A 7 0 0 AN ORDINANCE AMENDING SECTIONS 1 and 6 OF ORDINANCE NO. 9502, ADOPTED SEPTEMBER 23, 1982, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1983, AS AMENDED, BY INCREASING THE APPROPRIATION FOR THE ENTERPRISE FUND IN THE AMOUNT OF $669 487 FOR ORANGE BOWL STADIUM, AND BY INCREASING ENTERPRISE FUND REVENUE IN THE SAME AMOUNT FROM ADDITIONAL REVENUES EARNED IN FISCAL YEAR 1982-83 FOR THE PURPOSE OF PURCHASING 75 TURNSTILES FOR INSTALLATION BEFORE THE FIRST 1983 SEASON FOOTBALL GAME; PROVIDING THAT THE CITY BE REIMBURSED FROM THE DADE COUNTY RESORT TAX FOR THE PURCHASE OF SAID TURNSTILES; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9502 on September 23, 1982, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1983; and WHEREAS, the existing Orange Bowl Stadium turnstiles are over 25 years old and have been malfunctioning and have been a maintenance problem; and WHEREAS, accurate attendance measurements are required by Orange Bowl Stadium users and tenants; and WHEREAS, Orange Bowl Stadium revenues through the end of Fiscal Year 1982-83 are projected to exceed Orange Bowl adopted revenues by over $190,000 primarily due to the N.F.L. Playoff games and to the proceeds from the insurance policy the City purchased before the 1982 N.F.L. season; and WHEREAS, funds in the amount of $66,487 from these additional revenues generated by the Orange Bowl Stadium during Fiscal Year 1982-83 are available and can be allocated for the aforementioned purpose; and WHEREAS, bids have been received for furnishing 75 turnstiles For the Orange Bowl Stadium at a cost - of s $66,487.50; and WHEREAS, the Board of County Commissioners passed Resolution 707-83 on June 7, 1983, which approved the expenditure of Fiscal Year 1982-83 Resort Tax Funds to reimburse the City of Miami for the purchase of said turnstiles; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 1 and 6 of Ordinance No. 95029 adopted September 239 1982, the Annual Appropriations Ordinance for the Fiscal Year ending September 30, 1983, as amended, is hereby further amended in the following particulars:) "Section 1. The revenue needed to accomplish the aforementioned is derived from additional revenues earned by the Orange Bowl Stadium in Fiscal Year 1982-83 in excess of adopted revenues. Section 3. All ordinances or parts of ordinances in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Ordinance amending the Annual Appropriations Ordinance for purchase of turnstiles REFERENCES: ENCIOSURESI) Copy of Draft Legislation 2)Copy of Law Dept. cover memo The Office of Stadiums recommends the adoption of an emergency ordinance to amend the Annual Appropriations Ordinance by increasing the Enterprise Fund, Orange Bowl Stadium appropriation in the amount of $66,487 for the purpose of purchasing seventy-five (75) turnstiles for instal- lation before the first Dolphin football game on August 13, 1983. Enterprise Fund revenue will be increased in the same amount from additional revenues earned in Fiscal Year 1982-83. The existing Orange Bowl Stadium turnstiles have been in service for over 25 years. These units have reached the point where they are constantly malfunctioning and are becoming a maintenance problem. Furthermore, new turnstiles are needed to give the accurate atten- dance measurement required by Orange Bowl Stadium users and tenants. A companion resolution has been prepared to accept the bid of the Tomsed Corporation for furnishing seventy-five (75) turnstiles for the Orange Bowl Stadium at a cost of $66,487.50. The Orange Bowl Stadium is projected to have Fiscal Year 1982-83 revenues in excess of $190,000 over adopted revenues primarily due to the 1982 season N.F.L. Playoff games and to the proceeds expected from the strike insurance policy the City purchased prior to the 1982 N.F.L. season. The appropriation of $66,487 of these excess revenues is requested for purchasing the seventy-five (75) turnstiles for installation before the first Dolphin football games on August 13, 1983. The Board of County Commissioners, acting on the recommendations of the Tourist Development Council, passed Resolution 707-83 on June 7, 1983, which provides for reimbursing the City of Miami from Resort Tax funds for its purchase of seventy-five (75) turnstiles.
