HomeMy WebLinkAboutO-09722J-83-513 ORDINANCE NO. 9 AN ORDINANCE AMENDING ORDINANCE NO. 9500, THE; ZONING ORDINANCE OE' THE CITY OF MIAMI, FLORIDA, BY AMENDING SECTION 610 ENTITLED "LAND USE INTENSITY RATINGS AND RELATED REQUIREMENTS", OF ARTICLE 6 ENTITLED "PD-H: PLANNED DEVELOPMENT -HOUSING DISTRICTS", SECTION 903 ENTITLED "LAND USE INTENSITY RATINGS AND RELATED REQUIREMENTS-, OF ARTICLE 9 ENTITLED "PD-HC: PLANNED DEVELOPMENT -HIGHWAY COMMERCIAL DISTRICTS", BY ADJUSTING RATINGS AND ADDING A NEW SECTOR 9 WITH RATINGS; AMENDING SUBSECTIONS 203.7, 2006.2.1, 2013.6, and 2015.1, BY CLARIFYING LANGUAGE, AND 2008.11 AND 2016.1, TO PROVIDE FOR CLARIFYING LANGUAGE RELATIVE TO DISTRICT BOUNDARIES AND FEDERAL FLOOD CRITERIA RESPECTIVELY, AND SECTION 2200 ENTITLED "INTERPRETATION AND ENFORCEMENT", OF ARTICLE 22 ENTITLED "FUNCTIONS AND RESPONSIBILITIES OF COMMISSION, OFFICERS, AND BOARDS IN RELATION TO ZONING GENERALLY" BY CLARIFYING LANGUAGE RELATIVE TO INTERPRETATION AND ENFORCEMENT OF THE ZONING ORDINANCE; FURTHER, AMENDING PAGE 2 OF THE "OFFICIAL SCHEDULE OF DISTRICT REGULATIONS" MADE A PART OF SAID ORDINANCE NO. 9500 BY REFERE14CE AND DES- CRIPTION IN ARTICLE 3, SECTION 320, THEREOF, BY INCLUDING THE RG-2.3 (GENERAL -RESIDENTIAL TRANSIT) DISTRICT UNDER THE "LIMITATIONS ON SIGNS" COLUMN AND THE RG-3 (GENERAL RESI- DENTIAL) DISTRICT UNDER THE "MINIMUM OFF- STREET PARKING REQUIREMENTS", AND INCREASING THE PLANE III HEIGHT ENVELOPE OF TABLE 2; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Miami Planning Advisory Board at its meeting of June 1, 1983, Item No. 8, following an advertised hearing, adopted Resolution No. PAB-59-83, by a 5 to 0 vote, RECOMMENDING APPROVAL, with a modifications, of amending Ordinance No. 9500, as amended, as hereinafter set forth; and WHEREAS, the City Commission, after consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to qrant these amendments, as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 9500, the Zoninq Ordinance of the City of Miami, Florida,, is hereby amended as follows: 1 "ARTICLE 6. PD-H PLANNED DEVELOPMENT -HOUSING DISTRICTS * SECTION 610. The f ollowinq requirements and limitations apply to uses in PD-HC districts hereafter created in land use intensity sectors indicated on the Land Use Intensity Sector Map established under the provisions of Section 300.1. GENERAL AND SUPPLEMENTARY REGULATIONS. SECTION 2003. ACCESSORY USES AND STRUCTURES. -3- 2003.7. Convenience Establishments As Accessory to ,3 ' Residential or Office Uses. In RG-2.2 RG-3 RS-#-� -RO3 and , 0-1 districts, convenience establishments shall be permitted as accessory to residential or office uses subject to the following requirements and limita-tions: SECTION 2006. REGULAR LOTS. 2006.2. Regular Lot, Area. 2006.2.1. Regular Lot, Net Area. Net area of a regular lot shall be construed as total area within its property lines. prior to any required dedication(s). SECTION 2008. REQUIRED YARDS AND OTHER REQUIRED OPEN SPACES; DETAILED LIMITATIONS ON OCCUPANCY. 2008.11. Yard Where District Boundaries Divide Lots. Where district boundaries divide lots and it is proposed to build across such boundaries, omission of vards adjacent to such boundaries may be authorized only by Class C special permit. SECTION 2013. OPEN SPACE AND BUILDING SPACING. 2013.6. Height in Stories; How Measured. Height in stories shall be computed as actual number of stories in the wall above ground level with the following exceptions. Where the wall is along a slope, number of stories shall be construed as the arithmetic mean number, with half a story or more considered as a full story, and less than half a ..# i is story ignored in computations. When height per story exceeds an average of thirteen (13) eleven-fll} feet, calculations involved in yard or spacing determinations shall be based on an assumed IE j number of stores derived by dividing building height by eleven (11) ten-++9} feet. Penthouses, roof shelters, and housing for mechanical equipment shall be ignored in computations involving number of stories except where they are visible from the ground level within the lot or the building site within a PD-11 District, are eleven (11) ten-fle+ feet or more in height, and occupy fifty percent (50%) or more of the length of the wall at their bases, in which case an additional story shall be included in compu- tations. SECTION 2015. HEIGHT REGULATION, GENERALLY. 2015.1. Excluded Portions of Structures. Except as specifically provided herein, the height limita- tions of this ordinance shall not apply to any pentheuses-er roof structures for housing elevators, stairways, tanks, ventilating fans, solar energy collectors, or similar equipment required to operate and maintain the building, (provided that such structures shall not cover more then twenty-five percent (25%) twenty percent +204+ of roof area), nor to church spires, steeples, belfries, cupolas, domes, monuments, water towers, skylights, flag poles, vents, or similar structures, which may be erected above the height limit, nor to fire or parapet walls, provided however that such walls shall not extend more than five (5) feet above the roof. Generally. To provide a plan from which heights over the buildable area shall be measured, establish the base plane (Plane I). Where the ground surface is regular and horizontal, it shall be considered the base plane. Where the ground surface is irregular or sloping, a base plane shall be constructed parallel to its general surface and elevations shall be measured from such plane, using the methods set forth in Planning Advisory Service Report 237, Height Regulation in Residential Districts, of the American Society of Planning Officials. 2016.1.2. Exception for Federal Flood Criteria. Where construction on lots or portions of lots is affected by Federal Flood Criteria elevations, base plan I shall be construed as beginning at the same elevation as the Federal Flood Criteria elevation.
