AN EMERGENCY ORDINANCE ESTABLISHING A NEW
SPECIAL REVENUE FOND ENTITLEDt "CABLE TV
LEGISLATIVE EFFORT - 08TH CONGRESS";
APPROPRIATING FONDS FOR ITS OPERATION IN THE
AMOUNT OP $50,000, FROM REVENUES AVAILABLE
FROM CABLE TV LICENSE FEES FOR THE PURPOSE OF
ADVISING LEGISLATORS OF THE CITY'S POSITION
REGARDING PROPOSED FEDERAL LEGISLATION
AFFECTING CABLE TELEVISION AND THE CITY'S
R90ULAT'ION THERSOF; AND AUTHORIZING THE CITY
MANAGER AND CITY ATTORNEY TO EXECUTE
AGREEMENTS FOR PROFESSIONAL SERVICES AS
NEEDED TO CARRY OUT THIS PURPOSE; CONTAINING
A REPEALER PROVISION AND A SEVERABILITY
CLAUSE AND WAIVING THE REQUIREMENT OF READING
SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT
LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE
COMMISSION.
WHEREAS, S.66, as amended and passed by the U.S. Senate on
June 14, 1983 would have severe adverse impact upon the City of
Miami's ability to protect consumers through regulation of its
cable television licensee; and
WHEREAS, S.66 has been referred to the U.S. House of
Representatives Committee on Commerce and Energy; and
WHEREAS, the House Sub -Committee on Telecommunications,
under Chairman Tim Wirth, is now drafting cable television
legislation to be introduced in the House; and
"'WHEREAS,, the City Commission passed Motion 83-507 on
June 15,'1983 authorizing and directing the City Manager to take
the necessary action to send a message to the Congressional
delegation and to our Senators registering a strong protest of
the City of Miami Commission of Bill No. 66 regarding Cable
Television; and directing that City representatives fly to
Washington, D.C. to discuss this matter with our Senators and
Representatives; and
WHEREAS, Mark Israel, the City's legislative liaison, has

developed a legislative action plan with City staff, the U.S,

Conference of Mayors, the City of New York, and other concerned

municipalities= and
WORACAS, a vital part of this legislative action plan is a

recommendation that the Mayor and City Commission as a body fly
to' Washington, D.C. in late July or early August to meet with"

Sue Smoller will be in close touch with Mark Israel and will continue
to work with Left Simon and the staff of the U. St Conference of Mayora
and to serve on the steering committee of the group of concerned
cities that includes New York City.
Role of Arnold Porter
The role of Arnold & Porter will include:
In-depth analysis of the effect of S.66 on City ordinances;
Research and preparation of a detailed paper reflecting City
positions to give input to the subcommittee working group
preparing legislation to be introduced in the House;
Preparation of various papers presenting the City's position
on Cable Legislation, including position papers to be used to
build support from other cities against S.66;

Provision of briefing materials for Mayor and Commission;
Assistance in identifying legislative goals and in lobbying
efforts.
