ORDINANCE NO. 9733
AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, BY APPLYING THE
PEDESTRIAN STREET INDICATION TO 1) THE SOUTH
SIDE OF OAK AVENUE BETWEEN VIRGINIA AND MA RY
STREETS, 2) THE WEST SIDE OF MARY STREET
BETWEEN GRAND AND OAK AVENUES, AND 3) THE
SOUTHEAST SIDE OF MAIN HIGHWAY BETWEEN
MCFARLANE AND THE RS-1 DISTRICT BOUNDARY
LINE, (MORE PARTICULARLY DESCRIBED HEREIN);
AND BY MAKING ALL THE NECESSARY CHANGES ON
PAGE NO. 46 OF SAID ZONING ATLAS MADE A PART
OF ORDINANCE NO. 9500, BY REFERENCE AND
DESCRIPTION IN ARTICLE 31 SECTION 300,
THEREOF; CONTAINING A REPEALER PROVISION AND
A SEVERABILITY CLAUSE.
WHEREAS, the Miami Planning Advisory Board at its meeting of
June 1, 1983, Item No. 4, following an advertised hearing,
adopted Resolution No. PAB 55-83 by a 5 to 0 vote, RECOMMENDING
APPROVAL of applying the PEDESTRIAN STREET INDICATION to subject
property, as hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this application as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
Zoning Ordinance of the City of Miami, Florida, is hereby amended
by applying the PEDESTRIAN STREET INDICATION to 1) the south side
of Oak Avenue between Virginia and Mary Streets, 2) the west
side of Mary Street between Grand and Oak Avenues, and 3) the
southeast side of Main Highway between McFarlane and the RS-1
district boundary line, more particularly described as the street
frontage on Lots l and 24, Block 1, east side, Lots 37-42, Block
3, north side, Lot 25, Lots 43-48, Block 4, north and east sides,
WM. A. RICE SUB (1-13); Lots 9-13, Main Highway side only, C and
I Peacock Amd (B-70), of the public records of Dade County,
Florida, and presently zoned SPI-2 COCONUT GROVE CENTRAL
COMMERCIAL.
Section 2. Further, Page No. 46 of the zoning atlas
incorporated in said Ordinance by reference and description in
Article 3, Section 300 thereof, is hereby amended to reflect the
herein district.
Section 3. All ordinances, code sections or parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 4. Should any part or provision of this ordi-
nance be declared by a Court of competent jurisdiction to be
invalid, the same shall not affect the validity of the Ordinance
as a whole.

REQUEST
To add pe3estrian street indications in the Coconut Grove Village
Center, which were inadvertently omitted from the Official Zoning
Atlas of new Zoning Ordinance 9500.
BACKGROUND
Ordinance 9361; December 15, 1981, adopted certain changes to the
C-2A zoning district in the Coconut Grove Village Center, as
amendments to Comprehensive Zoning Ordinance 6871. The C-2A .
zoning district was carried forward as SPI-2 in new Zoning
Ordinance 9500. This amendment to Zoning Ordinance 9500 adds the
pedestrian street indication which was previously indluded in the
changes to the C-2A zoning district.
