AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, BY CHANGING THE
ZONING CLASSIFICATION OF APPROXIMATELY 3500
NORTHWEST 22ND AVENUE, MIAMI, FLORIDA, (MORE
PARTICULARLY DESCRIBED HEREIN) FROM RG-2/4
GENERAL RESIDENTIAL TO CG-1/7 GENERAL
COMMERCIAL; MAKING FINDINGS; AND BY MAKING
ALL THE NECESSARY CHANGES ON PAGE NO. 19 OF
SAID ZONING ATLAS MADE A PART OF ORDINANCE
NO. 95001 BY REFERENCE AND DESCRIPTION IN
ARTICLE 3, SECTION 300, THEREOF; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of June 22, 1983, Item No. 5, following an advertised hearing,
adopted Resolution No. PAB 81-83, by a 7 to 0 vote, RECOMMENDING
APPROVAL of a change of zoning classification, as hereinafter set
forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
71 general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 3500
Northwest 22nd Avenue, Miami, Florida, more particularly
described as, Lots 25, 26 and 27, Block 1, HOLLEMAN MANOR
(10-30), of the Public Records of Dade County, Florida, from
RG-2/4 GENERAL RESIDENTIAL to CG-1/7 GENERAL COMMERCIAL.
Section 2. It is hereby found that this zoning classi-
fication change:
(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) Is not contrary to the established land use patterns
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) Is not out of scale with the needs of the neighborhood
or the City;

(e) Would not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) Is necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;

(h) Will not create or excessively increase traffic
{; congestion or otherwise affect public safety;
(i) Will not create a drainage problem;

(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or develop-
ment of adjacent property in accord with existing
regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare;
Section 3. Page No. 19 of the Zoning Atlas, made a part
of Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this Ordi-
nance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.

REQUEST: To translate a previously -approved change of zoning
in Comprehensive Zoning Ordinance 6871 into a similar
classification in new Zoning Ordinance 9500.
BACKGROUND: Ordinance 9492; September 23, 1982 changed the zon-
ing classification of the subject property from R-3
LOW DENSITY MULTIPIrE DWELLING to C-4 GENERAL COMMER-
CIAL as an amendment to Comprehensive Zoning Ordinance
6871. To translate this zoning change into a similar.
classification in new Zoning Ordinance 9500 requires
specific legislation and public hearings on the advice
of the Law Department.

WHEREAS, the Miami Zoning Board, at its meeting of
June 21, 1982, Item 6, following an advertised hearing, adopted
Resolution No. ZB 104-82 by a 4 to 3 vote, RECOMMENDING DENIAL
of a change of zoning classification, as hereinafter set forth;
and
WHEREAS, the City Commission notwithstanding the denial
of the Zoning Board finds that the use will not be detrimental
or.injurious to the character of the development of the immediate

neighborhood;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No.6871, as amended, the Compre-

hensive Zoning Ordinance of the City of Miami, be and the same
is hereby `amended by changing the zoning classification of Lots
V_
25, 26 and 27, Block 1; HOLLEMAN MANOR (10-30) SUBDIVISION;
being approximately 3500 Northwest 22nd Avenue, from R-3 (Low
Density Dwelling) to C-4 (General Conmercial), and by making all
the necessary changes in the Zoning District Map made a part of
said Ordinance No. 6871 by reference and description in Article
III, Section 2, thereof.

1982, by Roga Enterprises, Inc., a Florida crrp.;ration, Galma
Limited, Inc., a Florida corporation, James S. Feigenbaum and -
Shirley G. Feigenbaum (collectively, the "Declarant").
WITNESSETH:
RECITALS:
A. The Declarant is the owner of certain real ro ert

A attached hereto and made a part hereof (the "Property").
H.' In order to obtain necessary governmental approvals .
for the development of the Property by McDonalds Corporation
d/b/a McDonalds, a Delaware company, pursuant to a certain
Ground Lease (the "Ground Lease"),, dated
1981 , by and between Roga Enterprises, Inc.. Galma Limited,-,
Inc., Isadore Lechtman, and Abe Feigenbaum, tenants in common,
and McDonalds Corporation, d/b/a McDonalds..,--a Delaware company,
the City of Miami, Florida has requested that, during the term
xm-earlier termination of said Ground Lease, the Property not
be divided into separate parcels for purposes of sale to
individuals or entities other than the Declarant.
NOW, TVXREFORE, in consideration of Ten Dollars ($10.00)
and other good and valuable consideration, the receipt -and
sufficiency of which is hereby acknowledged, the Declarant
hereby agrees as follows:
1. YFor the term (including option terms) or ..earlier
termination of the Ground Lease (the "Lease Term"), the Property
shall be considered as one parcel of property and no portion
of the Property shall be sold, transferred, diviseq or assigned
separately, provided, however, that notwithstanding the foregoing,
the Property may be sold, transferred, devised or assigned

2. The Declarant further agrees •that the restrictions
contained in paragraph 1 hereof shall be deemed a covenant
running with the land and shall remain in full force and effect
and be binding upon the Declarant, its heirs, personal
representatives, executors, successors and assigns for the
duration of the Lease Term or until such earlier date as the
Declarant may be released from the terms hereof by an appropriate
official of the City of Miami Fire, Rescue and inspection Services
Department or successor department or agency.
3. Notwithstanding anything to the contrary contained '
in this Unity of Title, the restrictions agreed to in paragraph
1 hereof shall immediately P terminate upon the removal condemnation
or substantial damage or destruction to the restaurant facility
to be constructed by McDonalds Corporation on the Property
pursuant to the terms•of the.Ground Lease.

PREVIOUS DEED OF RESTRICTION
WHEREAS, McDONIALD'S CORPORATION d/b/a McDONALD'S
CORPORATION, a Delaware Company, has previously filed with
the City of Miami, a Deed of Restriction containing
restrictions concerning that certain land situated in the
City of Miami, Dade County, Florida, and known and designated
as:
Lots 25, 26, 27, Block 1,
HOLLEMAN MANOR, according to
the Plat thereof as Recorded
in Plat Book 10 at Page 30 of
the Public Records of Dade
County, Florida.
WHEREAS, McDONALD'S CORPORATION desires to add an
additional restriction to said Deed of Restrictions,. and
NOW THEREFORE, there is created, dectlared and:_
established in regard to the above described real property,
the following additional restrictive covenant, reservation and
restriction which will run with the land and remain in full l
force and effect from the date of this Deed of Restriction
until amended or released by action of the City Commission of

Dear Mr. Pedrosa:
_._above -referenced piece of real property came before the
`-`"City-Cc mmission of the City of N.iami at its July 29th meeting.
The Commission, 'at the aforenoted meeting, accepted my client's
proposal that the subject property be limited in its use by
the creation of certain restrictive covenants. Enclosed herein
you will find a proposed Deed of Restrictions to fulfill the
intent as expressed'at the July 29th meeting.
The instant Deed sets forth three basic restrictions.
_ The first restriction limits the use of the subject property
to a parking facility usage.
Restriction two sets forth that a six (6) foot block wall shall•
be erected between the subject property grid an aujacer4t
residential lot. --
Restriction Three sets forth that in conjunction with the afore-
- noted block wall the applicant will implement and maintain a
five (5) foot landscaped area -contiguous. to said wall,

Attorney for his approval.
It will be necessary to have two officers of the McDonald•s
