A RESOLUTION AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE A CONCESSION AGREEMENT
BETWEEN THE CITY OF MIAMI AND THREE SOLE PRO-
PRIETORS TO OPERATE THREE VENDING KIOSKS AT
THE MANUEL ARTIME COMMUNITY CENTER MINI PLAZA
IN ACCORDANCE WITH TERMS OUTLINED IN THE
JULY 22, 1983 MEtIORANDUN FROM THE DIRECTOR OF
THE DEPARTMENT OF COMMUNITY DEVELOPt?ENT.
WHEREAS, the Manuel Artime Community Center mini plaza, completed in
February, 1983, has three permament vending kiosks; and
WHEREAS, the City advertised for proposals from individuals interested
in operating the vending kiosks; and
WHEREAS, only three individuals responded to the City's solicitation; and
WHEREAS, it is in the best interest of the City to execute a concession
agreement for the operation of the kiosks,
FLORIDA:
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
Section 1. The City Manager is hereby authorized to negotiate and execute
an agreement in accordance with terms outlined in the July 22, 1983 memorandum from
the Director of the Department of Community Development between the City of Miami
and the following individuals for the operation of three vending kiosks at the
t'anuel Artime Community Center mini plaza:
1. Orlando G. Napoles, 1951 N.W. 21st Terrace, Apt. 3,
Miami, Florida 33142, for a newspaper concession.
2. Edith Menendez, 721 S.W. 3rd Street, Apt. 4,
Miami, Florida 33130, for a flower concession.
3. Martiniano Perez, 3828 S.W. 29th Street,
Miami, Florida 33134, for a snack food concession.

It is recanmended that the City Comr:ission
authorize the City Manager to negotiate
and execute a concession agreement with
three individuals for the operation of
three vending kiosks at the Manuel Artime
Community Center mini plaza, per attached
resolution and in accordance with the
terms outlined below.
The Manuel Artime Community Center mini plaza, completed in February, 1983, has
three permanent vending kiosks (approximately 6'x 6' in size) as part of the
plaza design.
On two occasions (in late January and in June, 1983), we solicited proposals from
individuals and/or businesses interested in operating the kiosks by placing news-
paper advertisements and sending letters to existing City concessionaires, as well
as to businesses in the area around the Community Center.
We received no response to our first request for proposals.
There were only three individuals responding to our second request for proposals
as follows:
1) Martiniano Perez, 3828 S.W. 29th Street, Miami, Florida 33134.
Mr. Perez is proposing to sell churros (a type of pastry),
granizados (ices), and other refreshments.
— 2) Orlando Napoles, 1951 N.W. 21st Terrace, Apt. 3, Miami, Florida 33142.
Mr. Napoles is proposing to set up a newspaper and magazine stand,
with possibly a shoe shine stand.
3) Edith Menendez, 721 S.W. 3rd Street, Apt. 4, Miami, Florida 33130.
Ms. Menendez is proposed to sell flowers (artificial and natural),
as well as small c3ift items.

and the necessary licenses and permits for the conduct of business.
Because we have no way to forecast their revenues since are have an untested market.
and the three individuals have little or no capital, it is recommended that the
City negotiate and execute an agreement with the aforenamed allowing them to each
pay 'S10/month for a period of six months to determine a fair minimum payment and
allow the concessionaires to recover their initial investment. After the six-
month period, we will renegotiate the concession agreement and subirit it along
with a report to the City Commission.
Durina the first six months, we will require that the concessionaires submit a
monthly report on gross revenues received and the number of plaza visitors. They
will also be required to purchase the required liability insurance and maintain
the cleanliness of the kiosks and plaza area in general.
By authorizing this action, the City will provide a unique business opportunity
for these three individuals who have all had previous experience in concession sales
as well as provide a service for the Center's employees and visitors.
Commission approval is requested in order that are have the kiosks operating by
mid -August.
