A RESOLUTION RATIFYING, APPROVING, AND CONFIRMING
THE ACTION OF THE CITY MANAGER IN ENTERING INTO
AN MEMORANDUM OF UNDERSTANDING IN THE FORM
ATTACHED WITH METROPOLITAN DADE COUNTY TO PROVIDE
FUNDING FROM THE FLORIDA BOATING IMPROVEMENT
REVENUES ALLOCATED TO DADE COUNTY TO BE DISTRIBUTED
TO THE CITY OF MIAMI IN AN APPROXIMATE AMOUNT OF
$545,000 OVER A THREE YEAR PERIOD TO BE USED FOR
CITY OF MIAMI WATERFRONT IMPROVEMENTS.
WHEREAS, Section 327.28 of the Florida Statutes has established
a procedure whereby the State boat registration fees are distributed
to counties generally based upon collection of said fees; and
WHEREAS, Dade County over the past eight years has received in
excess of two million dollars ($2,000,000) of funding from this source;
and
WHEREAS, during that period of time none of these funds have
been shared with the City of Miami; and
WHEREAS, the City of Miami has provided both citizens of the
City of Miami and Dade County with boat launching and other water-
front facilities from revenues derived from City of Miami resources;
and
WHEREAS, the City of Miami pursued the adoption of a legislative
bill that would have required Dade County to share its revenues with
the City of Miami; and
and
WHEREAS, Dade County objected to the passage of such a bill;
WHEREAS, in lieu of a State legislative act Dade County has
offered to share said revenues from boat registration fees with the
City of Miami; and
WHEREAS, the City of Miami Parks Department and Dade County Parks
Department have developed a Memorandum of Understanding; and
WHEREAS, said Memorandum of Understanding provides for the
distribution of approximately $545,000 in State boat registration
revenues to pass through the County to the City of Miami for the
development of eligible waterfront projects; and

WHEREAS, said Memorandum of Understanding provides that as a
minimum during the three year period Miami would rccei_v< an aggregate
of two-thirds of the Dade County entitlement; and
WHEREAS, said Memorandum of Understanding provides for future
participation by the City of Miami in receiving 1 portion of these
funds;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA, THAT:
Section 1. The City Manager's action in entering into a Memorandum
of Understanding in the form attached with Metropolitan Dade County
to provide funding from the Florida Boating Improvement revenues
allocated to Dade County to be distributed to the City of Miami in
an approximate amount of $545,000 over a three year period to be used
for City of Miami waterfront improvements, is hereby ratified,
approved and confirmed.

During the past eight years Dade County has been receiving annual
allotments from State Boat Registration Fees provided for in
Section 327.28 of the Florida Statutes without sharing these revenues
with the City of Miami. The City of Miami boat owners provide a sub-
stantial portion of the State boat registration revenues collected
in Dade County. In addition, the City of Miami provides for boating
and waterfront facilities that are enjoyed by both City of Miami
citizens and Dade County citizens as well. Since 1974, Dade County
has received approximately $2,038,000 for projects located mostly
in the unincorporated areas of Dade County. Attempts by the City of
Miami to share in these funds were unsuccessful.
In 1982 Representative John Cosgrove (Democrat), offered to champion
a bill which would require counties to share these revenues with
municipalities. In the 1983 session, Representative Cosgrove's bill
(HB 50), was favorably reported out from two committees. However,
Dade County's administrative representatives in Tallahassee requested
that the City of Miami accept a Memorandum of Understanding to share
in the proceeds of the County's entitlement for State boat registra-
tion fees in lieu of pursuing House Bill 50. The attached Memorandum
of Understanding provides the City with a fair share of revenues
collected for use by the City of Miami on waterfront improvements.
This Memorandum of Understanding resolves the issue that developed
over the years between the City of Miami and Dade County over the
use and distribution of these funds.

The Memorandum of Understanding was negotiated by Carl Kern, City
of Miami Parks Director and his assistant Ralph Gonzalez, and Bill
R. Bird, Director of Dade County Parks and Recreation. It was
through their diligent negotiations and the assistance of Rick
Sisser, City of Miami's legislative liaison, that this Memorandum
of Understanding was achieved.
This Memorandum has been forwarded to Metropolitan Dade County for
signing. It was important to enter into this agreement early enough
so that the proper planning could take place in the distribution and
utilization of these funds that come to the County from the State of
Florida each year.

MEMORANDUNA OF UNEIERSTANDING
BETWEEN
METROPOLITAN OADE COUNTY, FLORIDA
AND THE
CITY OF MIAhlI, FLORIDA
WHEREAS, the Florida Department of Natural Resources administers a State
entitlement financial assistance source titled the Florida Boating Impro,ement Program
(hereinafter referred to as the Program), and
WHEREAS, both the legislation creating the Program and the rules governing the
Program stipulate that the financial assistance shall be distributed to the Counties of the
State of Florida, and
WHEREAS, the financial assistance provided to the Counties must be utilized for
recreational channel marking, public launching facilities and other boating related
acti,, Aies, and
WHEREAS, Metropolitan Dade County (hereinafter referred to as the County) is
notified annually of the amount available through the Program for such boating
improvements within the County, and
WHEREAS; the County has utilized the previous entitlements to upgrade and expand
boating facilities at its Haulover, Pelican Harbor, Crandon, Matheson, and Homestead
properc,es co help serve residents and tourists throughout the Ca.::,ty, and
WHEREAS, the City of Miami (hereinafter referred to as the City) has identified
impro.ements that are necessary to upgrade and/or expand City boating facilities, and
WHEREAS, the City improvements will help serve the residents -and tourists of the
Ccr.;nty as well as the City,
NOW, THEREFORE, IT IS UNDERSTOOD THAT:
1. Should the City desire to receive a portion or the entire amount of one or more of
the County's annual program entitlements, the City shall provide such information
concerning the proposed boating improvements as the County deems necessary, and
2. The County shall review the CIty's information to determine if the proposed
improvements comply with the Program rules and if the proposed improvements are
a high priority use of the County's annual Program entitlements(s), and
3. Should the City's proposed Improvements comply with the Program rules and be a
high priority, the County shall prepare, submit and seek the approval of a Program
application through the Florida Department of Natural Resources, and
4. Should a City Program project be approved by both the County and the State of
Florida, the County shall subcontract all applicable Program rules and regulations to
the City for the project's successful implementation, and

A. To help the City upgrade and/or expand its boating facilities, the County shall make

available to the City a portion of the total three year County entitlement received
during Fiscal Years 1983-84, 1984-85 and 1985-86 for up to two program projects, in
the followirg manner:

This will award the City approximately 65,000 of the 1983-84 funds, all but
approximately 650000 of the 1984••85 funds, and all of the 1985-86 funds, whatever
the entitlement amounts may be. In the event that entitlements fall below
projections, the County shall rec,,ive one third of the total entitlement and the City
two thirds.
B. Should additional City boating improvements be identified following this three year
period that are needed to help serve the residents and tourists of the County as well
as the City, steps 1-4 above will be followed, and
C. Should the City desire to provide input for the process by which the County's
Program projects are selected beginning in Fiscal Year 1966-87, such opportunity
shall be afforded by the County to the City, and
D. The County's responsibilities shall be fulfilled by its Park and Recreation
Department, and
E. The City's responsibilities shall be fulfilled by its Parks Department.
This Memorandum of understanding shall take effect on the
day of in the year and shall remain
in effect until the Dade County Board of County Commissioners and the Miami City
Commission authorize an Intergovernmental Agreement addressing the herein described
activities.
