HomeMy WebLinkAboutO-09736�tr J-83-1008 AMENDMENT No. 21 TO ORDINANCE No. 9534 ORDINANCE No.- Q 7 3 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 9534, ADOPTED DECEMBER 9, 19820 THE EXISTING CAPITAL IMPROVEMENT APPROPRIATION ORDINANCE; AS AMENDED; BY INCREASING APPROPRIATIONS FOR JOSE MARTI PHASE I IN THE AMOUNT OF $20,000, AND JOSE MARTI PHASE II IN THE AMOUNT OF $20,000 FROM THE 1972 PARK AND RECREATIONAL FACILITIES GENERAL OBLIGATION BOND FUND BALANCE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9534 on December 9, 1982 establishing resources and appropri- ations for the implementation of capital improvements in the City of Miami, Florida; and WHEREAS, the City Commission, by Resolution No. 83-652 on July 18, 1983, approved the selection of Rolando Lopez Dirube to create on 8' x 40' mural for Jose Marti Park; and WHEREAS, the construction of the wall upon which the mural was placed resulted in a $20,000 shortfall in the appropri- ations for Jose Marti Phase I; and WHEREAS, Jose Marti Phase II is funded in part by Land and Water Conservation Funds, and WHEREAS, these funds carry the requirement that the project be under construction by December 31, 1983, and be completed by September 30, 1983; and WHEREAS, the lowest most responsible bid received was for $20,000 more than the appropriations available for Jose Marti Phase II; and WHEREAS, the amount of $40,000 is available and can be transferred from the remaining Parks for People District VII Improvements in the VI.1972 Park and Recreational Facilities. General Obligation Bond Fund to the IX.Capital Improvement Fund for the above mentioned projects; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: .Section 1. Section 1 of Ordinance J b . 9534, adopted Decker 01, 1902, as amended, is hereby further amended in the following particulars:l 4 "Section 1. The following appropriations hereby made by fund and project title include previously authorized projects and fund appropriations for implementation of all municipal capital improvements of the City of Miami, Florida. If any section, part of section, paragraph, clause, phrase or work of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the pre- servation of peace, health, safety, and property of the City of Miami, and upon the further ground of the necessity to appropriate sufficient 0 4 funds for the completion of Jose Marti Phase I and so that a construction contract may be awarded in order to meet construction commencement and completion deadlines, as required by the grant received from the Land and Water Conservation Fund for Jose Marti Phase II. Section 5. The requirement of reading this ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the commission. The City Commission, by Resolution No. 83-652 on July 18, 1983, approved the selection of the artist, Rolando Lopez Dirube, to create an 8' x 40' mural in Jose Marti Park. The construction of the wall on which the mural was mounted resulted in a $20,000 shortfall in the appropriations.for Jose Marti Phase I. • Jose Marti Phase II is funded in part by grants received from the Land and Water Conservation Fund. The funding for these grants was a result of Public Law 98-8, the Jobs Bill, and has the requirement that construction commence before December 31, 1983 and be complete by September 30, 1983. The lowest bid received for this project is $20,000 more than the available appropriations. Monies to meet these unforeseen shortfalls are available in the 1972 Parks for People Bond Fund Balance for District VII.
