ORDINANCE NO. 9734
AN ORDINANCE AMENDING THE TEXT OF ORDINANCE
NO. 9500, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, BY AMENDING ARTICLE 16 OF
SAID ORDINANCE ENTITLED "HC: HERITAGE
CONSERVATION DISTRICTS;" MORE PARTICULARLY BY
ADDING A NEW SECTION 1613 ENTITLED "HC-4:
COMMERCIAL AREA HERITAGE CONSERVATION
OVERLAY DISTRICT; PROVIDING FOR INTENT,
EFFECT, LOT REQUIREMENTS, FLOOR AREA
LIMITATIONS, MINIMUM OPEN SPACE REQUIREMENTS,
HEIGHT, OFF-STREET PARKING, TRANSFER OF
DEVELOPMENT RIGHTS, AND CERTIFICATES OF
APPROPRIATENESS; AND BY MAKING ALL THE
NECESSARY CHANGES IN THE ZONING ATLAS MADE A
PART OF SAID ORDINANCE NO. 9500, BY REFERENCE
AND DESCRIPTION IN ARTICLE 3, SECTION 300,
THEREOF; CONTAINING A REPEALER PROVISION AND
A SEVERABILITY CLAUSE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of June 22, 1983, Item 20, following an advertised hearing,
adopted Resolution No. PAB 76-83 by a 7 to 0 vote, RECOMMENDING
APPROVAL of an amendment to Ordinance No. 9500; and
WHEREAS, the City Commission after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this amendment, as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The text of Ordinance No. 9500, the Zoning
Ordinance of the City of Miami, Florida, is hereby amended by
amending Article 16 of said Ordinance entitled "HC: HERITAGE
CONSERVATION DISTRICTS;" more particularly by adding a new
SECTION 1613 ENTITLED "HC-4: COMMERCIAL AREA HERITAGE CONSERVA-
TION OVERLAY DISTRICT," to read as follows:l
"ARTICLE 16. HC: HERITAGE CONSERVATION DISTRICTS
SECTION 1612. HC-3: RESIDENTIAL - OFFICE HERITAGE
CONSERVATION OVERLAY DISTRICT.
1 Words and/or figures stricken through shall be deleted. Under-
scored words and/or figures shall be added. The remaining
provisions are now in effect and remain unchanged. Asterisks
indicate omitted and unchanged material.

SECTION 1613. HC-4: COMMERCIAL AREA HERITAGE
CONSERVATION OVERLAY DISTRICT.
1613.1. INTENT.
This overlay district is intended to carryout the
intent and purposes of HERITAGE CONSERVATION ZONING
DISTRICTS as set forth in Section 1600. It is to be
applied to historic sites or historic districts located
within office or commercial zoning districts where it
is appropriate to encourage preservation of historic
structures by providing for construction of additional
new -development on the site or elsewhere within the
underlying zoning district.
1613.2. EFFECT OF HC-4 OVERLAY.
The HC-4 Overlay district shall have the effect of
modifying requirements and procedures applying in
existing zoning districts indicated in the Official
Zoning Atlas, or zoning districts hereafter created and
remaining after the HC-4 overlay district is super-
imposed, to the extent provided herein. All zoning
requirements, regulations, and procedures not speci-
fically modified by the HC-4 overlay shall remain in
full force and effect.
1613.3. REGULATIONS CONCERNING MAXIMUM FLOOR AREA.
The maximum floor area ratio shall be as set forth
in the underlying zoning district, except that where a
structure or portion of a structure of historic
sig nificance, as ideptified in the designation report,
is pre served as a part of an overall development plan
the Heritage Conservation Board may approve one of the
following through a Certificate of Appropriateness:
a. the existing floor area of the subject
historic structure shall be exempted from

calculation of maximum floor area for the
lot, provided that the exempted floor area
shall not exceed 20% of the maximum allowable
floor area; or
b. the maximum floor area ratio may be increased
b .25 FAR; or
ce the maximum floor area ratio may be increased
by 10_percent.
Wherever a floor area ratio bonus for preservation of
an historic structure has been_ provided within an
underlying zoning district, the provisions of this
section shall govern; and the bonuses shall not be
cumulative.
1613.4. REGULATIONS CONCERNING MINIMUM LOT REQUIRE-
MENTS, MINIMUM OPEN SPACE, MAXIMUM HEIGHT,
OFF-STREET PARKING.
1613.4.1. Regulations Concerning Historic Structures.
Any structure of historic significance,, as defined
in the designation report,..shall be permitted to be
repaired, restored,' structurally altered, or changed to
any use permitted within this district; notwithstanding
any conflicts with provisions of the underlying zoning
district pertaining to minimum lot requirements,
minimum open space, minimum yards, building spacing, or

landscaping, maximum height and off-street parking;
subject to a Certificate of Appropriateness as provided
in Section 1613.5. New or existing accessory struc-
tures, excluding new buildings, shall likewise be
permitted where necessary to serve existing historic
structures, subject to a Certificate of Appropriate-
ness. Subject to the standards for a Certificate of
Appropriateness in Section ,1613.5, existing historic

structures may be exempted from off-street parking
requirements where the size and configuration of the
site doesnot permit on -site parking consistent with
the historic character and integrity of the site.
1613.4.2. Regulations Concerning Additions and New
Buildings.
Additions to existing buildings and erection of
new buildings shall generally be subject to the
provisions of the underlying zoning district; however,
in cases where the configuration of an historic
structure precludes reasonable and appropriate use of
the property within the underlying_ zoning_ district
envelope, and a greater public purpose would be served
by modifying such regulations in order to permit
appropriate preservation of a historic structure, then
a _Special Certificate of Appropriateness may authorize
the following, subject to the standards in Section
1613.5:
a. a deviation of up to 20% from the underlying
,zoning district requirements for minimum lot
size, minimum open space, minimum yard area,
maximum height and landscaping; and
b. an exemption from all building spacing
requirements.
1613.5. CERTIFICATES OF APPROPRIATENESS.
1613.5.1. Certificates of Appropriateness Required;
Speciar- t+anc3ards.
All applic9able actions within the HC-4 overlay
district shall be subject to the requirements, proce-
dures, and guidelines for Certificates of Approl2riate-
ness, as set forth in Section 1605. In addition to the
guidelines set forth in Section 1605.3, the following
standards shall be observed in issuing Certificates of
Appropriateness within this district;
1. The project shall not cause undue negative
impacts on the surrounding area in terms of

compatibility with adjacent land uses,
vehicular ingress and egress, pedestrian
safety and convenience, parking, public
utilities and services, scale, lighting,

noise, or other potentially adverse impacts
on adjacent residential areas;
2. The location and arrangement of parking and
access drives shall be compatible with
special historic integrity and visual
character of the structure(s); and the
spacing and dimensions of such parking and
access drives shall provide at least minimum
safety standards for compact automobiles;
3. Parking and service areas shall be adequately
screened from view. of adjacent properties;
4. All signs, lighting fixtures, landscaping and
other appurtenant elements shall be suitable
for the historic character of the site and
compatible with the surrounding area; and
5. All plans shall be in accord with the intent
and Eurpose of this district and to the
benefit of the general public.
1613.5.2. Special Regulations Concerning Demolition.
In cases where a property owner has voluntarily
elected to utilize provisions in Sections 1613.3,
1613.4", or 2014 to increase total floor area, increase
the zoning envelope,_decrease parking requirements, or

any other such benefit available in consideration of
preserving a historic structure; then the Heritage
Conservation Board shall have the authority to deny a
Certificate of Appropriateness for demolition of the
subject historic structure ynder the provisions of

Section 1605.3.2-1, if the Board finds that structures
and improvements remaining_ after the proposed
demolition would continue to benefit from the
provisions of the HC-4 overlay."
Section 2. The Zoning Atlas made a part of said
Ordinance No. 9500, by reference and description in Article 3,
Section 300, thereof, is hereby amended to reflect any changes
made necessary by the amendments.
Section 3. That all ordinances, code sections or parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 4. Should any part or provision of this ordi-
nance be declared by a court of competent jurisdiction to be
invalid',='the same shall not affect the validity of the ordinance
as a whole.

Create a new'HC-4•overlay district which can be applied generally--
.throughout the City to historic sites in commercial and office
zoning districts.
BACKGROUND
Both HC-2 and HC-3 offer a change of use from residential to
office as the primary incentive for preservation of historic
structures. In office and commercial zoning districts, a change
of use is not relevant, and another type of incentive must be
employed. In this case it is primarily a bonus in the amount
of floor area that could be built on the site. (This assumes
-that new construction is desirable in addition to preservation
of the historic structure.)
ANALYSIS
The HC-4 overlay would contain the following provisions:

-- exempt the historic structure from calculation of maximum
-floor area or give a FAR .25 boiius or give a 10 percent increase
in floor area (whichever is greater F
-- exempt the historic structure from minimum lot area, minimum
-open space, building spacing, maximum height, and offstreet
parking requirements
-- for construction of new buildings and additions, allow the
HC Board to modify requirements for minimum lot area, minimum
open space, and maximum hei.gr.t up to 20% from the underlying
district requirements and exempt from building spacing require-
ments.
-- gives the HC Board power to deny a demolition request if the
property owner makes use of any benefits ,that would remain
after the demolition,
-- requires a Certificate of Appropriateness. and sets standards
for evaluating undue impacts in the area.
