HomeMy WebLinkAboutR-83-0595J 83- 522 RESOLUTION NO. 443--5931 A RESOLUTION RESCINDING RESOLUTION NO. 81-616, WHICH ACCEPTED THE PROPOSAL OF AND AUTHORIZED THE CITY MANAGER TO ENTER INTO A CONTRACT WITH AERIAL SURVEYS INTERNATIONAL, INC., TO PERFORM AN AERIAL SURVEY OF THE CITY, SAID R'SCISSION BEING NECESSARY DUE TO THE CONTRACTOR'S I'AILURE TO TENDER THE REQUIRED PERFORMANCE BOND; FURTHER REJECTING ALL PROPOSALS RECEIVED FOR SAID SURVEY PROJECT. WHEREAS, an up-to-date, complete aerial survey of the City of Miami is necessary and vital to the City's Capital Improve- ment Program for the design and construction of Highways, Storm and Sanitary Sewers and other needed improvements in the City of Miami; and WHEREAS, a proposal dated February 19, 1981, from Aerial Surveys International, Inc. stated that firm's ability and willing- ness to accomplish the aerial survey in accordance with the City's specifications; and WHEREAS, by Resolution No. 81-616, passed on July 9, 1981, a contract was awarded to Aerial Surveys International, Inc. for the project entitled CITY OF MIAMI AERIAL SURVEY, including Additive Items 1 through 9 inclusive of the proposal, in the amount of $34,570.47; and WHEREAS, after a period of two years since the award of the contract, the contractor has not secured the performance bond required in the specifications; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Resolution No. 81-616, passed on July 9, 1981, which accepted the proposal of Aerial Surveys International, Inc. for the project entitled CITY OF MIAMI AERIAL SURVEY, allocated funds for the project, and also authorized the City Manager to execute a contract with Aerial Surveys International, Inc., is hereby rescinded due to said firm's failure to tender the required performance bond. (For the 7/18/83 Commission ENCLOSURES: Meeting) is recommended that the City Commission, its scheduled July 18, 1983 meeting On February 19, 1981, Aerial Surveys International, Inc. responded to a City of Miami Request for Proposals (R.F.P.) to perform an Aerial Survey of the City of Miami. Resolution No. 81-616, adopted by the City Commission on July 9, 1981, accepted their proposal, allocated funds for the project, and authorized the City Manager to execute a contract with this firm to perform the aerial survey. As a part of the specifications for this job a performance bond was required. Now, two years since the award of the contract, the contractor has still not secured the required performance bond. Therefore, we must rescind the awarding resolution in order that we may proceed to issue a new-R.F.P. and acquire the professional services necessary to perform the aerial survey. As to why we waited this long before taking this action: when we realized the contractor would not be able to secure the performance bond, we verbally agreed to his suggestion that he be allowed to perform the work without a contract and at his own risk. Payment would have been made upon his successful completion of the work and its acceptance by the City. However, he has completed less than 5% of the required work, and despite numerous requests failed to supply any aerials since June of 1982. Our intention is to issue a proposed resolution as this and necessary component in Program.
