent Rental was asked to assess the possibility of
putting up a tent and found the following:
1. Due to the previous two tents installed at that
facility, they would charge $25,000 and demand
payment in advance.
2. LGH Construction has removed 9 feet of the previous
overhang and taken out the existing anchors and
tent rings which previously held the tent.
3. The drainage of the entire Coconut Grove Exhibition
Center would come down into the courtyard, flooding
all exhibits in the event of rain, unless the City
was to install a temporary double flashing (18") on
the entire west side, and it is questionable as to
whether or not that would be adequate to stop the
force of the water in the event of rain.
4. The above reasons make tenting impossible.
At this time I estimate our losses, due to the breakdown of
the project, to be somewhere in the area of $15,000 which I
will request the City be 'responsible for at least 1/3 of at
the very next Commission Meeting. This amount can be sub-
tracted from the normal 1983 Miami's Summer Boat Show rental
fee due the City. I request to be put on the agenda of the
next Commission Meeting to further discuss the above.

Issue: Victor Logan, promoter of the Summer Boat Show, request for
financial assistance from the City of Miami as a result of the
West Courtyard roof construction being incomplete at the time
of his show.
Background: It has been brought to my attention that Victor Logan is attempting
to secure City of Miami Financial Assistance for his Sumer Boat
Show, because he alleges that staff informed him that roof construc-
tion would be complete by the time the Boat Show opens. Please
be advised that no member of the Coconut Grove Exhibition Center's
staff advised him that the roof would be ready and to the best of
my knowledge no one in the Public Works Department did either.
Everyone who is intimately connected with the Coconut Grove Exhibi-
tion Center is aware of possible pending litigation from past
events (i.e., ASTA and the Tropical Plant Show) from the roof not
being completed in the Fall of_1982, and consequently, it would
not make any sense to make a definite commitment to anyone that
the roof construction would be completed prior to the normal
completion date.
Recommendation: in my professional opinion, I would categorically not recommend
that Victor Logan be given any financial assistance for the Summer
Boat Show for the following reasons:
1. Victor Logan took the entrepreneurial risk of selling space
to exhibitors without a definitive knowledge that the building
would be ready.
2. The City is already providing financial assistance in the
amount of $5,000 for events personnel during the time of
his show as a result of his long term agreement.
3. Additionally, the City of Miami is providing approximately
$10,000 to $12,000 in dockage fees, etc. as a result of the
above mentioned long term agreement.

4. we had previously notified Victor Logan and your office in
writing on May 17th, 1983, that no member of the Coconut
Grove Exhibition Center's staff advised him that the building
would be ready (cite attached letter).
5. Furthermore; it is the understanding that the long term
agreement for use of the Coconut Grove Exhibition Center
is with the City of Miami and that any useage of facilities
here would have to be cleared through the Auditoriums
Manager's office and this was not done.for the courtyard
area as it related to the roof being completed in time for
the show.
Conclusion: In effect, we have an over zealous entrepreneur who played both
ends against the middle and is caught.

The following is a summary of my communications with Victor Logan
which he interpreted as a promise that the west courtyard area of
the Coconut Grove Exhibition Center would be available for use for
the summer boat show.
Shortly after a contract was awarded for the project, Mr. Logan
called me and asked that we give any and all assistance that we
could to the contractor so that the construction in the west court-
yard area would be completed by July 1 and in time for his use for
the summer boat show. Mr. Logan was aware of the 100 day construc-
tion time (he actually thought it was 100 calendar days, but it is
in fact 100 working days). He thought that the 100 day period had
begun upon award of the contract. I explained to him that the
100 day period would begin when we, had completed execution of the
contract, and ten days after we had given the contractor written
notice to begin work. I did assure Mr. Logan that I would give the
contractor all the assistance I could for his having the work in
the courtyard area completed by July 1. In keeping with that promise
I wrote the contractor on Feb. 1, 1983, that he was authorized to
submit shop drawings for approval immediately on any and all material
to be used on the project. I specifically had in mind fabrication
drawings for the structural steel, which I consider to be the criti-
cal element in completion of the project. I also contacted the con-
tractor, L.G.H. Construction Corp., and asked if they thought it
was possible that we could have the west courtyard area substantially
completed by July 1, and thus usable for the summer boat show. Their

answer was, Yes, f they could get prompt approval of their shop
drawings and didn't run into any unforeseen problems. This informa-
tion was relayed to Mr. Logan the next time.he called, along with
the assurrance that we were still doing our best to have the area
open to him.
Two complications arose that have made it

drawings submitted by the contractor were

Even though the consultant had dealt extensively with the Department
of Fire, Rescue and Inspections Services while preparing the plans,
when the contractor made application for a permit, the permit was
withheld because of code violations shown on the plans. It was not
until Apr. 25,1983 that all the problems in the plans were resolved
and a permit could be and was issued to the contractor for the work.
Even though the contractor was delayed in getting his permit, I
wrote him on March 23, 1983, and authorized him to proceed with the
foundation and demolition work without a permit, and he did half-
heartedly begin work prior to having a permit.
A chronological fact sheet for the project is attached for your use.
Mr. Logan is not correct in saying that I or anyone else in this
division promised that the area would be ready for his use for the
simmer boat show. It was always very clear in our conversations
that we were attempting to get an early completion of the project
that would benefit him. He chose to accept our cooperative efforts
as a commitment that we never made.

Dear Mr. Logan:
Victor Jay Logan, voluntarily came to this office to take a _
polygraph examination on June 15, 1983 at 9:30 a.m.. It was the
understanding of the examiner that the primary concern was whether
or not Mr. Logan was being truthful about statements made at the
Commission Meeting.
This examination was conducted by Robert Ottilige, licensed by the
State of Florida, license number GP 1007.
The instrument that was used for the examination, was a Stoelting
UltraScribe, utilizing at least four pens for simultaneous,
permanent and visual recordings of the employee's blood pressure,
pulse, respiration and galvanic skin response.
During the pretest interview, the following attached questions were
asked and then answered by Mr. Logan.

Based upon a careful analysis of Mr. Logan's polygrams, it was the opinion of the
examiner that there were NO SIGNIFICANT OR CONSISTENT PSYCHO -PHYSIOLOGICAL REACTIONS,
Indicative to deception, in the areas of his response to those previously listed
relevant test questions.
It was therefore the examiner's opinion that Victor Jay Logan answered those
questions truthfully. The examination concluded at 12:30 p.m..
