THE FINDINGS AND CONCLUSIONS SET FORTH IN
THE PREAMRIE OF THIS RFSOLUTION.
WHEREAS, there exists a contract dated April 28, 1983
between the Cit-y of Miami and tl. Vila and Associates in the
amount of $426,745.26 for the construction of the GARMENT
CENTER COMMUNITY DEVELOPMENT PAVING PROJECT; and
WHEREAS, the contract was increased in the amount of
$22,375 by Resolution No. 83-703 dated July 28, 1983; and
WHEREAS, the City Manaqer has requested that certain
modifications be made to a partially constructed concrete
block wall in the vicinity of N.W. 5 Avenue and 22 Place; and
WHEREAS, the inclusion of this anticipated work in the
project will cost $51,0013 and will require an increase in
contract amount; and
WHEREAS, the City Manaqer has made a written findinq
that a valid emerrlency need exists for the additional work to
he done at this time; and
WHEREAS, the Director of the Department of Community
Development has provided written confirmation that Community
Development Funds are available for the herein increase;

The Department of Public Works recommends
a resolution authorizing, by an affirmative
vote of 4/5ths of the members of the City
Commission, after a duly advertised public
hearing, an increase in the contract amount
of $51,000 in the contract between The City
of Miami and M. Vila and Associates, Inc.,
dated January 28, 1983, for the construction
of the Garment Center Community Development
Paving Project with funds therefor allocated
from Community Development Paving Project
Funds; further ratifying the City Manager's
written finding that the herein increase
resulted from emergency circumstances, and
adopting the findings and conclusions set
forth in the preamble of this resolution.
There exists a contract between the City of Miami and M. Vila and
Associates, Inc., in the amount of $426,745.26 for the construction
of the Garment Center Community Development Paving Project. The
contract has already been increased once by $22,375 to cover the
additional cost of enlarging water :rains and providing services
to serve the parcels of private property that the City intends to
develop as an industrial nark.
The original contract called for the construction of a 5-foot high
concrete block wall around the parcels mentioned above, and con-
struction of the wall was begun by the contractor, but halted by
the City Manager when he objected to the aesthetic aspects of it.
Since, we have prapared an alternate plan for the .,all calling
-or it to be constructed with a combination of concrete block and
steel picket fence, the additional cost to make the modifications
is $51,000, and will require an increase in contract amount for
us to include it in the .vcrk.

The contractor has finished all other work on the project, and
the completion of the wall is the only item of work remaining.
To expedite the completion of the project, and for the conveni-
ence of the residents within the district, the City :tanager has
found that the additional work required is of an emergency nature,
and has prepared the necessary written finding stating so, and
it will ask, after a public hearing, for a four -fifths affirma-
tive vote of the Commission to ratify his action.
The Director of the Department of Community Development has con-
firmed in writing that Community Development Funds are available
to cover the increase in contract amount requested.

Emergency Need for Increase
in Contract Amount
REFERENCES
ENCLOSURES.
Based on information supplied to me by the Director of Public
Works, I have found that there exists an emergency need for
an increase in contract amount of $51,000 in the contract
between the City of Miami and M. Vila and Associates, Inc.,
for the construction of Garment Center Community Development
Paving Project.
The reason for the emergency need is as follows:
A partially completed concrete block wall around
parcels being developed by the City requires
modifications that will cause an increase in
contract. Failure to make the modifications
under the current contract would result in a
costly delay in completion of the overall
project and leave the area in an unsightly
condition and the wall open to vandalism while
we followed competitive bidding procedures for
a contract to complete the work.

I am sending you the paperwork (resolution, cover memorandum,
and written finding) for increases in contract on the Garment
Center C.D. Paving Project for $51,000.
You will recall that we have received a quotation from the
contractor for modifications to the concrete block wall for
2 feet of masonry wall and 5 feet of steel picket that will
cost $51,000.
Also, attached is a memorandum from you to the City Clerk
authorizing rim to advertise for a public hearing to be held
at the October 13th Commission meeting. A suggested text of
the advertisement is attached to the memorandum.
If we are to get this increase on the October 13th Commission
meeting, we ;rust have your approval by Wednesday, September 28,
so that the paperwork can be distributed.
