BE IT RESOLVED BY I H E COMMISSION OF THE CITY OF MIAMI,
F L 0 R I D A :
Section 1. By a 4;'5ths affirmative vote of the members
of the City Commission, after a duly advert. ised public
hearing,the following findings are hereby made concerning the
prohibition against appearances by a former city officer,
official or employee before the Commission within 2 years
after leaving city employment as such prohibition may apply
to MARK A. VALENTINE, ESQ., who last served as an Assistant
City Attorney on January 29, 1982 and who has engaged in the
practice of law since that date:
A. That in neither of the matters that are set
forth in Section 2 hereof which are forthcoming before the
City Commission did the former official, MARK A. VALENTINE ,
participate personally or substantially through decision,
approval, disapproval, recommendation, the rendering of
advice, investigation or otherwise.
B. That in neither of the matters that are set
forth in Section 2 hereof which are forthcoming before the
City Commission are there any contracts or business
transactions with the City or any agency acting for the City
involved.

such prohibition may apply to MARK A. VALEN(INE, ESQ., who

and who now seeks to represent clients in the following
matters which are forthcoming before the City Commission, is
hereby waived:
A. A new or amended covenant running with the land
pertaining to property known as Executive Plaza and located
in the area of Northeast 31st Street between Biscayne
Boulevard and Northeast 2nd Avenue, Miami, Florida.
B. A rezoning application pertaining to property
known as Hadley Gardens Subdivision and located in the area
of Northwest 32nd Street and 19th Avenue, Miami, Florida.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the
City of Miami, Florida on Thursday, October 25, 1963, at 2:30
P.M. in the City Commission Chambers at City Hall, 3500 Pan
American Drive, Miami, Florida, for the purpose of
considering a waiver of the prohibition against appearances
by a former city employee before the City Commission within 2
years after leaving city employment as such prohibition
applies to Mark A. Valentine, Esq., who last served as an
Assistant City Attorney on January 29, 1992 and who has
engaged in the practice of law since that date and who now
seeks to represent clients in matters coming before the City
Commission for its consideration.
All interested persons are invited to appear and may be
heard concerning such proposed waiver and purchase. The
hearing will be held at the time and place specified above.
Should any person desire to appeal any decision of the
Citv Commission with respect to any matter considered at this
hearing, that person shall ensure that a verbatim record of
the proceedings is made, including all testimony and evidence
upon which any appeal may be based.

RE: WAIVER OF CONFLICT OF INTEREST OF FORMER CITY EMPLOYEE
Dear Mr. Garv:
As you are aware, Section 2-302 of the Code of the City of Miami
prohibits a former city employee from appearing before the City
Commission of the City of :Miami within a two (2) year period following
his resignation with the Citv of Miami.
On January_ 31, 1982 I resigned for the City of Miami City Attor-
ney's Office. Section 2-304 of the Code of the City of Miami provides
for a waiver of said prohibition pursuant to a four -fifth vote from the
City Commission for the City of Miami.
I am respectfully_ requesting a waiver frcm the City of Miami
and tc have this item placed on the October 13, 1983 Commission Agenda.
it is necessary that the waiver be granted se that I might appear
be=ore the City Commission for the Cit7 of Miami or. October 13, 1983
and several meetings subsequent thereto for purposes of presenting
several zoning applications. The Citv Atternev's Office is in the
process of preparing the necessary resolution to reflect my request.
