A RESOLUTION APPROVING, IN PRINCIPLE THE
CONCEPT OF PERMITTING THE INSTALLATION OF
LIGHT ORNAMENTAL STRUCTURES DISPLAYING
THE TIME OF DAY AND A COMMERCIAL
ADVERTISING MESSAGE AT SELECTED LOCATIONS
ON CITY STREET AND SIDEWALKS;
ESTABLISHING A DESIGN REVIEW COMMITTEE TO
EVALUATE THE DESIGN AND LOCATION OF SAID
STRUCTURES; FURTHER SETTING FORTH THE
REQUIREMENTS THAT THERE BE A PUBLIC
HEARING SCHEDULED AT THE TIME THE CITY
COMMISSION CONSIDERS APPROVAL OF THE
DESIGN AND LOCATION OF THE DISPLAY
STRUCTURES WHICH WILL BE INCLUDED IN THE
REQUEST FOR PROPOSALS TO BE USED IN THE
CITY'S COMPETITIVE PROCUREMENT PROGRAM
FOR SUCH STRUCTURES.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLOR IDA:
Section 1. In principle, the concept of permitting
the installation of light ornamental structures displaying
the time of day and a commercial advertising message at
selected locations on city streets and sidewalks is hereby
approved.
Section 2. A committee of five members appointed by
the City Commission is hereby established to he known as the
Design Review Committee. The City Manager and the Dean of
the School of Architecture of the University of Miami, or
their designees shall be members of said Committee. One
member shall be appointed from a list of three persons
proposed by each of the following:
a. the American Institute of Architects;
b. the Institute of Interior Designers; and
C. the Institute of City Planners.
Section 3. The Design Review Committee shall
evaluate any proposed design and location of the ornamental
structures and consider such factors as the need for citywide
continuity of structural design and concern for environmental
harmony throuqhout the city. An initial report to t

Commission by the Committee including Committee comments and
recommendations will be made within ninety days from the date
the City Commission completes the appointment of individual
members as provided in Section 2 of this Resolution.
Section 4. There shall he a public hearing scheduled
at the time the City Commission considers approval of the
design and location of the display structures which will
he included in the Request For Proposals to he used in the
City's Competitive Procurement Proqram for such structures.

SUBJECT Proposal to Place Clock
Advertising in the Public
Right -of -Way

The City of Miami has, over the past several years, received at least
three proposals to place clocks with advertising in the public rights -
of -way. Item 23 of the Commission Agenda for May 12, 1983 presents
a fourth proposal which I have not personally reviewed.
In the past, the Public works Department has indicated a desire to
keep this kind of construction out of the public rights -of -way because
of some technical problems. In addition, the City has spent many
years in trying to reduce the amount of advertising in the downtown
area of Miami, particularly in the use of billboards. The only benefit
to the public in allowing these structures to be constructed within
the City is that citizens would see the time of day and the temperature
and in some cases, the structures would provide certain messages that
could be programmed in by computer and would change from time to time.
It is apparent that prior to permitting this kind of advertising, a
public policy should be developed describing the areas of the City
where such advertising could take place, the size and height of such
structures, and how much money the City would expect to receive as a
result of permitting this privilege.
The companies proposing a clock advertising to the City in the past
are as follows:
Electronic Time, Inc. - Luis Parajon, Director; PRS International
Consulting.
Planigrama - Juan Manuel de la Huerta Lopez, President; Juan
Regas Esteve, Director; Pedro Neno, Director; Dr. Donald Hudson,
Representative.
Plani-Time. Inc. - Jose Manual Casanova, Consultant; Laureano
Garcia Concheso.
Because of the limited number of places where these clocks could be
located, and the fact that owners of buildings may now place clocks
and advertising on their own premises, it is recommended that clock
advertising be permitted only if:

1. A clear public policy has been established.
2. A definite need has been determined.
3. Sufficient mitigating circumstances are demonstrated such
as a significant revenue stream to the City or such other
amenities which would make this kind of facility desirable.
In view of the problems that have been identified, the placement of
clocks with advertizing in the public right-of-way should be opposed.

Please be advised that our law firm represents PRS
International Consulting, of Key Biscayne, Florida relative to
their intent to propose to the City of Miami providing the City
with time and temperature readings on Omega street clocks
located in certain city approved public right of ways.
The purpose of this letter is to respectfully request
that this proposal be submitted to the City of Miami Commission
at their upcoming May 12, 1983 meeting.
It is our objective to discuss this proposal with your
staff prior to the May 12th meeting and provide you with all of
the information that we possess which may be helpful to you in
evaluating a recommendation to the City Commission.
Officially, our law firm represents PRS International
Consulting, Electronic Time, Inc., the owner of the designs,
under patent of the subject structures and Omega Electronic
Equipment (Switzerland).
