HomeMy WebLinkAboutO-097373-83-974 iI idment No. 3 to 0 finance No. M4 ORDINANCE NO. 9737 AN EMERGENCY ORDINANCE AMENDING SECTIONS 2 AND 6 OF ORDINANCE NO. 9684 ADOPTED SEPTEMBER 29, 1983, THE ANNUAL APPROPRIATIONS ORDINANCE FOR FISCAL YEAR ENDING SEPTEMBER 30, 1984, AS AMENDED BY ESTABLISHING A SPECIAL REVENUE FUND ENTITLED, "LOCAL OPTION GAS TAX TRANSPORTATION SYSTEM MAINTENANCE''AND I PR V EN 'F R IMPLE E TATION IN TISCAL YEAR 1983-84 FOR THE PURPOSE OF PROVIDING FUNDING IN THE AMOUNT OF $3,100,000 FOR SPECIFICALLY DEFINED TRANSPORTATION PROJECTS AS OUTLINED IN FLORIDA STATUTE 336.025(c), REVENUES IN A LIKE AMOUNT ARE AVAILABLE FROM THE DADE COUNTY LOCAL OPTION GAS TAX, AND CAN BE ALLOCATED TO THE CITY THROUGH AN INTERLOCAL AGREEMENT WITH METROPOLITAN DADE COUNTY, THE CITY OF HIALEAH AND THE CITY OF MIAMI BEACH AS AUTHORIZED BY RESOLUTION NO. 83-552, ADOPTED JULY 18, 1983; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9684 on September 29, 1983, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1984; and WHEREAS, the City of Miami entered into an interlocal agreement with Metropolitan Dade County, the City of Hialeah, and the City of Miami Beach to provide for the distribution of the Dade County Local Option Gas Tax as authorized by Resolution No. 83-552, adopted July 1P, 1983; and WHEREAS, these funds are restricted to be used for transportation system maintenance and improvements in order to comply with Florida Statutes, Section 336.025(c); and WHEREAS, before monies can be expended to accomplish these purposes, it is necessary to establish a special revenue fund containing resources and appropriations. NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2 and 6 of Ordinance No. 9684 adopted September 29, 1983, the Annual Appropriations Ordinance for fiscal year ending September 30, 1984, is hereby amended in the folowing particulars: 1/ "Section 2. The following appropriations are made for the municipal operations of Cable Television, Rescue Services, Southeast Overtown/Park West, Federal Revenue Sharing for fiscal year 1984 and Local Option Gas Tax Transportation System Maintenance and Improvements of the City of Miami for the fiscal year 1983-84: 17 d s and/or figures stricken roug shall, e deleted.' The herein Special Revenue Fund is established for the purpose of providing funds in the amount of $3,100,000 for specifically defined transportation projects as outlined in Florida Statute 336.025(c), revenue in a like amount is available from the Dade County Local Option Gas Tax and can be allocated to the City through an interlocal agreement with Metropolitan Dade County, the City of Hialeah and the City of Miami Beach as authorized by Resolution No. 83-552, adopted July 18, 1983. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, part of secticn, paragraph, clause, phrase or word of this ordinance shall be held to be invalid, the remaining provisions of this ordinance shall not be affected. Section 5. The requirement of reading this ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of. the -members of the Commission. Section 6. SlVment irector Department oand Budget DATE: October 31, 1983 Mg, DMB47/Jw SUBJECT: Establishment of a Special Revenue Fund REFERENCES: ENCLOSURES: It is recommended that the City Commission approve the attached emergency ordinance establishing a Special Revenue Fund entitled Local Option Gas Tax - Transportation Maintenance Svstem an -Improve- ments to fund specifically defined transportation p acts as outlined in Florida Statute 336.025(c). State Law allowed Metropolitan Dade County to impose an additional four cents per gallon gasoline tax on the number of gallons sold within the County limits in order to provide needed revenue to improve the transportation support systems throughout the County. These monies are to be shared with the municipalities located within the County based on the following formula: 1. Metro Dade County will receive 74% of all gas tax proceeds and 26% is to be shared by all eligible Dade County muni- cipalities. 2. Each individual City's share is to be determined by a for- mula which is based 75% upon the ratio of the population of each eligible City to the total population of all eli- gible Cities in Dade County and 25% upon the ratio of total centerline miles of roadway maintained by each eligible City compared to the total centerline miles maintained by all eligible Cities in Dade County. The City of Miami entered into a interlocal agreement with Metropolitan Dade County, the City of Hialeah and the City of Miami Beach authorized by Resolution No. 83-552 adopted July 18, 1983, which provided for the distribution of the local option gas tax collections. The City's share of same is estimated to be $3.1 million annually for the next five years. This money will be used to maintain and improve existing public transportation systems roadway and right's -of -way, streetlighting, traffic signs, etc. throughout the City. This proposed ordinance is prepared for the November 16, 1983 regular City Commission Meeting.
