HomeMy WebLinkAboutR-23-0237City of Miami Resolution R-23-0237 alldl 11 li.Rl I + Legislation File Number: 13835 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 5/25/2023 A RESOLUTION OF THE MIAMI CITY COMMISSION, AUTHORIZING THE CITY MANAGER TO ACCEPT A DONATION, FROM KEARNS CONSTRUCTION COMPANY, A FLORIDA PROFIT CORPORATION ("KEARNS"), FOR THE CITY OF MIAMI (`CITY") OFFICE OF CAPITAL IMPROVEMENTS ("OCI"), IN THE FORM OF SIX HUNDRED (600) CUBIC YARDS OF RIP RAP CONSTRUCTION MATERIAL ("CONSTRUCTION MATERIAL"), AS WELL AS ALL COSTS ASSOCIATED WITH THE TRANSPORTATION OF THE SAME, FOR AN APPROXIMATE TOTAL VALUE OF ONE HUNDRED FOURTEEN THOUSAND DOLLARS ($114,000.00); FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A DONATION LETTER OF ACCEPTANCE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; ALSO FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL DOCUMENTS, INCLUDING ANY AMENDMENTS AND MODIFICATIONS, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. WHEREAS, the City of Miami (`City") Office of Capital Improvements ("OCI") has a continuous need for preventing erosion caused by waves or water flow in the City's environmentally protected areas and for preserving the natural shoreline as best possible; and WHEREAS, Kearns Construction Company, a Florida profit corporation ("Kearns"), has offered to donate six hundred (600) cubic yards of Rip Rap construction material ("Construction Material"), and cover all costs associated with the marine transportation of the same; and WHEREAS, the City will be able to properly install the Construction Material and monitor the site to ensure that it will prevent erosion and minimize the environmental impact on the shoreline; and WHEREAS, the acceptance of this Construction Material will be beneficial to the City by providing a means of promoting natural environmental protection in a responsible manner; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are City of Miami Page 1 of 2 File ID: 13835 (Revision:) Printed On: 513112023 File ID: 13835 Enactment Number: R-23-0237 adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized' to accept a donation, from Kearns, for OCI, in the form of six hundred (600) cubic yards of Construction Material, as well as all costs associated with the transportation of the same, with an approximate total value of One Hundred Fourteen Thousand Dollars ($114,000.00). Section 3. The City Manager is hereby further authorized' to execute a donation letter of acceptance, in a form acceptable to the City Attorney, for said purpose. Section 4. The City Manager is hereby also further authorized' to execute any and all documents, including any amendments and modifications, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the Code of the City of Miami, Florida, as amended ("City Code"), including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption.
