AN ORDINANCE AMENDING SECTION 54-39 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED CONCERNING COSTS FOR STREET RESTORA- TION BY PROVIDING FOR TIME FOR COMPLETION; PROVIDING FOR CONSEQUENCES OF FAILURE TO COMPLETE STREET RESTORATION; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the companies and agencies providing utility services in the City frequently make excavations in the street right of way; and WHEREAS, these companies and agencies are often remiss in making proper restoration of the street in a timely manner; and WHEREAS, the public is severely inconvenienced by the lack of proper street restoration agencies; and by the above companies and WHEREAS, the public frequently suffers damage to personal property and occasional personal injury as a result of the above lack of street restoration; and WHEREAS, the City has also suffered financial loss as a result of litigation arising from the lack of proper restoration; and WHEREAS, the City Commission deems it advisable in the interest of the general health, welfare and safety of the public to ensure that these restorations are made in a timely manner; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 54-39 of the Code of the City of Miami, Florida, as amended, is further amended in the following particulars:l "Section 54-39. Same - Payment of Amount of Costs for Restoration; Issuance of Permit; Time for Completion- Consequences of Failure to Complete Street Restoration, ;f Words and/or figures stricken through shall be deleted, Under. scored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. ( a ) the-a�pl#ennt-fer-e-perrntt-regt�#red by Stet#en 54-34 Whenever any individual applies for a permit for excavation of a street, or other public right ot way, or easement, as required by section 5 :: , he Mir pay to the director of public works in the form of cash or certified check payable to the My o? Miami t o amount of the cost of the restoration as calculated by the director of public works and shall sign his acceptance of the terms of the permit, and thereupon the permit shall be delivered to the applicant who shall thereafter, and not before, be authorized to proceed with the work, and shall complete ItAe same within the time prescribed by the permit. (b) Whenever any company or age_n providing utility services in the City applies tor a permit for excavation in the street or other public right of way or easement, as required by section 54- , t e company or agency shall deliver to tie erector of public works a case bond or cashier's check in the amount of two times the cost of restoration as calculated under section 54-38. (c) U on receipt of the above cash bond or cas ier s Check and completion of t e appropr ate application, the director=o public works shall deliver a permit f6r the work, an3 shal therein fix such time for completion of the work; -including restoration of the street, rig t of way or easement in accordance with the standards and specifi- cations of the department of public works. The company or agency shall thereafter, and not before, a authorized to proceedwith t e work ana sHall mplete the same within the timeprescribed by the permit. (d) Upon proper completion of the work by t o permittee, including the above restoration, within the time prresc_1' e` the ermitt, the director o ublic works shall cause the amount of the cash bond or the sums paid by cas ier s check, and any payment made under subsection ahereof to e returned to the person, company or agency to whom the permit was issued. (e) In the event that the permitted com any or agency ai,s or refuses to comRlete the work, including restoration, within the time specified y the permit, all a iments including the above s ecified cash bond, or cash ier s c ec , shall e eeme forfeit. The director of public- works s a then be empower d to cause restoration to e one by contract, or by City orces, wit out regard to the status o the worksought to e one under the permit and all costs the --reo shall e payable by the permitte n v ua , company, or agency. _It the required amount s not remitted within ten da s of written not ce y t e rector ot public works to the permitted individual, cOm2any or agency, -the forfeit monies sha be used to comelete the work. Section 2. The City Manager is hereby instructed to schedule the subject of improper street restoration together with a copy of the herein ordinance on a City Commission Meeting agenda in November, 1984. Section 3. All ordinances or parts of ordinances in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Ca-tfier ENCLOSURES: September 29, 1983) Director of Public Works It is recommended that the Commission adopt an amendment to the City Code Chapter 54, Streets and Sidewalks, to provide for a bond to cover the cost of restoration of streets after excava- tion, and to provide for penalties if the restoration is not accomplished in an expeditious manner. The utilities companies frequently excavate portions of the streets in the City for repair or extension of their facilities. Often, the street surface is not restored in a timely manner causing serious inconvenience to the public. To rectify this inconvenience to the public and eliminate hazards to the motorists, as a prerequisite to issuance of a permit the contractor must deposit with the City a bond in a sufficient amount to cover the cost of the street restora- tion. The Commission has directed the Administration to prepare legislation to rectify this problem. The attached amendment to the City Code provides for said bonding of any person or companies excavating within the public right-of-way to ensure expeditious restoration of the streets and provides penalties in the event of default.
