AN ORDINANCE AMENDING THE TEXT OF ORDINANCE
NO. 9500, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, BY AMENDING SUBSECTIONS
1523.2, 1523.3, 1526.2.1 and 1526.2.2 OF
SECTION 1520 ENTITLED 11SPI-2: COCONUT GROVE
CENTRAL COMMERCIAL DISTRICT," OF ARTICLE 15
ENTITLED "SPI: SPECIAL PUBLIC INTEREST
DISTRICTS," BY PROVIDING DRIVE-IN FACILITIES
FOR FINANCIAL INSTITUTIONS, DELETING REFER-
ENCES TO PEDESTRIAN STREETS, AND INCREASING
THE FLOOR AREA RATIO FOR RESIDENTIAL,
NON-RESIDENTIAL AND MIXED -USED BUILDINGS;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the Miami Planning Advisory Board at its meeting of
June 11 1983, Item No. 3, following an advertised hearing,
adopted Resolution No. PAB 54-83, by a 5 to 0 vote, RECOMMENDING
APPROVAL, of amending Ordinance No. 9500, as hereinafter set
forth; and
WHEREAS, the City Commission, after consideration of this
matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
these amendments, as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Ordinance No. 9500, the Zoning Ordinance of
the City of Miami, Florida, is hereby amended by amending the
text of said ordinance as followsl
"ARTICLE 15. SPI: SPECIAL PUBLIC INTEREST DISTRICTS
General Provisions
SECTION 1520. SPI-2: COCONUT GROVE CENTRAL
COMMERCIAL DISTRICT.

Words and/or figures stricken through shall be deleted. Under-
scored words and/or figures shall be added. The remaining
provisions are now in effect and remain unchanged. Asterisks
indicate omitted and unchanged material.

Permissible

1523.2. Principal Uses Permissible at other
locations; Restrictions on Location
on Ground Floor Frontage of
Pedestrian Streets.
In addition to all uses permissible on ground

floor frontage of pedestrian streets, the following
shall be permitted, either above or behind establish-
ments developed with such frontage, or elsewhere within
the district, but not within such ground floor frontage
except as provided at Section 1523.3, below.
1. As for RG-3 for uses permitted or permissible
therein, provided that:
a. In this district, regardless of special
permits required in RG-3, all uses
require Class C permits unless otherwise
specifically provided.
b. In buildings containing combinations of
residential and office uses, limitations
as to proportion of office to total
floor area shall not apply.
2. Offices, business or professional; travel
agencies; clinics; studios; laboratories.
3. Banks, saving and loan associations, and
similar financial institutions. , including
drive-in facilities.
1523.3. Special Rules Concerning Extent and
Location of Certain Uses On Ground
Floor Frontage of Pedestrian
Streets.
The following rules shall
apply
concerning
extent
and location of the following
uses
on ground
floor

frontage of pedestrian streets:
1. On corner lots adjoining pedestrian streets
on two exposures, limitations as to the uses
permitted on ground floor frontage shall
apply to both exposures of such lots.
2. Where the frontage of a lot on a pedestrian
street is occupied at the ground floor level
by uses permissible under the limitations of
Section 1523.1 for at least 65% of lot width,
the remaining frontage may be occupied as
entrances inside or outside buildings to uses
above or behind those on the ground floor
frontage, or as driveways or walkways
providing access to uses or parking or
service areas behind the pedestrian
frontage.

SECTION 1526. MINIMUM LOT REQUIREMENTS: FLOOR

Except as modified by Section 1526.2.2. below:
1. The maximum floor area ratio for residential
or non residential use in a building shall
not exceed :45 .86 times gross lot area.

1526.2.2. Allowable Increase in Floor Area for
Buildings Providing Certain Supporting
Uses; Limitations.
The floor area and/or floor area ratio shall be
increased in conformance with the following provisions
and limitations:
1. Underground and/or Enclosed Parking: For
each 10 percent of required onsite parking
provided in an underground parking structure
(the roof of the underground structure shall
not exceed 3.5 feet above adjacent public
_ sidewalks) or in an enclosed above grade
parking structure (with autombiles screened
from view) the floor area ratio shall be
increased .015 times gross lot area.
4. _Split Level .Uses at General Level: For each
ten (10) lineal feet of ground leveluses
permissible under Section 1523.1, where by
reason of a vertical split level arrangement

of uses (above and below ground level),
directly accessible and visible from the
adjacent public sidewalk, the floor area
ratio shall be increased by .025 times the
gross lot area not to exceed a total of .30.

Section 2. All ordinances, Code Sections, or parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 3. Should any part or provision of this
Ordinance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.

The Planning Advisory Board, at its meeting of June 1, 1983, Item 3, following an'
advertised hearing, adopted Resolution PAB 54-83 by a 5 to 0 vote, recommending
approval of amendments to the text -of Zoning Ordinance 9500, Article 15 SPECIAL
PUBLIC INTEREST DISTRICTS, Section 1520 SPI-2 COCONUT GROVE CENTRAL COMMERCIAL
DISTRICT, Subsection 1523.2 -Principal Uses Permissible at Other Locations, restric-
tions on location on ground floor frontage of pedestrian streets, paragraph 3 to
include drive-in facilities and adding a new paragraph 6 to include mortuaries or
funeral homes; subsection 1523.3 Special Rules Concerning Extent and Locations
of Certain Uses on Ground Floor Frontage of Pedestrian Streets by deleting paragraph
3 concerning pedestrian streets in its entirety; Section 1526:2.1 Floor Area Limi-
tations for Residential or Non-residential Buildings to increase the permitted floor area ratio from .75 to .86; Section 1526.2.2 Floor Area Limitations for Mrlixed
Use Buildings providing certain supporting uses; limitations by deleting paragraph.-
1 and substituting in lieu thereof a new paragraph 1 to increase the permitted floor
area ratio from 1.06 to 1.21 and by adding a new paragraph 5 to provide a floor

hensive Zoning Ordinance 6871 to the new Zoning Ordinance 9500,'
as amendments to the SPI-2 zoning district.
Ordinance 9361; December 15, 1981, adopted certain changes to. '.
the, C-2A zoning district in the Coconut Grove Village Center,
as amendments to Comprehensive Zoning Ordinance 6871. The C-2A
zoning district has carried forward as SPI-2 in new Zoning.'. -
..;Ordinance 9500. This amendment to Zoning Ordinance 9500 adds
to SPI-2 the changes previously adopted (Ordinance 9361).”
