A RESOLUTION MAKING FINDINGS AND RESCINDING CITY
COrTMISSION RESOLUTION NO. 75-922, AS IT APPLIES TO
THE DESIGNATION OF REAL PROPTPTY I,0CATED AT APPROX-
It1�1, 623-799 BRICRELL, AVI I.'UL, '-IIAMI , FLORIDA,
AS Ei�VIRONMENTAL PRESERVATION DISTRICT NO. 36-2,
BUT RETAINING THE DLSIGNATIONS TO OTHER PARCELS OF
LAND LOCATED WITHIN THE AREA DL:SCRIBED IN SAID RE-
SOLUTION NO. 75-922, AND ENUMiERATED AS ENVIRON-
MENTAL PRESERVATION DISTRICTS 26-1, 26-2, 28-1,
31-2, 13-1 AND 33-2.
WHEREAS, City Commission Resolution No. 75-922 adopted
October 9, 1975, established the property located at approximately
623-799 Brickell Avenue, Miami, Florida, as an Environmental Pre-
servation District pursuant to Chapter 17 of the City Code; and
WHEREAS, the parcel of land located at approximately
623-799 Brickell Avenue was designated Environmental Preservation
District Number 36-2 pursuant to said Resolution No. 75-922; and
WHEREAS, past replattinr, of the subject property as
"Flagship Subdivision (109 - 100)" and subsequently "Nastier
Subdivision (117-90)', and the construction of the Flagship Build-
ing and the accessory surface parking lot have caused the desig-
nation of the subject property as an environmental preservation
district to become obsolete; and
WHEREAS, the Planning Advisory Eoard at its meeting of
September 14, 1983, Item No. 6, following an advertised hearing,
adopted Resolution Nn. PAB-110-83, by a 6 to 0 vote, RECOt-IMENDING
APPROVAL, of the rescision of Environmental Preservation District
No. 36-2, as hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration
of this matter deems advisable anr, in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
the Environmental Preservation District Rescision, as hereinafter
set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:

Section 1. It is hereby found that the designation of
real property located at apprnxiriatcly G23-79`? i:irickell Avenue,
Miami, Florida, (complete legal description of the property on file
with the Planning and Zoning Boards Administration Deaartment) has
become obsolete and no longer beneficial to the City clue to the
subsequent sequential replattings as "Flagship Subdivision (108-100)
and "Hasher Subdivision 117-90", as well as the construction of the
Flagship Building and the accessory surface parking lot.on the
property.
Section 2. City Commission Resolution No. 75-922,
adopted October 9, 1975, establishing the above referenced real
property as an Environmental Preservation District pursuant to
Chapter 17 of the Code of the City of Miartii and numbered 36-2,
is hereby rescinded.
Section 3. Real property parcels described and designated
as Environmental Preservation Districts in said Resolution No.
75-922, and numbered 26-1, 26-2, 28-1, 31-21 33-1 and 33-2 shall
retain their Environmental Preservation District status.

Consideration of recommendations to the City Commission
concerning rescinding of Environmental Preservation District
#36-2 from the property located at 623-799 Brickell Avenue,
pursuant to Chapter 17 of the City Code.
REQUEST
To lift an obsolete restriction on development.
BACKGROUND
Resolutio* 75-922; October 9, 1975 established Environmental
Preservation District #36-2, pursuant t6 Chapter 17 Environmental
Preservation of the City Code. This district was between the
Harbor Inlet Apartments and the Bulmer Apartments.
ANALYSIS
Replatting as Flagship Subdivision (108-100) and then the
Nasher Subdivision (117-90) and the construction of the
Flagship Building and the accessory surface parking lot
have caused this legislation to become obsolete.
