HomeMy WebLinkAboutR-23-0235City of Miami Resolution R-23-0235 alldl 11 li.Rl I + Legislation File Number: 13868 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 5/25/2023 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO SUPPORT A REQUEST BY THE DEPARTMENT OF FIRE - RESCUE ("FIRE") TO THE FEDERAL EMERGENCY MANAGEMENT AGENCY ("FEMA") TO UTILIZE AN ALLOTMENT OF FEMA GRANT FUNDS IN THE AMOUNT OF $29,400.00, FROM THE SPECIAL REVENUE PROJECT TITLED "URBAN AREA SECURITY INITIATIVE (`UASI') GRANT PROGRAM FISCAL YEAR 2021", ESTABLISHED BY RESOLUTION NO. R-22-0078, ADOPTED FEBRUARY 24, 2022, FOR THE PURCHASE OF TWO (2) NEW UNMANNED AERIAL VEHICLES ("DRONES") PRODUCED BY A MANUFACTURER APPROVED BY THE FLORIDA DEPARTMENT OF MANAGEMENT SERVICES AS PROVIDED IN SECTION 934.50, FLORIDA STATUTES, TO BE UTILIZED BY FIRE TO INCREASE SITUATIONAL AWARENESS CAPABILITIES AT VARIOUS EMERGENCY INCIDENTS INCLUDING ACTS OF TERRORISM OR NATURAL DISASTERS; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS, RENEWALS AND EXTENSIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR THE PURCHASE OF SAID DRONES. SPONSOR(S): Commissioner Christine King WHEREAS, pursuant to section 934.50, Florida Statutes, the Florida Department of Management Services ("Department"), in consultation with the State Chief Information Officer, has published a list of approved drone manufacturers that have demonstrated the appropriate safeguards to protect the confidentiality, integrity, and availability of data collected, transmitted, or stored by a drone, which may be purchased or otherwise acquired and used by a governmental agency; and WHEREAS, section 934.50, Florida Statutes, requires all governmental agencies to discontinue the use of drones produced by manufacturers not included on the Department's approved list; and WHEREAS, the City of Miami's Department of Fire -Rescue ("Fire") current fleet of drones were purchased prior to the implementation section 934.50(7), Florida Statutes and manufacturer by a company not included on the Department's approved list; and WHEREAS, Fire is seeking to become compliant with section 934.50, Florida Statutes by replacing its current drones with two (2) drones produced by a company included in the Department's approved list of drone manufacturers and WHEREAS, Fire intends to utilize Federal Emergency Management Agency ("FEMA") grant funds, in the amount of $29,400.00, from the Special Revenue Project titled "Urban Area City of Miami Page 1 of 2 File ID: 13868 (Revision: A) Printed On: 6/5/2023 File ID: 13868 Enactment Number: R-23-0235 Security Initiative ('UASI') Grant Program Fiscal Year 2021" established by Resolution No. R- 22-0078, adopted February 24, 2022, for the purchase of Department approved drones; and WHEREAS, pursuant to FEMA Policy 207-22-0002 titled "Prohibited or Controlled Equipment Under FEMA Awards," FEMA considers drones to be "controlled equipment" and is therefore regulated with policy and prerequisite requirements that must first be met by grant recipients before a drone may be purchased with FEMA grant funds; and WHEREAS, the aforementioned policy requires that a jurisdiction first provide evidence to FEMA that their governing body supports or authorizes the acquisition of drones as a controlled equipment purchase; and WHEREAS, Fire seeks the support of the City Commission to utilize FEMA grant funds for the purchase of two (2) drones produced by a company included in the Department's approved list of drone manufacturers and authority to submit this resolution to FEMA as confirmation of such approval consistent with FEMA's policies; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to support a request from Fire to FEMA to utilize FEMA grant funds, in the amount of $29,400.00, from the Special Revenue Project titled "UASI Grant Program Fiscal Year 2021" established by Resolution No. R-22-0078, adopted February 24, 2022, for the purchase of two (2) new drones produced by a manufacturer approved by the Department as provided in section 934.50, Florida statutes, to be utilized by Fire to increase situational awareness capabilities at various emergency incidents including acts of terrorism or natural disasters. Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, including amendments, renewals, and extensions, all in forms acceptable to the City Attorney, for the purchase of said drones. Section 4. This Resolution shall become effective immediately upon its adoption.
