AN EMERGENCY ORDINANCE AMENDING ORDINANCE
NO. 9534, ADOPTED DECEMBER 95 1982, THE
EXISTING CAPITAL IMPROVEMENTS APPROPRIATIONS
ORDINANCE; AS AMENDED; BY APPROPRIATING THE
AMOUNT OF $65500,000 FOR LAND ACQUISITION
AND SITE ASSEMBLY FOR THE AFFORDABLE RENTAL
HOUSING PROGRAM FROM THE ANTICIPATED SALE OF
1976 GENERAL OBLIGATION HOUSING BONDS;
CONTAINING A REPEALER PROVISION
AND SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 9534
on December 9, 1982 establishing resources and appropriations
for the implementation of certain capital improvements in the
City of Miami; and
WHEREAS, the City Commission adopted Resolution No. 83-986
on October 25, 1983, authorizing the use of $6,500,000 in
Capital Improvement Funds Fiscal Year 1982-83 Florida Power
and Light Franchise Revenues on a temporary basis to fund the
acquisition of project development sites for the Affordable
Rental Housing Development Program until such time as general
housing bonds are sold; and
WHEREAS, the amount of $6,500,000 is available from the
Capital Improvement Fund, Fiscal Year 1982-83 Florida Power
and Light Franchise Revenues on an interim basis for this
purpose; and
WHEREAS, subsequent to the anticipated sale of 1976
Housing General Obligation Bonds, the FY 1983 Florida Power
and Light Franchise Revenue funds will be reimbursed; and
WHEREAS, the amount of $6,500,000 is hereby appropriated
for Land Acquisition and Site Assembly for the Affordable
Rental Housing Development Program from the anticipated sale
of 1976 Housing General Obligation Bonds; and
WHEREAS, this Ordinance further makes corrections to Item
VIII. 1976 Housing General Obligation Bond Fund, to reflect
current financial needs and associated project appropriations
based on adopted City Commission actions and resolutions;

,t NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE

CITY OF MIAMI, FLORIDA:
Section 1. Section .1 of Ordinance No...9534, adopted December 9,
1982, as amended, is hereby amended in the following
particulars:)
"Section 1. The following appropriations hereby made by
fund and project title include previously authorized projects
and fund appropriations for implementation of all municipal
capital improvements of the City of Miami, Florida. The source
of revenues to support the herein appropriations are hereby
identified by fund and project:

Section 2. All ordinances or parts of ordinances in
conflict herewith, insofar as they are in conflict, are hereby
repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this ordinance is declared invalid, -
the remaining provisions of this ordinance shall not be
affected.
Section 4. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the
City of Miami, and upon the further ground of the necessity to
appropriate sufficient funds to allow the City to proceed with
the Affordable Rental Housing Development Program.
Section 5. The requirement of reading this ordinance on
two separate days is hereby dispensed with by an affirmative
i vote of not less than four -fifths of the members of the

Commission.

It is recommended that the City Commission by
Emergency Ordinance, amend Ordinance No. 9534,
adopted December 9, 1982, (Capital Improvement
Appropriation Ordinance, as amended); appropriating
$6,500,000 from the Capital Improvement Fund,
proceeds of Fiscal Year 1982-83 Florida Power and
Light Franchise Revenues to the 1976 Housing General
Obligation Bond Fund to fund on an interim basis
acquisition of project development sites under
the City of Miami Affordable Rental Housing
Development, per the attached Ordinance.
On March 17, 1981, the City Commission, through Resolution No.
81-173, authorized the use of up to $8,000,000 in General
Obligation housing bond proceeds for acquisition of project
development sites for the Affordable Rental Housing Development
Program.
On July 22, 1982, through Resolution No. 82-678 the City Commission
approved acquisition of four (4) project development sites. The
Civic Center site and the Melrose Nursery site are being acquired
through negotiated purchase. The remaining two sites, P.B.A. and
Highland Park, are being acquired through Eminent Domain
proceedings.
In November, approximately $1,134,000 will be required to execute
the option held by the City on the Civic Center site. Also in
November, a closing will be held for purchase of the Melrose
Nursery site. The acquisition cost for Melrose Nursery, including
relocation and closing costs, is $2,520,000. In December, the City
will be required to deposit with the Court an amount (approximately
$2,500,00 ), equal to the appraised value of the two sites to be
acquired through Eminent Domain.
General Obligation housing bonds will be issued in an amount equal
to the cost of acquisition and related site purchase costs in
accord with the City's bond sale schedule. By Resolution No.
83-9869 the City Commission authorized use of $6,5009000 in Capital
Improvement Funds (said proceeds from Fiscal Year 1982-83 Florida
Power and Light Franchise Revenues) on a temporary basis to fund
the acquisition of project development sites.
The said $6,500,000 will be reimbursed to the Capital Improvement
Fund, Fiscal Year 1982-83 Florida Power and Light Franchise Fund,
upon the sale of up to $8,000,000 in General Obligation Housing
Bonds.
Due to the immediate need to make available funds to meet these
costs, the appropriation of said funds is essential.
Approval of the attached Ordinance is recommended.
