AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE
NO. 9534, ADOPTED DECE BER 9, 1982, THE EXISTING CAPITAL
IMPROVEMENT APPROPRIATIONS ORDINANCE, AS AMENDED; BY
REDUCING ITEM III.B.3. FIRE APPARATUS ACQUISITION,
REPLACMM AND MODIFICATIONS, BY AN AMOUNT' OF $125,000,
AND TRANSFERRING SAID AMOUNT TO ITEM XVII.D.3. EXPANSION
OF FIRE ALARM OFFICE; CONTAINING A REPEALER PROVISION
AND SE'VERABILITY CLAUSE.

WHEREAS, the City Commission adopted Ordinance No. 9534 on December 9, 1982,
establishing resources and appropriations for the implementation of Capital Improve-
ments in the City of Miami, Florida; and
WHEREAS, the Department of Fire, Rescue and Inspection Services finds it
necessary to transfer funds from the Fire Apparatus Acquisition, Replacements and
modifications Capital Project in the amount of $125,000, said funds being from the
1981 Firefighting, Fire Prevention and Rescue Facilities General Obligation Bond
Funds, and to increase funding of the Expansion of Fire Alarm Office Capital
Project in the amount of $125,000, to cover anticipated contractual, project, and
incidental expenses; and
WHEREAS, the following Ordinances and Resolutions of the City of Miami
speak to the holding of election, issuance, passage, and subsequent revisions to
maturities of 1981 Firefighting, Fire Prevention and Rescue Facilities Bonds:
Resolution No. 81-729, Ordinance No. 9295, Ordinance No. 9296, Resolution
No. 81-776, Resolution No. 81-1020, Ordinance No. 9406, Resolution No. 82-304;
and
WHEREAS, the projects identified in the 1981 Firefighting, Fire Prevention
and Rescue Facilities Bond were approved by referendum, appropriated by the City
Commission and the referendum has been validated through the court system,
meeting all legal prerequisites; and
WHEREAS, the passage of this Ordinance is considered to be an emergency
measure on the grounds of urgent public need for the preservation of peace, health,
safety, and property of the City of Miami, and upon the further ground of the
necessity to appropriate sufficient funds for the expansion of the Fire Alarm
Office so that a construction contract may be awarded, as required;
NOW, 'ARE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FI ORIDA:
Section 1. Section 1 of Ordinance No. 9534, adopted December 9, 1982, is hereby
amended in the following particulars:.!/
"Section 1. The following appropriations hereby made by fund and
project title include previously authorized projects and fund appro-
priations for implementation of all municipal capital improvements
of the City of Miami, Florida. The source of revenues to support

Section 2. All ordinances or parts of ordinances insofar as they are

inconsistent or in conflict with provisions of this ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph, clause, phrase or
word of this ordinance is declared invalid, the remaining provisions of this
ordinance shall not be affected.
Section 4. This ordinance is hereby declared to be an emergency measure on
the grounds of urgent public need for the preservation of peace, health, safety, and
property of the City of Miami, and upon the further ground of the necessity to appro-
priate sufficient funds for the expansion of the Fire Alarm Office so that a
construction contract may be awarded, as required.
Section 5. The requirement of reading this ordinance on two separate days is
hereby dispensed with by a vote of not less than four -fifths of the members of the
Commission.

It is recommended that the attached energency
Ordinance amending the existing Capital Im-
provement Appropriations Ordinance, as amended,

It is necessary to provide additional funding in the amount of $125,000 to
cover award of a construction contract and other project and incidental
expenses associated with the expansion of the Fire Alarm Office in the
Department of Fire, Rescue and Inspection Services Department.
In conjunction with conversion and upgrading the Department's Radio and
Cammications System to 800 MHz, the physical expansion of the Fire Alarm
Office to almost twice its current size is required. This will also neces-
sitate relocation of Fire Prevention Bureau offices from the fifth to the
second floor of the City Administration Building, as well as construction
Of an improved City conference room on the ground floor.
Current funding of the capital project is from 1981 Firefighting, Fire
Prevention and Rescue Facilities Bond Fund in the amount of $210,000 and
will be augmented by transfer of $125,000 in surplus funding in the Fire
Apparatus Acquisition, Replacements and Modifications Project.
