Subject: Emergency Ratification - MRC Garage
Purpose of Item:
The nature of this item is to authorize a resolution of the Miami City Commission, by a
four -fifths (4/5) affirmative vote, ratifying, confirming and approving the City Manager's
emergency finding, that is it most advantageous for the City of Miami to waive the
competitive sealed bidding procedures pursuant to Section 18-90 of the Code of the
City of Miami, Florida as amended, ("City Code") and retroactively approving the
selection of Florida Lemark Corporation, ("Florida Lemark") for the replacement of the
barrier cable system at the City of Miami's Riverside Center ("MRC") Parking Garage for
an approximate amount of $82,918.00. Authorizing the City Manager to negotiate and
execute any and all documents, including any amendments, modifications, for the
replacement of the barrier cable system for the MRC parking garage, subject to all
allocations, appropriations, and budgetary approvals having been previously made,
compliance with applicable provisions of the Code of the City of Miami, Florida, as
amended, ("City Code"), including the City of Miami's Procurement Ordinance, Anti -
Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the
City Code, in a form acceptable to the City Attorney, and in compliance with all
applicable laws, rules, and regulations, as may be deemed necessary for said purpose.
Background of Item:
On January 15, 2023 the City of Miami General Services Administration ("GSA")
requested an emergency structural assessment of the existing conditions of the MRC
parking garage from RH Engineering Group, Inc., ("RH Engineering"). It was assessed
by RH Engineering that the barrier cables which serve as the guardrail system at each
floor along the center column grid were in poor condition and show advance
deterioration and one (1) broken cable at the top floor of the garage. The barrier cable
guardrail system is a life safety component and needed to be fixed in a timely manner
as this is a public emergency with threats to health, life, welfare or safety. GSA is
requesting retroactive approval for the replacement of the barrier cables in the MRC
parking garage by Florida Lemark, which posed a public safety threat.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A
FOUR -FIFTHS (4/5) AFFIRMATIVE VOTE, CONFIRMING, RATIFYING, AND
APPROVING THE CITY MANAGER'S EMERGENCY FINDING, ATTACHED AND
INCORPORATED AS EXHIBIT "A," PURSUANT TO SECTION 18-90 OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDDING METHODS AS NOT BEING
PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI ("CITY"), FOR
SELECTION OF FLORIDA LEMARK CORPORATION, A FLORIDA PROFIT
CORPORATION ("FLORIDA LEMARK"), FOR THE REPLACEMENT OF THE
BARRIER CABLE GUARDRAIL SYSTEM AT THE CITY'S MIAMI RIVERSIDE
CENTER ("MRC") PARKING GARAGE, FOR AN APPROXIMATE TOTAL AMOUNT OF
EIGHTY TWO THOUSAND NINE HUNDRED EIGHTEEN DOLLARS ($82,918.00);
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL
DOCUMENTS, INCLUDING ANY AMENDMENTS OR MODIFICATIONS, SUBJECT
TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS,
COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CITY CODE,
INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT,
AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF
THE CITY CODE, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND IN
COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS
MAY BE DEEMED NECESSARY FOR SAID PURPOSE.
WHEREAS, the City of Miami ("City") General Services Administration ("GSA")

WHEREAS, the barrier cables, which serve as the guardrail system at each floor, were

WHEREAS, the barrier cable guardrail system is a life safety component and needed to
be fixed in a timely manner; and
WHEREAS, Florida Lemark Corporation, a Florida profit corporation ("Florida Lemark"),
was selected for the emergency replacement of the MRC parking garage barrier cable guardrail
system for an approximate total amount of Eighty Two Thousand Nine Hundred Eighteen
Dollars ($82,918.00); and
WHEREAS, the City Manager, pursuant to Section 18-90 of the Code of the City of
Miami, Florida, as amended ("City Code"), approved an emergency finding, waiving competitive
sealed bidding methods as not being practicable or advantageous to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, confirming the City Manager's
emergency finding, attached and incorporated as Exhibit "A," pursuant to Section 18-90 of the
City Code, waiving the requirements for competitive sealed bidding methods as not being
practicable or advantageous to the City, for selection of Florida Lemark, for the replacement of
the barrier cable guardrail system at the City's MRC parking garage, for an approximate total
amount of Eighty Two Thousand Nine Hundred Eighteen Dollars ($82,918.00), is hereby
confirmed, ratified, and approved.
Section 3. The City Manager is authorized' to negotiate and execute any and all
documents, including any amendments and modifications, subject to all allocations,
appropriations, prior budgetary approvals, compliance with all applicable provisions of the City
Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity
Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City
Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed
necessary for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption.
