AN ORDINANCE AMENDING ORDINANCE NO. 9500, THE COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF MIAMI, BY CHANGING THE ZONING CLASSIFICA- TION OF LOTS 8, 9, and 10, BLOCK 2, HARDING HEIGHTS (6-138), LESS THE SOUTH 40' THEREOF, ALSO DESCRIBED AS APPROXIMATELY 2724-26-34 SOUTHWEST 7TH STREET FROM RG-1/3 (GENERAL RESIDENTIAL (ONE AND TWO FAMILY)), TO CR-3/7 [COMMERCIAL RESIDENTIAL (GENERALLY)], AND BY MAKING THE NECESSARY CHANGES IN THE ZONING ATLAS MADE A PART OF SAID ORDINANCE NO. 9500, BY REFERENCE AND DESCRIPTION IN ARTICLE 3, SECTION 300, THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT AND CONTAINING A SEVERABILITY CLAUSE. WHEREAS, the Miami Zoning Board at its meeting of April 18, 1983, Item No. 2, following an advertised hearing, adopted Resolution No. ZB-61-83, by a 5 to 0 vote, RECOMMENDING APPROVAL of a change of zoning classification of the south 40' of Lots 8, 9 and 10, Block 2, HARDING HEIGHTS (6-138) as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, deemed it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant a change of zoning classification for the entirety of Lots 8, 9 and 10, Block 2, HARDING HEIGHTS (6-138) as hereinafter set forth; WHEREAS, the City Commission by Ordinance No. 9658 changed the zoning classification of the south 40' of Lots 8, 9 and 10, Block 2, HARDING HEIGHTS (6-138), also described as the back portion of approximately 2724-26-34 Southwest 7th Street from RG-1/3 [General Residential (One and Two Family)] to CR-3/7 [Commercial Residential (Generally)]. NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. Ordinance No. 9500, the Comprehensive Zoning Ordinance of the City of Miami, Florida, is hereby amended by r 0 changing the zoning classification of Lots 8, 9 and 10, Block 2, HARDING HEIGHTS (6-138), less the south 40' thereof, also described as approximately 2724-26-34 Southwest 7th Street from RG-1/3 [General Residential (One and Two Family)] to CR-3/7 (Commercial Residential (Generally)), and by making the necessary changes in the Zoning Atlas made a part of said Ordinance No. 9500, by reference and description in Article 3, Section 300, thereof. Section 2. Should any part or provision of this ordinance be declared by a Court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole. Site plans for tracts of land where zoning changes are not anticipated on relatively small tracts of land will be reviewed by this department without traffic engineering study reports by a professional traffic engineering firm. The County's primary concern for all proposed developments is to assess the effect of the anticipated traffic on the City, County and State road systems.
