WHEREAS, the Miami Zoning Board at its meeting of May 16, 1983, Item No. 2 followinq an advertised hearing, adopted Resolution No. ZR 83-83, GRANTING a variance as hereinafter set f.,-)r_ th; and WHEREAS, the objectors have taken an appeal to the City Commission from approval of the variance; and WHEREAS, the City Commission, after careful consideration of this matter finds that due to peculiar circumstances affecting this parcel of land, practical difficulties or unnecessary hardship would impair the owner's right to the reasonable use of the property without the variance granted as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The variance granted by the Zoning Board from ordinance No. 6671 ARTICLE IV, Section 11(1), to permit the creation of a lot described as Tract "A" tentative plat #1151-D, "GRANT SUBDIVISION" also described as approximately 3639 North- east Miami Place, as per survey on file, with an average width of 28' (60' required); and a second street frontage of 25' (30' required); subject to a recorded unity of title; zoned C-5 (LIBERAL COMMERCIAL) is hereby affirmed. The Zoning Board, at its meeting of May 16, 1983, Item 2, following an advertised hearing, adopted Resolution ZB 83-83 by a 5 to 0 vote, granting a variance to permit the creation of a lot at approximately 3639 NE Miami Place, also described as Tract A,'Tentative Plat #11'51-D, "GRANT SUBDIVISION", as per survey on file, with an average width of 28' (60' required), a second street frontage of 25' (30' required) and subject to a recorded unity of title; zoned C-5 (Liberal Commercial). Two objections received in the mail; two opponents present at the meeting. One reply in favor received in the mail; three proponents present at the meeting. Backup information is included for your review. A RESOLUTION to provide for the above has been prepared by the City Attorneyis Office and submitted for consideration of the City Commission. Approval Subject to Unity of Title The method ot determining average lot width in this instance does not work and is not logical as the western portion of the site meets the average lot width by itself. The unity of title will assure that the northeastern portion (25') will not be sold off as a separate site. Dedication is required by plat. Recommends that the eastern portion of Tract "A" which fronts on N.E. lst Ave not have vehicular access to N.E. 1st Ave for lack of on site turn around. GRANTED on May 16, 1983, Res.
