HomeMy WebLinkAboutR-83-1084J-83-1012 RESOLUTION NO. 83-1084 A RESOLUTION ACCEPTING THE PLAT ENTITLED GENESIS SUBDIVISION, A SUBDIVISION IN THE CITY OF MIA111, ACCEPTING THE DEDICATIONS SH014N ON SAID PLAT, AND AUTHORIZING AFD DIRECTING THE CITY MANAGER A14D CITY CLERK TO EXECUTE THE PLAT AND PROVIDING FOR THE RECORDATION OF SAID PLAT IN THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA. WHEREAS, the City Zoning Board and the Department of Public Works have recommended the acceptance of the plat: NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The plat entitled Genesis Subdivision is a resubdivision of a portion of Block 6A of Revised Plat of Block 6 of Durward Heights according to the Plat thereof as recorded in Plat Book 38 at Page 28 of the Public Records of Dade County, Florida, all lying in Section 6, Township 54 South, Range 41 East, City of Hiami, Dade County, Florida which subject plat by reference is made a part hereof as if fully incorporated herein and which plat, together with the dedications shown thereon, and the dedications to the perpetual use of the public of all existing and future planting, trees and shrubbery on said property, is hereby accepted and confirmed by the City of Pliami, Florida. Section 2. The City Manager and City Clerk are hereby authorized and directed to execute the plat and cause the same to be recorded in the Public Records of Dade County, Florida. For November 18, Commission Meeting The Department of Public Works recommends the approval of the plat by the City Com- mission of Miami, Florida, and certifies its correctness as to form. The proposed record plat entitled Genesis Subdivision is a resubdivision of a portion of Block 6A of Revised Plat of Block 6 of Durward Heights (38-28) and will consist of one lot. It is zoned RS-2/2. *This plat is being forwarded to your office for City Commission action. It is in correct form for submission to the City Commission and is forwarded with a recommendation that it be approved. PERTINENT INFORMATION REGARDING THE PLAT: (1) The property platted is a resubdivision of a portion of Block 6A of revised plat of Block 6 of Durward Heights (38-28) and will consist of one lot. It is zoned RS-2/2. (2) The location of the streets and the widths conform with the standards of the Department of Public Works of the City of Miami, Florida. (3) As certified to by Omar Armenteros, Registered Land Surveyor, this Plat complies with the plat filing laws of the State of Florida. (4) The City Zoning Board of Miami, Florida, after Public Hearing, has recommended the closing of S.W. 54bh Avenue alley. This action was confirmed by City Commission Resolution No. 83-356. (5) By authority of Resolution No. 101-83, adopted June 13, 1983, the Plat was recommended for acceptance by the City Zoning Board of Miami, Florida. (6) The attached Certificate of Title Examination dated October 4, 1983, signed by David D. Phillips, Attorney, indicates that the fee simple title to the property platted is correctly vested in Gerald Lynn Zimmerman and Sue Jim Lake Zimmerman, his wife and the Plat has been correctly executed. • 83-1084 (7) The area platted is encumbered by a mortgage and the mortagage holder has executed the Plat and joined in its dedications. (8) In accordance with the requirements of Chapter 54, Section 54-30, of The City of Miami, Florida, a Cashier's Check in the amount of $2,200 has been tendered by the owner, Gerald Zimmerman. This Cashier's Check has been deposited with the Director of Finance and will guarantee the completion of the subdivision improvements according to the provisions of the Agreement between The City of Miami and the aforementioned Gerald Zimmerman. The Cwner hereby agrees to abide by all of the provisions of the' "Guide for Work in the Public Right -of -Way", a copy of which is attached hereto and by this reference made a part herof. 2. In accordance with the provisions of said Chapter 54, Section 54-30, THE CODE OF THE CITY OF MIAMI, FLORIDA, the Owner herewith deposits with the City a Cashiers Check in the amount of $a,a -which amount -is not less than Qne hundred (100%) percent of the estimated cost of the construction of the improvements listed in the attached Exhibit "B", plus twenty-five (257.) percent for engineering or contingent costs and damage, the conditions of the deposit thereof being such that if the Owner shall fully and faithfully perform the work I in accordance with the terms of this Agreement and has submitted to the City of Miami Department of Public Works a letter from a Registered Land Surveyor certifying that the Permanent. Reference Monuments indicated on the Plat have been installed and properly placed, the amount of said - check shall be returned to the.Owner; otherwise, in the event of the failure or neglect of the Owner to perform this Agreement, said check` shall be applied by said City to the cost of constructing or completing + the improvements, together with any engineering or contingent costs, and any damages direct or indirect, not'to exceed twenty-five (25%) percent thereof, which said City may sustain on account of the failure of the Owner to carry out and execute all of the provisions of this Agreement.
