WHEREASi the Miami Zoning Board, at its meeting of June 13,
1983, Item No. 6, following an advertised hearing, adopted
Resolution No. ZB 94-83, by a 4 to 2 vote, RECOMMENDING APPROVAL =
of a change of zoning classification, as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of 7
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;

Section 1. The Zoning Atlas of Ordinance No. 9500, the

DECLARATION. OF RE$TRICTIVE COVENANTS
Know all men by these presents:
That Felipe A. Val l s and Luis Martinez, being the fee -simple owner of the,
parcels described on Exhibit "A"attached hereto and matte a part hereof* make th#
following Declaration of Restrictive Covenants, covering and running with tht
property,,specifying that this Restriction during its lifetime shall be for thi
behefi t of* and a limitation upon, all present and future comers of the real
property describedon said Exhibit "A". '
The undersigned 'are presently applying before the Zoning Board and the _
City Commission of the City of Miami for a certain zoning change. In connect-
ion therewith, the undersigned agrees:
1. Any office established on the real property shall be for a business
not involving sale or handling of merchandise on the premises. .
2. That the present structures now existing shall be mantained in its
current use, and any -future change of use or additional construction, other
than to demolish the existing structures for the purpose of providing --_--
additional parking areas (which will be constructed in accordance with the
existing City of Miami Codes),shall be submitted and receive approval by a
majority vote of the Zoning Board of the City of Miami.
3. This Declaration of Restrictive Covenants may be modified, amended or
released as to any portion of the parcels described on Exhibit "A" by a ----
written instrument executed by the then owner of the fee simple title to thq
land to be affected by such modification., amendment or release, and approved -
by the City of Miami or the Zoning Board of the City of Miami whichever by
law has jurisdiction over such subject matter.
4. Should this -Declaration of Restrictive Covenants be so modified,.--
amended or released, the Director of the City of Miami Building and Zoning
Department shall execute an instrument effectuating and acknowledging such
modification, amendment or release.
