CONCLUSIONS SET FORTH IN THE PREAMBLE OF
[HIS RESOLUTION; FURTHER AUTHORIZING AN
INCREASE OF 90 WORKING DAYS IN THE
CONSTRUCTION TIME FOR SAID PROJECT.
WHEREAS, there exists a contract dated May 11, 1982
between the City of Miami and Better Construction, InC. in
the amount of $19910,934 for the construction of Jose Marti
Riverfront Park; and
WHEREAS, an increase in the contract is required because
of additional and unforeseen work needed to protect the river
edge bulkhead from salt water intrusion, added length to
bulkhead tiebacks as required by Metropolitan Dade County
Department of Environmental Resources, and poor soil
conditions encountered at the site that will require the
hauling away of debris and its replacement with the suitable
soil; completely depleting the cash allowance set forth in
the proposal to rover special items; and
WHEREAS, the City Manager has made a written finding
that a valid emergency existed under the circumstances; and
WHEREAS, the Director of the Department of Parks
recommends the increase in contract to cover the additional
cost and has certified that funds for the increase are
available from U. S. Depatment. of Interior Land and Water
Conservation Funds; and
WHEREAS, the special work items have delayed the
contractor and have caused it to request additional

WHEREAS, the contractor has agreed that the granting of
this additional construction time shall not he used as a

WHEREAS, the Direr.turs of the Depnrtmr,nts of Park._- and
Public Works recommend the Brantinq of an additional 90
working days construction time;
NOW, THEREFORE, I3F IT RESOLVED BY THE COMI.IISSION OF THE
CITY OF MIAMI, FLORIDA:
Sect inn 1. After a property advertised public hearing,
the finding of the City Manager set forth in the preamble to
this Resolution is hereby rat ified by an affirmative vote of
2.'3rds of the City Commission and adopted as if fully set
forth in this Section.
Section 2. The contract between the City of Miami and
Better Construction, Inc., dated May 11, 1982, for the
construction of Jose Marti Riverfront Park is hereby
increased by $35,000 with funds therefor hereby allocated
from U. S. Department of Interior Land and Water Conservation
Funds.
Section 3. The construction time allowed by the
contract documents for the same contract is hereby increased
by 90 workinq days.

The Department of Public Works recommends the
adoption of a resolution authorizing an increase
in the contract between the City of Miami and
Better Construction, Inc., for the construction
of Jose Marti Riverfront Park in the amount of
$35,000, said funds to be provided entirely by
U.S. Department of Interior Land and Water
Conservation Funds, and authorizing an increase
of 90 working days in the construction time for
the project.
There is a contract dated May 11, 1982 between the City of Miami
and Better Construction, Inc., in the amount of $1,910,934 for
the construction of Jose Marti Riverfront Park. The park is
located on the south side of the Miami River between S. W. 3 and
4 Avenues, extending as far south as S. W. b Street.
Additional work and expense we have incurred by corrections we had
to make to the river edge bulkhead, added length to the bulkhead
tiebacks as required by Metropolitan Dade County Department of
Environmental Resources, and poor soil conditions we have en-
countered that will require the hauling away of debris and replace-
ment with suitable soil will completely deplete the cash allowance
for the project. We are aware of other items of special work that
are forthcoming that will require the replenishing of the nearly
depleted cash allowance. The Director of the Department of Parks
agrees with the recommendation for the increase in contract of
$35,000 to replenish the cash allowance, and has certified that
funds for the increase are available from U.S. Department of
Interior Land and Water Conservation Funds.
The special and extra work referred to above has also
contractor, and has caused him to request additional
time. The Director of the Department of Parks concur
recommendation of adding an additional 90 working day
construction time for the project.
