Gary _ DATE City Manager I -Rom Adrienne Macbet "�--- Special Assistant BACKGROUND SUBJEC' August 22, 1983 VILE Minority Procurement Program: RFP for Documentation Study Agenda Item: Sept. 7, 1983 REFERENCES Ordinances 9341 & 9530 Procurement Charter Amendment ENCLOSURES it is recommended that the City Commission adopt a resolution authorizing the City Manager to solicit proposals for a contract with individuals, joint ventures, partnership or firms to produce a report investigating and assessing the extent to which Minority (Hispanic and Black) providers of goods and services have been involved in the City of Miami's procurement from 1973-83. Pursuant to the November 1982 Procurement Charter Amendment which provided for Affirmative Action, Non -Discrimination and Minority Participation in transactions with the City, the City Commission enacted Ordinances 9341 identifying a 20% (10% Black & 10% Hispanic) Minority Procurement Goal and Ordinance 9530 setting aside 50% (Goal of 25% & 25% Black & Hispanic) of the total annual dollar volume of Public Works, Public Facilities and Unified Development Projects for Minority Providers. Recently, amendments to Ordinance 9530 extended the authority to include the dollar value of city property and services related to Public Works, Public Facilities and Unified Development Projects and to include sub -contracts in goal attainment. Both Ordinances are predicated on the undocumented assumption that prior discrimination had prevented equitable contractual or procure- ment opportunities for minorities. In 1983, the U.S. District Court (South Florida Chapter of the Associated General Contractors of America Inc. v. Metro Dade County) held that the County Commission had the authority to determine that blacks had not shared proportionately in the county's economic development and that provided reports were available to the 83-'9361 r Howard V. Gary Page 2 Minority Procurement Proaram Commission which provided the basis for the actions taken, i.e. aoals or set -asides, the Commission could enact a race -conscious policy to remedy the situation. Included in this memorandum is a Request for Proposals to acquire consultant services to produce a report which will provided the documented analysis required to substantiate minority procurement and contracting goals. additionally, this report should provide more accurate indices for establishing realistic goals in the future. Following the receipt and evaluation of proposals, the City Manager will present a recommendation to the City Commission for contract award. 83-~93 f 1 4 CITY nF 10IAMI MINORITY PRnCUREME`1T PROGRAM INVITATION FOR PROPOSALS nFFICF OF THE CITY MANAGER I. INTRODUCTION The City of Miami is requesting proposals from individuals, firms or joint ventures interested in conducting a study of and producing a report documenting the extent Minority (Hispanic and Black) providers of goods and services have been involved in the Citv of Miami's procurement and contracting from the years 1973-1983. II. PURPOSE The proposed study is required to document the extent to which the City's presumption of historical discrimination has resulted in a disproportionate under -representation of Blacks and Hispanics in procurement and to provide findings and conclusions regarding the extent to which the City should develop qoals and programs to reduce the disparity. III. MINORITY PROCUREMENT PROGRAM In 1982 the citizens of Miami supported a procurement Charter Amendment which provided for Affirmative Action, Mon -Discrimination and Minority Participation in City transactions, i.e. purchasing and contracting. Subsequently, the City Commission enacted ordinan- ces 9341 (Minority Vendor Procurement Program) and 9530 (Minority Procurement Program). These programs established goals for procuring 20% from Blacks and Hispanics and set -asides equalling 50% of the total dollar volume of the City's construction projects. Both ordinances were predicated on the undocumented assumption that prior discrimination had prevented equitable procurement or contrac- tual opportunities for minorities. Currently, Ordinance 9530 has undergone amendments which now include the dollar value of city property or services included in construction projects. The City has also initiated procedures for increasing and monitoring minority involvement in purchasing and construction contracts. IV. PROPOSAL SUBMISSION? GUIDELINES Proposals submitted in response to this invitation must include the following: 1. Identificational and background information on the respondent(s) as it relates to investigations of this nature. 83-*9361 2. The respondent's experience and capabilities for conducting such a study. 3. The individuals, firms or joint ventures to be involved in the study, their experience and a descrip- tion of their roles in this project. 4. A Research Outline and a projected timetable for the completion and submission of a final report. 5. An original and one copy of the proposal should be delivered to the Office of the City Manager, 3500 Pan American Drive, Miami, FL 33133 no later than 6. The City of Miami reserves the right to waive any informalities in the proposal submission process and reserves the right to reject all proposals. The City also reserves the right to further negotiate fees, tasks and schedules subsequent to selection of the consultant. 7. The City Manager will appoint a selection committee to review proposals and submit the results of the proposal evaluation process to the Miami City Manager. 8.
