AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, BY CHANGING THE
ZONING CLASSIFICATION OF APPROXIMATELY
3665 - 71 NORTHWEST 7TH STREET AND APPROXI-
MATELY 821 - 899 NORTHWEST 37TH AVENUE,
MIAMI, FLORIDA, (MORE PARTICULARLY DESCRIBED
HEREIN) FROM RG-2/5 GENERAL RESIDENTIAL TO
CR-2/7 COMMERCIAL RESIDENTIAL; MAKING
FINDINGS; AND BY MAKING ALL THE NECESSARY
CHANGES ON PAGE NO. 26 OF SAID ZONING ATLAS
MADE A PART OF ORDINANCE NO. 9500, BY
REFERENCE AND DESCRIPTION IN ARTICLE 3,
SECTION 300, THEREOF; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of June 22, 1983, Item No. 2, following an advertised hearing,
adopted Resolution No. PAB 66-83, by a 6 to 0 vote, RECOMMENDING
APPROVAL of a change of zoning classification, as hereinafter set
forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 3665 - 71
Northwest 7th Street and approximately 821 - 899 Northwest 37th
Avenue, Miami, Florida, more particularly described as, the
N293.63' of Lot 6 and the N398.47' of Lot 7, TROPICAL TRADES CO.,
STATION "A" (4-6), of the Public Records of Dade County, Florida,
from RG-2/5 GENERAL RESIDENTIAL to CR-2/7 COMMERCIAL RESIDENTIAL.
Section 2. It is hereby found that this zoning classi-
fication change:
(a) is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;

(b) Is not contrary to the established land use pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) Is not out of scale with the needs of the neighborhood
or the City;
(e) Would not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) Is necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or develop-
ment of adjacent property in accord with existing
regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare;
Section 3. Page No. 26 of the Zoning Atlas, made a part
of Ordinance No. 9500 by reference and description in Article 31
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this Ordi-
nance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.

Change of zoning classification from RG-2/5 GENERAL
RESIDENTIAL to CR-2/7 COMMERCIAL RESIDENTIAL in the
Official Zoning Atlas of Zoning Crdinance 9500, when
effective, subject to the covenant voluntarily proffered
by the owner, on file with Ordinance 9542; January 13, 1983.
To.translate a previously approved change of zoning in
Comprehensive Zoning Ordinance 6871 into a similar classi-
fication in new Zoning Ordinance 9500.
Ordinance 9542; January 13, 1983, changed the zoning
classification of the subject property from R-4 Medium
Density Multiple Dwelling to C-1 Local Commercial, as an
amendment to Comprehensive Zoning Ordinance 6871. To trans-
late this zoning change into a similar classification in new
Zoning Ordinance 9500 requires specific legislation and
public hearings on the advice of the Law Department.

DECLARATION OF RESTRICTIVE COVENANTS
This Declaration of Restrictive Covenants Running with the
Land ("Declaration") is made and entered into this lstday of No-
vember, 1982 by RACASA N.V., a Netherlands Antilles corporation
("Owner") and by MANUEL GARCIA, as representative of property
owners within 375 feet of Owner's property to be herein defined;
BACKGROUND FACTS
The Owner holds fee simple title to the Property described
in Exhibit "A" attached hereto and made a part.hereof ("Property").
Owner has applied- to the City of Miami ("City") to rezone
the Property to C-1 under the City of Miami Zoning Code.
Owner desires to offer certain assurances to the owners of
properties within 375 feet of the Property ("Neighbors") and to
the City, that if the Property is developed unde the C-1 classifi-
cation, Owner will buffer the Property.to reducer any adverse impacts
to Neighbors and will limit certain uses thereon.
The Owner recognizes and acknowledges that the Covenants
listed below are offered as a benefit to the public health, welfare
and safety.
COVENANTS -
Owner hereby agrees and covenants as follows:
1. That.if the Pop erty is rezoned to C-1, Owner will provide
a landscape buffer and a wall or planters'of no less than 5 feet in
height to run along.the North Property line Said landscape buffer
and walfor planters shall have a driveway opening which may be'used
as a service drive, and shall be clearly designated whereby, only
left turns will be permitted to those exiting the driveway.
2. That the landscape buffer will be maintained in a good
and healthy condition.
3. That if the Property is zoned C-1, the following C-1 uses
described below shall not be permitted thereon:
1. Clubs or Lodges, Fraternal or Religious Associations.
2. Parking lots and parking garages. (ORD.8066)
3. Clinics, Hospitals, Sanitariums, Convalescent
Homes and Nursing Homes.
4. Employment office. (0RD.7310)
5. Coin Operated Laundries. -
6. Automobile and boat repair, service and
maintenance facilities.
7. Substance abuse facilities -Non -Residential (ORD.8389)
8. Amusements Events, Temporary. (ORD.7267)
9. Educational Institutions of a business, professional
or scientific nature. (ORD.7310)
10. Gun Shops and Shooting Galleries.
Furthermore, in order to avoid certain uses that are in
violation of the C-1 classification and, because said uses have been
specifically designated as highly offensive by the Neighbors, the
Owner shall not permit the establishment and.operation of any kind
of wholesale stores, and specifically the following wholesale stores:
1. Fruit and Vegetables.
2. Grocery. -
3. Hardware.
4. Meat Market or Delicatessen.
4. These covenants shall be covenants running with the land
and shall be binding upon Owner, Owner's successors in title and
assigns and shall inure to the benefit of and be enforceable by all
owners of property within 375 'feet of the Property.
5. This Declaration shall' be in effect for a period of
THIRTY (BO) years from the date the documents are recorded in the
Public Records of Dade County, Florida, after which time,they shall
be extended automatically for successive periods of TEN (10) years
unless released, modified or amended as provided below.
6. This Declaration may be released, modified or amended as
to all or any portion of the Property by a written instrument approved
after a public hearing by Resolution of the Board of City Commissioners
or the Zoning Board of the City, whichever, by law, has jurisdiction
7. This Declaration is enforceable by the City or by any
owner of property within 375 feet of the perimeter of the Property,
by action at law or in equity with costs and reasonable attorneys
fees to the prevailing party.
