I wish to bring to the City Commission's attention that the effect of Ordinance 9585.and 9664 is to take away,from. the City Zoning Department any'jurisdiction to grant variance on liquor zoning matters and for other matters referred to in the Ordinance. Certainly, this was not the intention of the City Commission, because such a result would require the City to pass a special Ordinance for the relief of worthy individuals who required a variance. I represent Mr. Frank King who through his corporation, F.K. Inc., owns the property at 1220 N.W. 54th Street, Miami, Florida, and who wishes to open a Bar and Package Store. The property was used for this purpose for many years previously but was closed down at the time of the riots, the liquor license moved. When Mr. King purchased the property he went to reopen the Bar with a new license and he was prevented from doing so because another Bar was too close even though the other Bar and our predecessor had been doing business at the same time. Under the old law we would have asked for a variance. Zoning now tells us that the new ordinace prevents them from considering any case regardless of how worthy. I am sure the City did not intend this result and if brought to their attention will restore the jurisdiction of the City Zoning Department. I will be away until September 5th and trust that upon my return to the City that my request to appear before the ii D/ScUSf%ON y t %, it.
