A RESOLUTION ACCEPTING THE BID OF
KENNEY DRAPERY ASSOCIATES, INC. IN
THE PROPOSED AMOUNT OF $374,000,
BID "A" OF THE PROPOSAL, FOR CITY OF
I1IIA.�II/UNIVERSITY OF MIAMI JAMMES L.
KNIGHT INTERNATIONAL CENTER - STAGE
RIGGING; WITH MONIES THEREFOR ALLOCATED
FROM THE CITY OF MIAMI/UNIVERSITY OF
MIAMI JAMES L. KNIGHT INTERNATIONAL
CENTER AND PARKING GARAGE ACCOUNT
IN THE AMOUNT OF $374,000 TO COVER
THE CONTRACT COST; ALLOCATING FROM
SAID FUND THE AMOUNT OF $37,400 TO
COVER THE COST OF PROJECT EXPENSE;

OF $7,480 TO COVER THE COST OF SUCH
ITEMS AS ADVERTISING, TESTING LABORATORIES,
AND POSTAGE; AND AUTHORIZING THE
CITY MANAGER TO EXECUTE A CONTRACT
WITH SAID FIRM
1,1HEREAS, sealed bids were received July 11, 1983
for CITY OF MIAMI/UNIVERSITY OF MIAMI JAMES L. KNIGHT
INTERNATIONAL CENTER - STAGE RIGGING; and
WHEREAS, the City Manager and the Director
of the Department of Public Works recommend that the
bid received from Kenney Drapery Associates, Inc.,
for Bid "A" of the proposal, be accepted as the lowest
responsible and responsive bid; and
WHEREAS, the Capital Improvements Appropriation
Ordinance No. 9534, as amended, was adopted on December 9,
1982, and monies are available for the proposed amount
of the contract, project expense, and incidentals from
the account entitled "City of Miami/University of Miami
James L. Knight International Center and Parking Garage",
as set forth under Section X.B.1 of said ordinance;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:

Section 1. The .July 11, 1983 bid of Kenney Drapery
Associates, Inc., in the proposed amount of $374,000,
for the project entitled CITY OF MIAMI/UNIVERSITY OF
MIAMI JAMES L: KNIGHT INTERNATIONAL CENTER - STAGE
RIGGING, for Did "A" of the proposal, based on lump
sum prices, is hereby accepted at the price stated
therein.
Section 2. The amount of $374,000 is hereby
allocated from the account entitled "City of Miami/
University of Miami James L. Knight International Center
and Parking Garage" to cover the cost of said contract.
Section 3. The additional amount of $37,400
is hereby allocated from the aforesaid fund to cover
the cost of project expense.
Section 4. The additional amount of $7,480 is
hereby allocated from the aforesaid fund to cover the
cost of such incidental items as advertising, testing
laboratories, and postage.
Section 5. The City Manager is hereby authorized
to enter into a contract on behalf of The City of Miami
with Kenney Drapery Associates, Inc. for CITY OF MIAMI/
UNIVERSITY OF MIAMI JAMES L. KNIGHT INTERNATIONAL CENTER -
STAGE RIGGING, Bid "A" of the proposal.

The Department of Public [forks recommends
adoption of the resolution accepting the
bid received July 11, 1983 of Kenney
Drapery Associates, Inc. in the amount of
$374,000.00;and authorizing the City
Manager to enter into a contract on behalf
of the City of Miami for CITY OF MIAMI/
UNIVERSITY OF MIAMI JAMES L. KNIGHT INTER-
NATIONAL CENTER - STAGE RIGGING (BID "A").
Bids were received July 11, 1983 for supplying and installing
the stage rigging and curtains for the Convention Hall and
University Auditorium, located at 400 S.E. Second Avenue.
As reflected in the tabulation of bids, the $374,000 bid of
Kenney Drapery Associates, Inc. is the lowest responsible bid
for Bid "A" of the proposal.
Funds have been allocated under the "City of Miami/University
of Miami James L. Knight International Center and Parking
Garage Account" for the estimated amount of the contract, for
project expense, and for such items as advertising, testing
laboratories, and postage.
Seventeen contractors picked up plans and specifications; six
cg tractors submitted bids. The engineer's estimate was $330,000.

The Convention Center Stage Rigging project consists of two parts;
stage rigging and curtains (Bid "A") and electrical work (Bid "B").
In order to clarify the misunderstanding regarding the electrical bids
for the Electrical Work (Bid "B") on the stage rigging, enclosed are
copies of the proposals received from the lowest and second lowest
bidders for this work. Both bidders are minority contractors and are
qualified to do the work.
For further clarification, enclosed is a copy of the proposal from
Kenney Drapery, the low bidder for the Stage Rigging (hardware &
curtains). They are a local firm and will be using local labor and
services on the project. All the other bidders were out of state and
none were minority owned.
In order to meet the City's commitment for the Convention Hall and to
avoid further delay, it is essential that the Convention Center Stage
Rigging be re -scheduled for the City Commission Meeting of July 28, 1983.

that he has made no changes in these Contract Documents.

A contract will be awarded on the basis of Bid "A" or on the basis of
Bid "B", or a contract will be awarded on the basis of both Bid "A"
and Bid "B", whichever is in the best interest of the City, and
depending on the availability of funds.
STARTING AND CONSTRUCTION TI2%1ES :
The bidder agrees to start work within ten (10) consecutive calendar
days after date of written notice from the Engineer to begin work.
The work may be started on any working day within this ten (10)
consecutive calendar day period. The bidder shall complete the
entire contract in accordance with the plans and specifications
therefor within one hundred and twenty (120) calendar days, and this
time is of the essence. The one hundred and twenty (120) calendar
day period shall begin on the first working day after the above noted
loth calendar day. Work associated with Additive Item shall be
completed along with any work remaining on the entire contract within one
hundred and twenty (120) calendar days, as outlined above. All work
shall be in full and in complete accordance with all terms and conditions
set forth in and covered by the contract documents.
Should the Contractor fail to complete the work on or before the date
specified, it is agreed that for each calendar day that any portion
of the work shall remain uncompleted, after the time specified in the
proposal, with any extension of time which may be allowed by the City
for the completion of the work provided for in the contract documents,
the sum per day, given in Division 2 - Special Provisions, shall be
deducted from the monies due the contractor, not as a penalty but as
liquidated damages and added expense for inspection.
The names of any subcontractors and their current County -Municipal
Occupational License numbers for the type of work shall be listed
below. No change in subcontractors will be allowed without written
approval of the Engineer. Subcontractors shall hold the license at
the time of executing and during the performance of this contract.
